" The Arc, United Cerebral Palsy and 28 national disability organizations involved in special education sent a strong letter to Education Secretary Margaret Spellings responding to the Department’s new policy for placing an additional 1.5 million special education students in alternate assessments under No Child Left Behind. The letter stresses that no policy should be implemented until the research basis is proven applicable for affected students and spells out provisions that must first be in place including final regulations; training and technical assistance to school officials and parents; IEP decisions; and assessment instruments. The letter urges discarding the term “persistent academic disabilities” to describe special education students who would be assessed under the policy."

P.S. I had not heard the phrase "persistent academic disabilities" and it seems well worth looking into what the designation is meant to cover
