Florida Attorney General Discriminating In Schiavo Case

Analysis By The Empire Journal

Florida Attorney General Charlie Crist announced Friday that he
is issuing subpoenas to US Airways in the case of paraplegic who was
put off a flight in Tampa while trying to go to Cleveland for an
operation that would allow him to breathe on his own.

He said the airline might have discriminated against the person,
a wheel-chair bound paraplegic who relies on a ventilator to breathe.

Is this a case of double standards?

How can Charlie Crist, said to have aspirations to become
Florida's next governor, act to protect the rights of some disabled
but not others?

Isn't Charlie Crist practicing discrimination himself?

Especially in the Terri Schindler-Schiavo case.

Crist was elected Florida's first Republican AG in 2002 and
claims to aggressively address complaints of fraud and violations of
civil rights.

The Dr. Marvin Davies Civil Rights Act of 2003 provides Crist
with authority similar to that of the U.S. Attorney General to
prosecute patterns and practices of discrimination. He says he's
committed to improving the quality of life for all citizens of
Florida.

Doesn't that include the life of Terri Schiavo?

Or is Crist engaging in discrimination by not using the resources
of his office to protect her life, investigate the rampant
allegations of criminal wrongdoing in the case as well as the
violations of federal and state law as well as Florida's
Constitution.

One news report issued in regard to Crist's actions against US
Airways, said that the high profile case is virtually guaranteed to
generate publicity for Crist in his run for Governor. Crist denied
that political considerations were involved—only justice.

So, is that how Charlie Crist is running the Attorney General's
office? Only taking actions in maters in which will generate the
most positive publicity as he prepares for his gubernatorial run
and shying away from controversial matters that could affect his
political aspirations?

Like the Terri Schiavo case----like taking the much warranted
and overdue action against Sixth Circuit Court Judge George W. Greer
for his alleged violations of election laws, action against the
multiple violations in this case of the health care laws for the
vulnerable and disabled, the alleged criminal wrongdoing by Michael
Schiavo?

"Whenever somebody may have discriminated against a
Floridian…….we have a duty and obligation to fight for them" Crist
said.

He has a legal, constitutionally mandate to fight for and defend
Terri Schindler-Schiavo who has been grossly discriminated against
by the system and some of Crist's fellow Republicans.

In his letter to the CEO and president of US Airways, Crist
said "It is my understanding that Mr. Barrett, a wheelchair-bound
paraplegic who relies on a ventilator to breathe, was seated on a US
Airways flight bound from Tampa to Cleveland, Ohio, when he was
physically removed from the aircraft by US Airways personnel
allegedly because he posed a medical risk. It was reported that he
was flying with a medical assistant and had informed airline
personnel of his condition well in advance of boarding the plane.
"Mr. Barrett suffered inconvenience and personal humiliation not
only because he was carried off the airplane by US Airways
personnel, but also because US Airways did not assist in finding
other transportation arrangements to Cleveland or in ensuring his
safe return home".

While Michael Schiavo and his attorney, George Felos relentlessly
persist in their quest to cause of the death of Terri Schiavo by
judicial homicide in consort with Judge George Greer, Crist has
stood idly by, allowing federal and state civil rights laws to be
grossly violated and has failed to protect one of Florida's most
vulnerable persons from egregious discrimination.

Terry Schiavo has suffered inconvenience and personal humiliation
for nearly 10 years because of Michael Schiavo's insistence on her
death and the state of Florida has failed to protect her. Michael
Schiavo and Felos claim they are protecting her right to privacy but
that too is an oxymoron. They are the ones who have grossly
violated her right to privacy.

Crist has a legal and constitutional obligation to protect Terri
Schiavo, an individual from disabilities from the discrimination
being perpetrated upon her.
While he took swift, decisive action in the US Airways matter,
apparently based on the publicity value, after thousands upon
thousands of phone calls, emails, faxes and letters to take action
against the abuse, neglect and exploitation of Terri Schiavo, he
declined to get involved because the matter was "in the courts".
Seems like rather selective enforcement of our Constitution and
Florida Statutes and abandonment of the oath he took to uphold the
laws and Constitution of the state of Florida.

In October, 2003, the last crisis when the feeding tube of Terri
Schiavo was removed on Greer's order, even after a federal judge
asked Crist to address the question of the constitutionality of
Florida law dealing with the right of severely incapacitated people
to refuse artificial life support---the issue at the center of the
Schiavo case---Crist refused.

He ruled the law constitutional but said he wouldn't get further
involved.

That's definitely not the type of person that Florida needs to be
their next Governor. Maybe Charlie Crist should remember that the
thousands of Floridians who have reached out to implore him to do
his job also vote and will no doubt remember his discriminatory
action against Terri Schiavo at the polls.

As suspected, the actions----or rather inactions----in the Terri
Schiavo case are politically motivated.

NEW MEDICAL TESTS SOUGHT
TO SAVE LIFE OF TERRI SCHIAVO

The life of Terri Schindler-Schiavo will hinge on the outcome of
two dramatic hearings scheduled to unfold Monday, Feb. 21 in the
Florida courtroom of Sixth Circuit Court Judge George W. Greer.

David Gibbs III of Seminole, Fl., attorney for Mary and Robert
Schindler Sr., parents of the brain damaged woman, said Thursday
that he will file a new motion Monday asking Greer to allow new
medical tests for Terri based on the findings of a new brain imaging
study published in the journal Neurology.

Gibbs said a hearing is also scheduled for Monday at 2:30 p.m.
on the Schindlers' motion to extend the stay of Greer's 2000 court
ordered judicial homicide which could remove Terri's assisted
feeding tube as early as Tuesday.

Theresa Schindler-Schiavo, 41, a patient at the Woodside Hospice
in Pinellas Park, Fl., sustained severe brain damage 15 years ago as
the result of a mysterious and suspicious incident at her home. She
is the center of decade-long life and death court battle between her
estranged husband, Michael Schiavo and her parents in an arena that
extends from the Probate Court in Pinellas County to the U.S.
Supreme Court.

"Any action to end Terri's life would be totally premature",
Gibbs said at a news conference Friday in front of the Pinellas
County Courthouse. He said new medical tests should be done on the
basis of the new study which indicates the possibility that brain
injured people such as Terri, treated as though they are unaware of
their environment and labeled in a persistent vegetative state (PVS)
may in fact hear and understand what goes on around them but be
unable to respond.

James Bernat, professor of neurology at Dartmouth College, said
the study findings are relevant to the Schiavo case and that a brain
image test could determine if she is in a persistent vegetative
state as Greer has labeled her.

"Terri deserves to get these tests", her father said. "Terri is
alert, she's aware. I think the bottom line is that Terri deserves
to get these tests. It would be unconscionable for Judge Greer or
any other judge to order her death without these tests".

The Schindlers have maintained, backed by medical experts, that
Terri is not PVS and could improve with rehabilitation. Michael
Schiavo, although being awarded nearly $1.7 from medical malpractice
claims on the representation that he would provide rehabilitation
services for his wife, refused to do so shortly after receiving the
money and instead has used the money earmarked for Terri's rehab to
be used for legal fees to obtain a court order to end her life.

In his plea for Greer to allow the new medical tests to be
conducted, Schindler also cited the case of Sara Scantlin, the
Kansas woman who recently began talking 20 years after she suffered
brain injuries as the result of injuries suffered when she was
struck by a drunk driver in 1984. She has been bedridden in a
Hutchinson, Kansas health care center ever since, aware of her
surroundings but unable to make any sounds other than loud crying.
She was severely brain injured and her doctors feared she would
spend the rest of her life in a vegetative state.

But a month ago, without any explanation, she suddenly began making
sounds, telling health care workers, "OK, OK". She is now counting,
remembering people and forming other words.

Terri's parents and health care workers say that Terri is
responsive. She follows people with her eyes, she interacts. She
is not on a respirator. She is simply on a feeding tube which
provides her nutrition and hydration three times a day. (See

There is currently a stay in place for the execution of Greer's
2000 order to withdraw the feeding tube and Gibbs has filed for an
emergency hearing to be conducted Monday on the Schindler's request
to extend the stay. With the 2nd District Court of Appeals having
denied the Schindlers' last motion before the DCA to void the order
due to the alleged violation of Terri's free exercise of religion,
Schiavo's attorney, George Felos, says he expects the DCA decision
to be finalized Monday or Tuesday which would allow his client to
withdraw Terri's feeding tube.

If Greer allows the court-ordered homicide to go forward, death
by starvation would result in 7 to 10 days.

The Schindlers have recruited anti-abortion activist Randall
Terry, founder of Operation Rescue and president of Truth and
Justice to organize protests and rallies at the White House and at
the Florida State Capital in Tallahassee in an effort to save
Terri's life.. Pickets are also planned at the home and workplace
of Michael Schiavo in an effort to wear him down and convince him to
simply give Terri back to her parents so they may care for her.
Terry has also mounted an intense telephone and email campaign
focused at Gov. Jeb Bush and the Florida Legislature, asking for
them to invoke the powers accorded to them under the state
Constitution. Terry and others maintain that the Governor is
constitutionally empowered to take Terri Schiavo into protective
custody because she is a vulnerable and disabled adult in danger of
losing her life.

The Schindlers have asked the DCA to withhold its mandate which
would finalize its Feb. 4 decision on the religious liberties issue
and issue a stay pending the filing and resolution for writ of
certiorari to the U.S. Supreme Court.

Schindler supporters feel that Schiavo and Felos may attempt to
move the woman from the hospice to an undisclosed location to remove
the tube.

Pamela Hennessy, spokesperson for the Terri Schindler-Schiavo
Foundation, said that the DCA has previously ruled that new
information or developments such as medical technology are matters
that can be considered as long as Terri is alive and such would
allow for an extension of the stay to be granted.

Gibbs filed motions on behalf of the Schindlers earlier this week
advising both Greer's court and the DCA that for the second time
this year, the Schindlers will take their daughter's case before the
U.S. Supreme Court, asking the Court to review Greer's and the DCA
denial of the religious liberties issue.

Michael Schiavo had been successful in October, 2003, to remove
the assisted feeding from his wife but after six days, Gov. Bush and
the Florida Legislature enacted Terri's Law which ordered that the
tube be reinserted.

Schiavo claimed such action by the Governor was

CONSTITUTIONAL SHOWDOWN LOOMING IN FLORIDA SCHIAVO CASE

A constitutional showdown is looming in Florida between the
Governor, the Legislature and the judiciary.

Randall Terry, founder of the anti-abortion group Operation
Rescue, outlined a campaign of lobbying and protests Wednesday in an
attempt to save the live of Terri Schiavo, the brain damaged woman
who is at the center of a prolonged court battle between her
parents, Mary and Robert Schindler Sr., and estranged husband,
Michael Schiavo.

"We will not rest until we have saved Terri from the threat of
starvation", Terry told the crowd gathered outside the Woodside
Hospice in Pinellas Park where Terri is a patient.

Michael Schiavo and his attorney, George Felos, have announced
their intent to enforce a 2000 court order issued by Sixth Judicial
Circuit Court Judge George W. Greer to withdraw assisted feeding
from Terri which will result in her death by starvation and
dehydration.

"What we're in for is a constitutional showdown", Randall told
the crowd. "We believe this Governor and this legislature has the
backbone to win this fight. Our mission is to create an avalanche
of support for them to do the right thing".

In the fall of 2003, when Schiavo had won court approval to
withdraw Terri's feeding tube, Gov. Jeb Bush and the Florida
Legislature enacted Terri's Law which directed that the gastric tube
be reinserted after she had been without nutrition and hydration for
six days.

Michael Schiavo contested Terri's Law, saying it was
unconstitutional, a violation of the separation of powers doctrine.
The Florida Supreme Court agreed with him and last month, the U.S.
Supreme Court refused to review the matter.

Terry announced plans to again lobby Gov. Bush and the
Legislature to intervene and to picket the home and workplace of
Michael Schiavo.

"We will fight for Terri with every ounce of strength we have
left" Robert Schindler Sr. told the group of supporters and
media. "And we have many ounces".

Terry said that as he had been thinking about the case, so many
things intersected—Terri's family's struggle to save her from
starvation, an ongoing battle of judicial tyranny and the mood of
the country that is really fed up with judges taking the law into
their own hands.

"Philosophically, the Rule of Law is not judicial decree",
Terry said. "If it was, then what the Nazi judges said would have
been the rule of law, or what Saddam Hussein's puppet judges ruled.
It comes from above with a capital `L.'. "We have a right as a free
people to enjoy representative government"
"That this woman must die is not the rule of law. It is a bunch
of tin pot judges making law. That is not the rule of law. They are
creating law out of thin air. It is arbitrary, it is not law, it is
tyranny",

Terry said "the gloves are coming off with Michael Schiavo. He
said that protesters plan to picket the Capitol building in
Tallahassee, the Pinellas County Courthouse of Greer as well the
home and workplace of Michael Schiavo.

Schiavo will be urged to drop the effort to stop feeding Terri
and to turn her over to her family, Terry said. He said he hoped
that the protests will wear down his will.
"We know that the Governor is sympathetic", Terry continued. "He
showed it last year. We need to bolster him, to encourage him and to
inject steel into his spine. We have a large network of heavy
hitters and they have already begun, who will continue to contact
him at a personal level and an avalanche of callers. The Governor
has the constitutional authority to intervene on behalf of a
disabled person. The last time he chose to work with the legislature
and we honor that and even if the legislature decides not to act,
the Governor can act on his own and has a duty to act"

Terry said if the feeding tube is ordered to be removed, he would
coordinate a 24-hour vigil at the Hospice and a consecutive 24-hour
vigil in the Capital non-stop with the legislature and the governor
encouraging them to act. We are going to camp out 24 hours a day at
the Capital. This will not go away until Terri is saved".
"I am in contact with senators. Other people are here that are
in contact with senators. ….This woman deserves to live and it is
important for the legislature to stand up to the court. …..the
country is ready for the legislature to stand up to the courts.

Terry told the crowd that Michael Schiavo "is a monster. He is
not a good person…. Why doesn't he divorce her and give this woman
to her mother and dad. I am asking members of the media to visit
www.terrisfight.org and read the deposition of his former
girlfriend. He stalked his former girlfriend and that he ran her off
the road. We are going to hold pickets at his home, at his work"

Terry pointed out that Judge Greer purports to be a Southern
Baptist. "In case anyone was wondering, it is against the Southern
Baptist Church to starve innocent people to death".
"When the Nazis held Europe, everybody knew they need to get a
foothold on the shores of France, the only question was where and
when. We are the allies and the people who are trying to kill Terri
are the bad guys. But, we need to have a certain element of
surprise", he added.

"The long shot is to ask President Bush to give Terri a pardon.
There will be protests and rallies at the White House asking
President Bush to get involved. On the anniversary of Roe v. Wade
President Bush said `The essence of civilization is that the strong
have a duty to protect the weak'. Mr. Bush, our president and Mr.
Bush, our Governor, they're the strong, Terri's the weak and we want
them to invoke their authority to protect Terri".

"If we find out that Terri is possibly going to be moved to
another facility to remove the feeding tube, we will boycott that
hospital", Terry promised. "An institution that heals does not
want to be known as an institution that brings death deliberately"

Terry also requested the media to invoke an immediate editorial
policy change, no longer saying that Terri is in a persistent
vegetative state (PVS). "I am asking you to read the sworn testimony
from medical professionals who are all saying, with a unified voice,
the ones who have been with her, she is not in a coma, she is not
brain dead, she is not in a PVS, she is not on any life support
system whatsoever. She is being fed. She is not on a ventilator, no
blood.

"So every time that members of the press report that she is PVS,
the average person at home looking goes "why is everybody wasting so
much time on her?" …This is not someone who is brain dead. This is
somebody who tries to say "hi" or joke with her dad. This is
somebody who uses infantile speech to try to communicate".

"Several years ago on the phone, a speech therapist was secretly
giving Terri speech therapy on the phone. He said to Terri "Terri,
there are people trying to kill you and you've got to get out of
bed." On the other end of the phone, Mr. Schindler who was with
Terri during the call, said to the therapist, "what did you say to
her because she just jumped out of the bed and I had to catch her?"

"This is someone who hears. this is someone who reasons. I am
begging you as a matter of honor to at least look at the
documentation and for an editorial change to not call her PVS".

Felos has been quoted as saying that Michael Schiavo will not be
deterred in his quest to end Terri's life. "All I can say is that I
know Mr. Schiavo is dedicated to carrying out his wife's wishes and
I believe he is going to do that, notwithstanding these threats".

Schindlers' attorneys have filed new motions with both the Sixth
Circuit Court of Greer and the 2nd District Court of Appeals which
will be heard next week. They are seeking to extend the stay of the
execution of Greer's 2000 order that would withdraw the feeding
tube. They are also preparing to file for a writ of certiorari
before the U.S. Supreme Court on the freedom of religion issue.

Following are the facts, and what you can do to save
her…
Hello friend of Life.

Thank you so much for your desire to help rescue Terri from
starvation.



In case you are wondering, let us clear up some of the lies and the
distortions that are circulating in the press about Terri.

Terri is not brain dead. She is not in a coma. Terri is not in a
persistent vegetative state. She is not on any life-support
systems.

Terri wakes and she sleeps. She smiles, she laughs, she cries.
Sometimes she will say "mom" or "dad" or "yeah" when asked a
question. She shows a wide variety of emotions with her facial
expressions, her attempts at speech, and the various tones in her
voice.

Then why is Terri threatened with starvation? Terri's estranged
husband, Michael Schiavo won nearly 1.7 million dollars to provide
care for her, as well as pay for rehabilitative therapy. Shortly
after he obtained the money, he petitioned the court to have her
starved. He has used nearly $400,000 of the money that was awarded
for her care to try and have her starved to death! He is the one
fighting to have her killed.

Michael Schiavo has lived with another woman for years, and has
2 children by her. He has declared that he intends to marry her
after Terri is dead.

So why doesn't he just get a divorce, and let the parents have
their daughter? That is a troubling question. Some assert it is
because he wants what is left of the money. Others believe that he
put her in this condition, and he wants all evidence of abuse
buried. Still others guess it is a grudge match with Terri's father.

Whatever the reason, Terri does not deserve to be treated like a
pawn. She is a child of God, an innocent woman, and she has the
right to be alive, and not be starved to death.

Right now, Terri is being fed through a tube to her abdomen.
Terri has been denied therapy for over 12 years. She could be much
better if she were given the therapy she deserves. Her parents are
willing to bring her home and care for her, and get her the therapy
she has been denied.

In October of 2003, Judge George Greer ordered food and water to be
withheld from Terri. This death sentence resulted in protests at
the facility where she was being starved. A deluge of phone calls
and e-mails pleading for mercy inundated the governor and
legislature.

The legislature and the governor responded and passed Terri's Law.
Food and water were restored to Terri. Her life was spared.

Then Florida's Supreme Court struck down Terri's Law and the US
Supreme Court recently refused to hear any appeal.

The court can once again order Terri to be starved.

Terri needs you to do two things to help save her life:

1) Today--contact the governor and the leaders of the legislature
and politely insist that they write a new law to save Terri's life.
We need this to happen today, and we ask you to recruit your friends
to do the same. And remember, phone calls are better than emails.

2) If you hear that the court has ordered Terri to be starved--, if
at all possible, come to Pinellas Park (Near St. Petersburg) where
Terri is being held, or to Tallahassee Florida (where Governor Bush
and the Legislature are) to take part in peaceful vigils and
protests.



We will have around the clock vigils in both locations: at the one
where Terri is to show our support for her and her family; in
Tallahassee to call on the Governor and the Legislature to intervene
and save her from Judicial homicide by starvation.

Schiavo Protest Organizer Says Will Fight
"Tooth And Nail"

As hundreds of supporters of Terri Schiavo descend on Pinellas
Park and Tallahasse, Fla.,fom all over America to plead her case,
Randall Terry, founder of Operation Rescue and the president of the
Society for Truth and Justice said "We will fight tooth and nail to
keep Terri from being starved to death and demand justice for her".

" We did this in October 2003, and prevailed", Terry said. "This
time we expect the protests to be larger, and the outcry from around
the nation to be louder. Our will to fight and prevail for Terri is
set in stone."

Terri Schiavo, 41, is the brain damaged woman who is at the center
of a tug of war between her parents, Mary and Robert Schindler, and
her estranged husband, Michael Schiavo. The husband, who is engaged
to another woman by whom he has two children, has sought and
obtained a court order from Sixth Court Court Judge George W. Greer
to withhold the feeding tube from Terri which will cause her death
by starvation and dehydration.

Terry and Schindler Sr., will hold a press conference
Wednesday, Feb. 16 beginning at 1 p.m. in front of the Woodside
Hospice, located at 6774 102nd Avenue N (near 66th Street N. and
102nd Avenue N) in Pinellas Park, Fla.

"We are counting on Governor Bush and the Florida Legislature to
do the right thing, and again rescue our daughter from the clutches
of the court", said Bob Schindler.

"Our plans are comprehensive, and we will attack this injustice from
every possible side. Like the persistent widow in Christ's parable,
we will give no rest to our political leaders until Terri receives
Justice", Terry added.

"Our family has asked Randall Terry and his staff to once again
coordinate the efforts to rescue Terri from the clutches of death by
judicial homicide. We ask you to help my daughter, Terri, by
following Randall's lead, and cooperating with and supporting the
efforts we have asked him to undertake. We thank you with all our
hearts for your concern for our daughter, and for your help in
trying to save her", Schindler said. ."

Emergency Stay Of Execution Requested In Schiavo Case

New motions seeking an emergency stay of the execution of the
2000 order of Florida's Sixth Judicial Circuit Court Judge George W.
Greer to end the life of Terri Schindler-Schiavo have been filed by
her parents.

Attorneys for Mary and Robert Schindler Sr. of Gulfport, Pinellas
County, have asked Greer and the 2nd District Court of Appeals for
an emergency stay of the execution of Greer's Feb. 11, 2000, order
to remove Terri's nutrition and hydration pending the outcome of
Schindlers' petition to the U.S. Supreme Court for a writ of
certiorari to hear the issue concerning Terri's free exercise of
religion.

Terri, 41, is the brain damaged woman who sustained injuries
under mysterious circumstances 15 years ago. She is at the center
of tug of war between her parents and her estranged husband, Michael
Schiavo who has sought and obtained a court order from Greer to
withhold the feeding tube from Terri which will cause her death by
starvation and dehydration.

The motion before Greer explains that George Felos, attorney for
Michael Schiavo, has threatened to move forward without further
court order to discontinue the assisted feeding of Terri immediately
upon the 2nd DCA issuing its mandate confirming its decision of Feb.
4 in regard to the Schindlers' contention that withdrawing the
feeding tube would violate their daughter's free exercise of
religion. Felos says that the withdrawal of the tube could occur as
early as Feb. 22.

The Schindlers have also asked the DCA to withhold its mandate
and issue a stay pending the filing and resolution of their petition
for writ of certiorari to the U.S. Supreme Court on the religious
issue.

On Feb. 11, Greer had denied the Schindlers' motion seeking
relief from a void judgment based on the court's failure to provide
Terri with procedural due process rights to access to the court, her
own independent counsel and own personal right to privacy as
guaranteed by Florida Statutes and the Florida Constitution.

The Schindlers maintain that Greer impermissively retroactively
applied 2000 law to Terri Schiavo's conduct that occurred before
Feb. 1990. Such is in regard to the alleged comment Michael Schiavo
says that she made that she would not want to be kept alive by
artificial means.

The Schindlers also maintain that Greer has violated the court
doctrine of separation of powers by acting as guardian or proxy or
surrogate.

David Gibbs of the Gibbs Firm of Seminole, Fla.;, representing
the Schindlers, asks Greer to rehear the motion he denied Feb. 11
and when he again denies it, Gibbs has advised that the Schindlers
will then appeal the denial to the 2nd DCA.

While the legal actions are pending, a stay of enforcement of
the 2000 order is necessary, the Schindlers say.

Still pending before Greer is the Schindlers' motion filed Jan.
10 to remove Michael Schiavo as their daughter's guardian based on
allegations of the inability to act as guardian due to abandonment
of his marriage, deprivation of Terri's rights under the
guardianship laws, failure to file guardianship plans, mismanagement
of the ward's assets and legal, personal, religious and financial
conflicts of interest with the ward.

Discovery in connection with the Schindlers' petition to remove
the guardian is ongoing, the attorneys advise, with depositions set
for April 7 and 17 for Michael Schiavo, and on May 5 for his live-in
mistress, Jodi Centonze to whom he announced his engagement in 1997
and by whom he has two children.

Neither Schiavo nor Centonze have appeared for previously
scheduled depositions and sources say that Centonze avoid a court
ordered deposition in 2001. Greer did find not impose sanctions
against her for contempt of court.

Requests for production of documents, interrogatories and
admissions will soon be served before the first deposition date, the
attorneys told the court.

A stay is necessary to permit the Schindlers to complete
discovery and for the court to determine the guardian's continued
eligibility.

"Removal of Michael Schiavo as guardian and the appointment of a
successor guardian would dramatically impact all key decisions
regarding the ward while she remains alive", the motion states, "as
well as all key decisions upon the death of the ward such as funeral
and burial arrangements and the distribution of her estate".

On Feb. 4, the DCA denied the Schindlers' motion for
clarification and rehearing of the motion concerning religious
issues, refusing to issue a written decision which prohibited the
Schindlers from appealing the denial to the Florida Supreme Court.
Both Greer and the DCA have sidestepped the religious issue.

On March 20, 2004, Pope John Paul had made an official declaration
of doctrine of the Roman Catholic Church in regard to the moral
obligation of Catholics to continue artificial nutrition and
hydration of a patient in a persistent vegetative state until the
patient dies a natural death.

Schindlers' attorneys told the DCA that they were preparing to
petition the U.S. Supreme Court for a writ of certiorari to review
the orders of Greer and the DCA summarily dismissing the religious
motion. They said the motion was due in the U.S. Supreme Court on
or before May 5 and seek a stay by the DCA until the issue is
resolved.

The attorneys pointed out that the DCA had previously
established the procedure for the court to follow before assisted
feeding may be discontinued, instructing that if the trial court, or
Greer, elected to enforce its Feb. 11, 2000, order, it should enter
an order informing all interested parties of the day and time that
the guardian must instruct the health care provides to discontinue
life-prolonging procedures.

The court has never authorized the guardian "to charge in with
unseemly haste to discontinue Terri Schiavo's assisted feeding so as
to permit her death without a specific date and time order from the
court", Schindlers said.

"Given the critical importance of the religious and legal issues
presented by the case and given the fact that Terri Schiavo's life
literally hangs in the balance over the court's decision, the
mandate should be withheld and stayed pending the filing and
resolution of Schindler's petition for the writ of certiorari.
