I have heard of cases where TOCs was caused my MVAs. I hope that the
insurance company has paid for medical expenses. Did they pay for your
of work time? I would think that if the M.D. said it was caused by the
MVA and you were not able to work that they should have taken care of
that. I don't know what your companys insurance is but I don't think
work comp will do anything in this regard. There is no way to know
what will happen.
You can only go back to work and take it one day at a time. Ask the
M.D. if he will start you back half time since you still have pain and
problems and see if he will let you take a 5 minute break every hour.
If your symptoms get worse at work then the M.D. will have to recommend
that you not do that work and under law the company has to put your
somewhere else and provide you with a job you can do. You really have
no other choices but since you still have some problems with pain and
symptoms...I think he could start you off at a low level and see how it
goes. You poor thing.
What has the insurance carrier done ... they should have paid for all
the medical and your loss time at work; if they don't you might have to
get an attorney etc. Problem is if you have long term effects from
this, they are responsible. It is a fight not matter whether it is
work comp or insurance because its about money and no one wants to pay
anyone who is injured or deserves it if they can find a way out. Let
me know how it goes when you get back to work and ask the M.D. about
this stuff...
use the better arm if you can... Maybe you can be transferred to an
easier job... I only know that under law they have to do that if you
cannot do the job you did before and the M.D. is the one who provides
the
paperwork and decides what you can and cannot do...talk to him and
tell him your concerns. You will know when you get there ... it will
all work out someway it always does.
