The new exams are not proposed, rather have been decided on by DSHS.
However, TAMSO and I believe TCMSI is objecting. The site where this
is stated is under "Apply for new License" on the DSHs Massage
Therapy Home:
http://www.dshs.state.tx.us/massage/mt_exam.shtm
Go to the following web-page and find out what the objections are and
information about the stake holders meeting:
http://www.dshs.state.tx.us/massage/mt_rules.shtm
The old rule actually states no compensation including tuition
waivers and the new rule is proposed to state the same.
As I understand it, the rule before the current one, was ruled not to
have a clear intent, by a SOAH hearing judge after a school who was
charged for allowing internship to be used as tuition waivers, fought
DSHS for a fine that was administered on them. The school won which
is probably why the rule was re-written with clearer intent.
Proposed Rule:
§140.338. Massage School Curriculum Outline and Internship.
(k) A massage school shall not allow an unlicensed student to receive
any form of compensation for massage therapy or other massage therapy
services. Compensation includes discounted or reduced student fees
for tuition, books, supplies, or other educational expenses.
I am sorry but I have to get to work and don't have the time to look
up the current and previous rules.
Hope this helps
Vicki
