Oh yeah absolutely I have an attorney. That is one of the reasons they are
giving me the run around over meds and over seeing a vascular surgeon. One of my
problems has to do with the fact I didn't have any symptoms of TOS until my OS
did the resection on my clavicle. It is like a domino effect: one problem
effects or causes another. The surgeon & workers comp. work to make things go in
favor of the company not the injured employee. It is such a farce the way the
system works. In the state of TN they passed major changes in worker comp.
cases. You have 90 days after being give MIR to try and settle with the company
before you can even see an attorney. They also cut the amount of compensation
you can receive: max. amount being two n one half times, previously it was six
times the amount.....min. amount is one times, previously min. was two n one
half the times. I'm sure you understand what I mean. It is kinda complex anyway
you try to explain it. All the changes in the WC laws only
benefit the employer. Sure doesn't make any sense to me.

I'm sorry to ramble on....I have dealt with workers comp. since '96. Things went
pretty smooth til I sustained the new injuries in '02. Between '98 and '02 the
company went with a different insurance cover-er. Much harder to deal than the
other.

went through the work
comp hell when I was first diagnosed with TOCS in 1996. Here is
what they do: I was sent to a hand surgeon who only diagnosed
and treated CTS; althought I had been diagnosed with TOCS. His
very detailed exam and x-rays cost work comp a lot of useless
money. His diagnosis was that he did not know what I had but it
was not work related. This jerk also used to work with Harold
Kleinert and knew that TOCs existed; he left the practice when
he tried to get work comp from them based on a heart attack. I
also saw two other M.D.'s who did not know what I had.
Therefore, when my case was presented by my attorney; I only had
one M.D. who said I had TOCs and it was work related, Harold
Kleinert. I lost my case based on that and on the fact that
nothing showed up on xray. Work comp will send you to an M.D.
who is not a specialist in your area of illness. It the way
they do it. Its all about money. I hope you have an attorney.
