Quackpot Barrett Crushed in Federal Court - Again...

Some people never learn. Stephen Barrett (quackwatch.com) seems to be
one of those.
Despite loss after loss, and humiliation on top of humiliation, self
styled "quackbuster" Stephen Barrett trudges on to the next
embarrassment.
Like a bug in the fast lane, Barrett is doomed to be wiped off the
windshield of the North American Health Freedom Movement time after
time, I guess.
This time, Barrett, apparently stung from defeats in other arenas, and
perhaps trying to reclaim some dignity from a world becoming accustomed
to laughing at his anti-health antics, sued the attorney, Carlos
Negrete, he's come to associate with his steady downfall in the politics
of health care.
I'm not sure what the subject of Barrett's suit against Negrete in
Federal Court in San Diego was all about. Barrett submits volumes of
whiney material in his court actions, none of which, to me, seems to be
acquainted with reality. But what I do know, is that Barrett used as
his own attorney, one Morse Mehrban, listed as the general counsel of
the National Council Against Health Fraud (NCAHF). It was Mehrban who
was quoted in the LA Law Journal as saying "I consider suicide daily."
"Suicide daily?"
Negrete flattened them both - without breaking a sweat. Another victory
for GOOD, in the battle against EVIL.
Of course, Barrett also sued, in the same lawsuit, world renowned
health-humanitarian Hulda Regehr Clark PhD, N.D. Barrett can't seem to
talk, or write, these days, without bringing up Clark's name in some
way. So, I'm not surprised he put Clark's name in the lawsuit. He
describes her as "Unlicensed Naturopath Hulda Clark," in his writing.
His hatred and resentment of her accomplishments, compared to his, are
obvious. He lost to Clark, too...
Barrett had to allegedly "retire" from the medical profession, giving up
his license in 1993, when he was in his mid-50's. He admits that he
didn't have enough medical practice income in 1993 to even pay the
required malpractice insurance premiums. Barrett, who claims to be a
retired Psychiatrist, was forced to admit in court documents (forced by
Negrete) that he only had nine patients all year, each year, for several
years, before he supposedly "retired." Psychiatrists get their
patients from referrals from other MDs. Doctors in the LeHigh Valley of
Pennsylvania just weren't sending him any business. Anybody wonder why?
And now Barrett is failing as a "quackbuster."
By the way - Barrett lost in an anti-SLAPP motion, which means he gets
to pay Negrete, and Clark's, attorney fees...

I was following an old link from Grant today and found this, which i

For Quackbuster's NCAHF - It's All Over But The Shouting...

The Quackbuster Flagship sank today. A Three Judge California Appeals
Court broad-sided it. Let's all go watch it slide under the waves.
Bring a bottle of wine and some paper cups.
We already know that the quackbusters have ZERO credibility with the
American court system. So it's not going to be a surprise to anyone
that the National Council Against Health Fraud (NCAHF), today, lost the
decision they appealed over the case called "NCAHF v. Botanical
laboratories, et al."
Here are the the Three Judge Panel's words...
"Conclusion - Appellant (NCAHF) believes that no one should be allowed
to market homeopathic remedies. Congress has decided otherwise, and
officially recognizes the Homeopathic Pharmacopoeia. Appellant's
broad-brush approach of sweeping all homeopathic remedies into a single
bag marked "undesirable" simply does not work in the courts, where each
claimed instance of unfair advertising and unfair business practice must
be closely scrutinized. Appellant failed to present any admissible
evidence in this case that respondents are guilty of false advertising
and unfair business practices with respect to any of their products."
The NCAHF lost on a SLAPP (Strategic Lawsuit Against Public
Participation) Motion. Which means they owe the Defendants Attorney
Fees. Al Lohrman, chief counsel on this case, said to me, today, in an
e-mail "By the way, the trial court also awarded us attorneys' fees on
our anti-SLAPP motion, as provided by law."
And, there's the rub.
The NCAHF is operating out of a cardboard box in the back room of Bobbie
Baratz's Braintree, MA hair removal salon, and has so little money, that
Baratz begged members for cash, offering a picture of me (Tim Bolen) as
an incentive for contribution.
According to court documents, NCAHF Board members, it turns out, were
COMPLETELY UNAWARE that Baratz and Barrett had made the NCAHF the
Plaintiff in these cases. Court documents show that Baratz and Barrett
had set up this case to generate "expert witness" fees for themselves.
Baratz is the current President of the NCAHF. Barrett is a failed MD
who operates the dubious website quackwatch.com out of his basement in
Allentown. PA.
Legal fees, by my estimate, will run around $500,000 to $700,000. It
looks to me, like the individual NCAHF BOARD MEMBERS, and the MEMBERS,
may be legally liable for the attorney fees...
The court, in it's decision, quoted the earlier Health Freedom Appeals
Court Victory in NCAHF v. King Bio like this:
"In the context of a lawsuit against homeopathic manufacturers of
homeopathic remedies, 'there is nothing in the nature of a false
advertising action that makes it difficult for a plaintiff to prove
allegations of the complaint. The homeopathic remedies are marketed and
readily available for testing by the plaintiff. The falsity of the
advertising claims may be established by testing, scientific literature,
or anecdotal evidence.' (NCAHF v King Bio). Appellant provided no
admissible, prima facie evidence that the respondents' advertising is,
in fact, false....In addition, appellant presented no evidence at all
that respondents' advertising is likely to deceive consumers."

workplace. I've had great success at settling some very distressed
newborn babes.These are those babies who have been fed,have dry
nappies(diapers)and for some reason or another just are unable to

Not that chanters can't appreciate a little rock now and then. Copies of
"Abraxas" and "Born to Run" share shelf space with "Himalayan
Melodies of
Nepal" in Jon Seskevich's Iredell Street living room. The advanced
practice
nurse at Duke University sings in a local monthly chanting group,
Universal
Chanting, and teaches patients guided relaxation and meditation to
handle
stress. Seskevich strongly believes in the mind-body connection.
Stress -
which he calls the body's response to change - factors in more than
half of
all disease, Seskevich said. People under stress tend to take shallow
breaths that don't take in enough oxygen. Teaching patients to
repeat words
in concert with deep abdominal breathing is some of the best
medicine he can
offer. "Sometimes you can't control health problems coming at you,"
he said.
"You can control your response to them."
A born Methodist, Seskevich today practices a personal religion with
three
tenets: Love everyone, serve anyone and remember God. When he
teaches
chanting, he picks words and phrases that respect people's religious
traditions. Most faiths feature some form of repetitive singing, he
said.
Unlike hymns, however, chants are open ended. They cycle until the
chanter
feels it is time to end. And that, he said, comes only with
practice. "For
me, chanting is a way to quiet the mind and open the heart, a way of
deepening one's spiritual connections," he said. "If we try to analyze
and
figure it out, it kind of keeps you on the intellectual level."

Take Krieger's old hemoglobin study -- it is still cited prominently in most nursing articles on TT, though it was definitively ground into the dust by Clark and Clark in 1984. Good grief, even TT research reporting no significance take on significance in later recountings. Even if Long's study were to die a thousand deaths at the hands of scientific scrutiny, I assure you it will live on and on in nursing academia.
I am so saddened by all this. I feel like years of progress made by many hard-working, pro-science nurses is being undone before my eyes. Things looked promising, but now I don't think we'll ever be able to turn the nursing profession back onto the path of science.
I would wish that whenever skeptics declare war on other skeptics that, at least, a healthy competition would ensue. That would happen if the major focus of all parties was confronting quackery.
Good thought on the picture for emily - wouldn't want to tax her 4th
grader's reading ability...
Maybe you have offered the real explanation for why emily still doesn't "get
it" - there is no classics illustrated statistics comic book at her
intellectual level... but then, there isn't one at yours, stephen's,

Massive Fluke Die Off Leaves Many Worried

Badbad, Last year's epidemic of foot-in-mouth disease was somehow abated,
temporarily at least. While SARS is sweeping Hong Kong, this year a new
illness has been detected in Badbad.
Health Freedom Fighters by the tens took to the streets today wearing white
armbands and bemoaning the death of the liver fluke and their loss of
leadership.. It seems a parasitic disease has swept through the fluke
population and, well, killed them all off. "Who shall we worship now?" asked
a bemused follower of the zapper cult. "Darnn" said another, I just bought a
two year supply of batteries at Radio Shack, "and I'm drowning in walnut
tincture". " I wonder if I can get my money back, what else can yo do with
this stuff?" bemoaned another.
Most of the leadership of the Bowel Movement shrugged off the issue. They
simply moved on to create the next pseudo-epidemic, and from their caves, in
hiding, they issued a press release announcing a new scourge, parasitic
moonbeam fungi. "And we have a special new machine, the flung dung shui
detector to find them, and a second device, the Reppaz, to keep them at bay.
"It's much like a zapper but it works in reverse., they proclaimed," and "we
have a much better disguised web site to sell them with this time; the FTC
won't find us so easily." To view the site you need a mirror (since the
writing is all backwards), and some smoke to obscure any names. Get it?
The fluke die off has virtually wiped out the cross-border home of Last
Century Nutrients and Nutriceuticals, a decaying idea of a clandestine pink
house disguised as a clinic. " We're so sad, " said a clinic worker, "we
were just getting used to the regular raids by the authorities, the deaths
of our cleints, and the disclaimers by the owner that this place is really
just a house." "Even our publicist doesn't take credit for us anymore," she
said. He was too busy sorting out his lies, and chasing other clients, and
was unavailable for comment., something rare.
Recently, the publicist, Mr. Grandiose, had even less to say, as he was
deposed in a legal matter. He and his patron, Madame Indiana Nolicense
Jones, both seemed to suffer from something between Alzheimer's and amnesia
when questioned about their relationship. Word has it that there was
something between them. After all, Mrs. Grandiose, aka Mammouth, was nothing
to speak of. Grandiose has a thing for older women, with money. As for
Mrs. G, Dowdy and a bit demented, was one description found around the
society pages, after she reportedly was found near San Juanita on Old Ranch
Road counting saponified pseudo-stones she summarilay shed, and then trying
to say that phrase quickly. Most think that was complementary, medicine
that is., as her activity distracted from her otherwise grim life. On the
surface she seemed to suffer from the same mental problem as the other two,
except that her email diaries are a bit too revealing. On a grander scale
she resembles her sister, Mammoth, quite a lot ;-), except they have
different hair colorings.
It seems the Madame Jones, the dowager, had paid Grandiose more than
$100,000 but couldn't quite remember what the money was for, nor could he.
"It was, well, two years ago," she said, "that is such a long time." Are we
surprised.?
Grandiose and Jones were formerly seen together quite a bit, including, a
while back, a stint in Milan. The Italian paparazzi speculated that Jones
had a "thing" for the publicist. After all, he had a hard life, starting out
as a failed cop, and then working mostly at a nameless desk job. No wonder
he wanted to be something else. A friend suggested he puff things up a bit
and "invent" himself as the head of "millions" of something, and call
himself a "consumer advocate". After all, it had a nice ring. Who would ever
check? So he did. Oh well, these are lien times, lying just seems to be a
part of him, even if his nose grows a bit each day.
"Grandiose is a pretty good con," said fellow fiction writer, Ima Fake, "but
much too transparent. He's also in your face too much. No subtlety. And his
lies are just so repetitious." "He just isn't as smart as he thinks he is, "
stated Ima. "He's been caught just too many times, nobody who knows him
listens to him anymore." How true.
" He claims to be leading some break-away health party group, but in
testimony and in private says he doesn't know anything about it. He's a
fraud's fraud," Peter Bee, a rodentologist, said describingly. "I guess it
takes a snake to sell snake oil," said Peter, as he took a detour to chase
more rats.
"How apt. Grandiose accuses others of soliciting business, for high fees,
while that is exactly what he does, claiming he can "make a difference".
"Now isn't that something," announced Father Paul, a member of the Order of
Muscle Stretchers, Truthsayers, and WebSite Makers.. I've got a lot up on my
site on Grandiose, said Paul. "So far the only measurable difference he
makes for his clients is thinning their wallets. Even his spam is getting
stale, not to mention the hyperbolic diatribes on his pseubo-web site. If
the truth be known he didn't even think up the idea, but took credit for it
anyway." So much for "original thinking" Word has it someone else does the
site for him too. Typical. "A fraud's fraud," said Peter Bee again.
Grandiose's only interest in the site was that it might get him advertising
dollars. "A fraud's fraud," said Peter Bee again.
"Heck, all's fair as long as I win," Grandiose, reportedly said. "Who needs
the truth? I just pretend to be a part of any cause that pays." "Keep
telling lies and eventually some people will believe them.""Ride the wave."
"Right now that's the alternative craze." "Next week, who knows?" "A fraud's
fraud," said Peter Bee again.
From all the spin you get you'd think that things in Badbad were hunky
dorey. The hype-perbole seems endless, but rumor has it that things in
Badbad are not as cozy as they've been. Jones' lawyer just got his hands
slapped, big time, and there's a few more skeletons here and there. Another
member of the gang has been charged with selling drugs and devices on the
Internet. The federales have spotted the hideout of Grandiose and word has
it he's under surveillance. Jones' other lackeys are being investigated. And
Jones....well, stay tuned. Now that the flukes have gone there just has to
be something else.
Indeed it's spring in the Northern Hemisphere, the flukes are gone, and the
swallows are back, but right behind them are the chickens which are coming
home to roost.

perpetrated a fraud on JAMA, the health care community, and the public.
That suggests that Emily should be about 16 by now - certainly old enough to
pick up a statistics book and apologize for her role in the family fraud.
How long will it take you Emily? All you really need to do is the obvious -
admit you were clueless all along and that you were just callously used by
people who should have been protecting you from harm.

Florida Consumer Health Freedom Act.

The The Consumer Health Freedom Act would: Remove blocks to
consumers' right to choose complementary and alternative
therapies (CATH) practitioners whose modalities and practices do not
meet the statutory requirements for licensure.
Protect CATH consumers by setting practice boundaries for CATH
practitioners.
Enhance consumer choices by requiring CATH practitioners to provide
information about themselves and their practices.
Facilitate communication between practitioners of CATH and licensed
health care providers.

Our lobbyist and attorneys will meet with members of the House of
Representatives' Health Care Committee this coming Monday and
Tuesday, March 17 & 18, to ask them to support our bill.
It is critical that these legislators know that this bill is
important to you, the voters.
Strong and well funded opposition to our bill is being led by the
"Naturopathic Physicians" (NPs). The NPs are seeking to create a
licensed profession in Florida which will combine both conventional
medicine and
naturopathy (natural healing). They are changing what has defined the
practice of naturopathy for decades (natural healing methods
involving
plants)-- adding prescription drugs, insisting that they are still
practicing naturopathy, and declaring that no other practitioner may
use that term to describe natural healing methods.
Under their bill, HB 1615, NPs would have the exclusive right to use
natural health care remedies, such as herbs and homeopathic remedies.
The NPs want to keep unlicensed CATH practitioners off of "their
turf." Giving the NPs a
monopoly on natural healing methods will put natural healing
practitioners out of business, and drive up the cost of natural
healing to consumers by requiring them to go to licensed Naturopaths
for natural healing services.
Your message will be most effective if it is received on Monday or
Tuesday. For this reason, please call first. If you are willing, a
letter is also
important. It will take just 5 minutes of your time to make a call or
write a letter. 10 minutes to do both!
It is essential that members of the House Health Care Committee hear
that the Consumer Health Freedom Act HB 1301 is important to you. If
a Representative does not receive a sufficient number of contacts
from voters, it is possible that he or she may vote against our bill.
It is equally
important that they know that you want them to vote against HB 1615,
the Naturopathic Physicians' bill, because of their effort to claim a
monopoly
on natural healing methods and the overlap their bill creates between
natural healing methods (naturopathy) and conventional medical care
which involves drugs and surgery.
