Can you give us some legal context? E.g. are there contributory clauses in the forum's statutes or caselaw? I.E. Is this a zero-sum matter (one side takes all) or are there provisions for joint  or proportional liability? Let's also ask a litigation oriented group LSC, and also it will be interesting to learn of the results of your query to all.
