handbills were converted from PDF files to the gif and jpg
images found here. The freeware Adobe Acrobat Reader and the
freeware IrfanView were used.

your needs. Download the full-size gif images since they use
far fewer kilobytes compared to the 640x480 and 800x600 jpg

files are much better for flyers and banners. IrfanView can
easily edit, reduce, or enlarge gif and jpg images.

Doug Greene gave an excellent speech on behalf of the Global Marijuana March
to the members of the Manhattan Libertarian Party on Wednesday evening. (ed. filling in for Dana Beal.) Doug mentioned that it would be welcome if the MLP formally endorsed the march and marched as a contingent. Our county committee met yesterday and voted to do both. We'll see you on May 7th, and we'll work between now and then to
distribute the materials Doug gave us.

I would like to request some speaking time on the stage in Battery Park for
our candidate for NYC Mayor, Audrey Silk. Audrey is the founder of NYC-CLASH
(Citizens Lobbying Against Smoker Harassment), the lead activist group
fighting the smoking ban. She is also strongly opposed to the drug war.
Audrey is also a retired NYPD cop, which makes her an especially interesting
person to speak out for marijuana.

Please let me know if Audrey Silk can have some microphone time, and when you
would like her to be at the stage, so I can put it on her schedule.

On Saturday, Apr 9, the Ft Wayne Journal Gazette (IN) ran an excellent
commentary written by a college junior at Cal State Fullerton.  Her
target?  The horribly misguided 'drug provision' in the Higher
Education Act of 1998, which penalizes applicants who have a drug
conviction of any kind in their background.

This column is extra notable because it was carried in the J-G, the
hometown paper for cited U.S. Congressman Mark Souder (R-IN).  Souder
was the primary author of this provision, passed over six years ago,
that has since adversely impacted over 160,000 American college-bound
youth.

Author Marisa Garcia accurately notes that Mr. Souder has spoken out
several times in criticism of his own legislation - as passed in 1998
- but he has of yet failed to demonstrate the needed backbone when it
comes to stepping up to the plate and repealing the HEA 'drug
provision' from student financial aid applications.

Please consider writing a short, succinct Letter to the Editor to the
Journal-Gazette in support of Ms Garcia's commentary and in criticism
of Mr. Souder's staunch inaction in righting this legislative wrong
which he himself admits is a reality.  Please include an appeal to Mr.
Souder that he stop dragging his heels and now demonstrate the
political leadership needed to make this repeal possible.

In the spirit of "A Drug War Carol" by Susan Wells et al [www.adrugwarcarol.com] another educational comic book is now available.
At the Tally Rally MTWT and the Florida Lolits were able to give away these educational comic books "Prisoners of the War on Drugs" free, thanks to Lois Ahrens of 'The Real Cost of Prisons Project.' The comic books were a tremendous success.  I inserted one of my trifolds in each book and had them on my table.  I shared them with anyone who crossed my path.  Everyone walked away already opening the book to read. It was the best received give-away education I've ever had on my table. Even the politicians were standing around reading their copy while they waited for the elevator... and we know they hardly read anything but mainstream newspapers if they can help it.

    Four children, all US citizens, continue to be
    stranded in Thailand, ranging in age from 6 months to
    four years. The US State Department claims no
    knowledge of visa application delays of the children's
    mother, now delayed for months. Wife and children have
    now been stranded in Thailand without proper housing
    or medical care for one year.

    The US State Department continues to act punitively
    and without accountability in a country where dissent
    is increasingly suppressed. Targeting women and
    children is acceptable. A government out of control.

    The US State Department in Bangkok and the US further
    denied the trafficking of other Akha children from
    Thailand to Sacramento, California area, despite the
    fact that these children were identified and contacted
    in Sacramento.

    Violation of Civil and Constitutional Rights in US has
    become the norm.

    The terrorists against women and children are the
    arrogant "little Eichmanns" of the US government.

    No relationship to the "freedom and democracy" they
    teach in schools and preach in "Iraq". And all the
    dead children marched endlessly in the night.

House Insanity -- HR 1528: 5 Years For Passing A Joint!

Republican Congressman James Sensenbrenner has launched his
next assault on freedom. The full House Judiciary Committee
is set to vote as early as next week on H.R. 1528, which
creates a new group of mandatory miniumum penalties for
non-violent drug offenses, including a five year penalty for
passing a joint to someone who's been in drug treatment.

That's right: Passing a joint to someone who used to be in
drug treatment will land you in federal prison for a minimum
of five years.

The "Defending America's Most Vulnerable: Safe Access to
Drug Treatment and Child Protection Act of 2005" (H.R. 1528)
was introduced by House Judiciary Committee Chairman James
Sensenbrenner (R-WI) on April 6, and it has already passed
out of the House Judiciary Subcommittee on Crime, Terrorism,
and Homeland Security.

We warned you about this bill last September. It's now
coming home to roost. Please visit here to e-mail your U.S.
representative and two U.S. senators today. Stop this bill
in its tracks.

Marijuana Policy Project reports:

In addition to the shocking joint-passing provision
described above, the bill would also create a 10-year
mandatory minimum sentence for a first-time conviction of
distributing a small amount of marijuana to a person under
18 years of age . . . and a 10-year sentence for a second
offense of distributing marijuana to a person under 21. By
comparison, the average time served by convicted rapists in
this country is about seven years.

MPP does not condone the distribution of marijuana to
minors, nor do we advocate the use of marijuana by people
recovering from substance abuse problems. But we do believe
that judges should have discretion to determine whether or
not offenders in these circumstances deserve to be
imprisoned for sentences as long as five or 10 years. If
these mandatory minimum sentences are enacted, judges'hands
will be tied.

This bill has traction because it also contains a section
that serves as the House Republican leadership's response to
a recent U.S. Supreme Court ruling that made the Federal
Sentencing Guidelines advisory, rather than mandatory.* The
Republican leadership is highly motivated to pass this bill
-- and with it, the harsh new penalties related to marijuana.

The bill will now be debated and voted on by the full House
Judiciary Committee and -- if the committee passes the bill
-- the full House will then vote on it.

Families Against Mandatory Minimums (FAMM) also has an
action alert on this bill. Here are the gory details,
courtesy of FAMM:

* Makes the federal sentencing guidelines a system of
mandatory minimum sentences through a "Booker-fix" provision.
* Creates new mandatory minimums that further erode judicial
discretion.
* Eliminates the safety valve for low-level drug offenders.
* Makes virtually every drug crime committed in urban areas
subject to "drug free zone" penalties that carries a
five-year mandatory minimum sentence.
* Punishes defendants for the "relevant conduct" of
co-conspirators that occurred BEFORE the defendant joined
the conspiracy.

As written, H.R. 1528 would:

* Effectively make the federal sentencing guidelines a
system of mandatory minimum sentences through a "Booker-fix"
provision. This provision forbids judges from departing
below the guideline sentence in all but a few cases.

* Make the sale of any quantity of any controlled substance
(including anything greater than five grams of marijuana) by
a person older than 21 to a person younger than 18 subject
to a ten-year federal mandatory minimum sentence.

* Create a new three-year mandatory minimum for parents who
witness or learn about drug trafficking activities,
targeting or even near their children, if they do not report
it to law enforcement authorities within 24 hours and do not
provide full assistance investigating, apprehending, and
prosecuting the offender.

* Create a new 10-year mandatory minimum sentence for any
parent committing a drug trafficking crime in or near the
presence of their minor child.

* Mandate life in prison for persons 21 years or older
convicted a second time of distributing drugs to a person
under 18 or convicted a first time after a felony drug
conviction has become final.

* Increase to five years the federal mandatory minimum
sentence for the sale of a controlled substance within 1,000
feet of a school, college, public library, drug treatment
facility (or any place where drug treatment, including
classes, are held), or private or public daycare facilities
-- in short, almost anywhere in cities across the U.S.

* Eliminate the federal "safety valve," granting it only
when the government certifies that the defendant pled guilty
to the most serious readily provable offense (the one that
carries the longest sentence), and has "done everything
possible to assist substantially in the investigation and
prosecution of another person," and would prohibit the
federal "safety-valve" in cases where drugs were distributed
or possessed near a person under 18, where the defendant
delayed his or her efforts to provide substantial assistance
to the government, or provided false, misleading or
incomplete information.

This is absolutely sickening. As we said last week,

Sensenbrenner is a one-man disaster for justice. He's been
the driving force behind the Real ID Act and bills to strip
judges of their discretion in sentencing and subpoena
judges' records. In 2004, he wanted to add mandatory minimum
penalties to non-violent drug offenses (one example: a five
year mandatory minimum sentence for passing a joint to
someone who had been in a treatment center.)

Don't let him get away with it.

Ibogaine Therapy:A 'Vast, Uncontrolled Experiment'

Despite potentially harsh side effects,an African plant extract is being tested in two public clinical trials-and many clandestine ones

On a snowy President's Day, an odd group of activists and scientists devoted to treating addiction gathered in an art gallery in the Chelsea warehouse district of New York City. As an all-night, all-day rave throbbed next door, panelists outlined the latest developments in a decades-long movement to mainstream a West African plant alkaloid, ibogaine, that purportedly interrupts addiction and eliminates withdrawal. Sustained by true believers who operate largely outside the academic medical world, research on the vision-inducing drug is gaining attention, despite its U.S. status as a banned substance. The Food and Drug Administration (FDA) approved a clinical trial in 1993, but the National Institute on Drug Abuse (NIDA) decided not to fund it after consultants raised questions about safety. The plant extract can be neurotoxic at high doses and can slow the heart. Yet a handful of scientists continue to study it for its potential in treating addiction. The enthusiasts who gathered in New York reviewed efforts to tease apart its antiaddictive and hallucinatory components. Although a PubMed search for "ibogaine" pulls up some 200 articles on laboratory studies, clinical reports cover just a few dozen patients. That's because patients seek treatment clandestinely. "Whether the FDA likes it or not, the fact of the matter is that ... hundreds, probably thousands of people ... have been treated with ibogaine," said Stanley Glick, a physician and pharmacologist at the Albany Medical Center in New York who has documented ibogaine's antiaddictive potential in rodents. At the meeting, Kenneth Alper, a Columbia University assistant professor of psychiatry, estimated that more than 5000 people have taken ibogaine since an organized (but unregulated) clinic opened in Amsterdam in the late 1980s. Boaz Wachtel, an ibogaine advocate in Israel, believes that 30 to 40 clinics operate worldwide. Listed alongside heroin, LSD, and marijuana on the U.S. Drug Enforcement Administration's schedule I of banned substances, ibogaine is nevertheless legal in most of the world. "There's basically a vast, uncontrolled experiment going on out there," said Frank Vocci, director of antiaddiction drug development at NIDA. The agency spent several million dollars on preclinical ibogaine work in the 1990s before dropping it. Ibogaine's promoters yearn for the legitimacy that a successful clinical trial can bring. They may soon get their wish. Later this spring, neuroscientist Deborah Mash of the University of Miami in Coral Gables, Florida, will launch a phase I safety trial in Miami. A second safety and efficacy trial, of 12 heroinaddicted individuals, is slated to begin this fall at the Beer Yaakov Mental Health Center in Tel Aviv. Both are being funded in an unusual fashion: by anonymous donations-$250,000 for Mash, a smaller amount for the Israeli study. Restarting  For Mash, a tenured professor who runs an Alzheimer's brain bank and won attention in the 1980s for research on how mixing alcohol and cocaine damages the brain, the donation marks a victory. The holder of a patent claim on ibogaine, she has been trying for 12 years to give the drug a scientific hearing. FDA approved Mash's phase I study in 1993, but she abruptly halted the trial when NIDA rejected her funding application. Three years later, she moved offshore, opening a fee-for-service clinic on the Caribbean island of St. Kitt's. The standard fee per patient of several thousand dollars is adjusted based on ability to pay, according to Mash. Critics derided the unorthodox move as a money grab, but Mash maintains that her motivations were scientific. "You know, somebody ought to test it. Either the damn thing works or it doesn't," she said in a telephone interview. At the New York meeting, Mash's physician colleague Jeffrey Kamlet presented snippets of data from the 400 patients he and Mash helped treat at St. Kitt's. (Patients took a single dose of ibogaine titrated to body weight and other factors.) He said that for up to 90 days posttreatment, patients reported "feeling wonderful"; physician evaluations also showed improvement in depression and drug-craving scores. The results mirror those from 27 cocaine- and heroin-addicted individuals treated with ibogaine at St. Kitt's published by Mash in 2000 in the Annals of the New York Academy of Sciences. However, Mash has not published the bulk of her data. Her explanation: She does not want to stir up long-running controversies, including a patent dispute with Howard Lotsof, who discovered ibogaine's antiaddiction value as a young heroin addict in 1962. Multiple effects  There is no consensus on precisely how  ibogaine works, although researchers have shown that it inhibits the reuptake of the  neurotransmitter serotonin, among other actions. In this way, "it's like supersticky, long-acting Prozac," said Kamlet, president of the Florida Society of Addiction Medicine in Pensacola. It can also have effects similar to those of LSD or PCP. Like them, it jolts serotonin and glutamate systems and can cause hallucinations and feelings of depersonalization. In Gabon, the Bwiti religion revolves around "visits to the ancestors" induced by eating root bark from the shrub Tabernanthe iboga, the source of ibogaine. Many patients in the West also report emotionally intense, sometimes frightening visions: scenes from childhood, or past mistakes and regrets replayed and somehow released. Debate rages over whether these experiences are key to ibogaine's antiaddictive potential or simply a psychedelic side effect. Not every patient experiences visions, but animal and human pharmacokinetic data reveal a common physiological response: The liver converts ibogaine into its primary metabolite, noribogaine, which fills opiate receptors hungry for heroin or morphine. Mash believes that this dramatically reduces or eliminates withdrawal symptoms, and "that's why [addicts] don't feel dope sick anymore." Ibogaine also stimulates nicotinic receptors in the cerebellum, an action that, according to Glick, contributes to ibogaine's long-lasting antiaddictive properties by modulating the dopamine reward circuit in the midbrain. Besides tweaking neurotransmitters, rodent studies suggest that ibogaine increases quantities of a protein in the brain called glial cell line-derived neurotrophic factor (GDNF). Researchers at the University of California, San Francisco, recently observed this effect in the brain's dopamine-producing areas. Dorit Ron and colleagues reported in the January issue of the Journal of Neurosciencethat addicted rodents lose interest in opiates when given either ibogaine or GDNF. But after injecting an anti-GDNF antibody that scoops the growth factor out of play, the team found that the animals go dope-crazy again. Ron goes further, suggesting that GDNF maintains and possibly even repairs frazzled dopamine receptors. She reported last year in the Journal of Neurosciencethat genetically modified mice producing excess GDNF grow up to have denser dopamine connections in the ventral tegmental area, where the dopamine reward pathway begins. Mash and others suggest that the effects of the St. Kitt's therapy lasted up to 3 months because unmetabolized ibogaine deposits in fat, creating a slow-release reservoir, and because metabolized ibogaine can stay in circulation for weeks. But government agencies are wary of ibogaine, in part because of its myriad effects. It slows the heart and, at very high doses, can destroy neurons in the cerebellum. FDA and NIDA cited these toxicity risks repeatedly in the 1990s. Glick has been trying to develop cleaneracting derivatives. The best-studied,  18-methoxycoronaridine (18-MC), exhibits strong action at nicotinic receptors but "seems to lack all of the actions that make ibogaine undesirable," said Glick. Mash and other ibogaine supporters claim that the neurotoxicity risks have been hyped. But the St. Kitt's team closely monitors heart activity of volunteers, excluding any with irregular rhythms. While Glick tries to line up funding for clinical studies of 18-MC, Mash is betting on a formulation of the metabolite noribogaine. She and the University of Miami won patent rights to noribogaine in 2002 after a longrunning dispute with Lotsof, who holds a patent claim on ibogaine. Mash hopes that, like 18-MC, noribogaine may offer antiaddictive effects without the scary trip. Meanwhile, Vocci is disappointed that Mash has not published her data from St. Kitt's. "This big case series, no one knows what to make of it," he said. "I would expect to see a spectrum of responses. Even though it's not a controlled study, it would still give us some idea whether or not she has anything worth looking at." If Mash's new trial does produce promising data, ibogaine advocates will have a token of legitimacy to point to. But the circle of true believers seems to be expanding, Wachtel says, because users insist that ibogaine works.

where we held a one-day conference on MDMA research and met with Ministry of
Health & Israeli Anti-Drug Authority officials. We're back and focused on

1. Israeli scientists, regulators, and media supportive of starting
MDMA/PTSD research

MAPS president Rick Doblin, staffers Valerie Mojeiko and myself, and several
MAPS-funded researchers and MAPS members traveled to Israel to help build
support for a MAPS-sponsored Israeli MDMA/PTSD pilot study. The study will
examine the effects of MDMA-assisted therapy for people with Posttraumatic
Stress Disorder (PTSD) as a result of war or terrorism. The highlight of the
trip was a one-day conference attended by Ministry of Health officials,
Israeli Anti-Drug Authority officials, doctors, laypeople, and reporters
interested in the study. The speakers were:

-Dr. Michael Mithoefer, primary investigator of the MAPS-sponsored MDMA/PTSD
study in South Carolina
-June May Ruse, Ph.D., director of MAPS' MDMA/PTSD treatment manual project
-Dr. John Halpern, primary investigator of the FDA-approved Harvard Medical
school MDMA research in cancer patients with anxiety
-Dr. Raphael Mechoulam, Israeli scientist who discovered THC in cannabis and
decades later the brain's endocannabinoid system, and is now beginning
research in Israel with cannabis in treating PTSD
-Valerie Mojeiko, who discussed her proposed outcome study of the use of
ibogaine in treating substance abusers
-Dr. Udi Bastiaans, who discussed his Internet-based outcome study with
ibogaine 
-Jose Carlos Bouso, Ph.D. candidate, primary investigator for the
MAPS-sponsored MDMA/PTSD study in Spain that was shut down for political
reasons but which we are now working to resume
-Dr. Torsten Passie, psilocybin and ketamine researcher from Germany
-Dr. Jordi Riba, ayahuasca researcher from Spain

The talks were filmed and will be available for downloading on the MAPS
website within the  next few weeks.

Prior to the conference, MAPS researchers met with officials from the
Israeli Anti-Drug Authority and Ministry of Health, and members of both
expressed support for the study. Dr. Moshe Kotler, Chair, Dept. of
Psychiatry, Tel Aviv University, Sackler School of Medicine, and former
chief psychiatrist of the Israeli Defense Forces, will be the study's
principal investigator.  In light of the latest scientific data and positive
political response, Dr. Kotler has decided to go forward and submit the
protocol for review to the ethics committee and Ministry of Health, seven
years and three conferences after he was first contacted by MAPS about
conducting MDMA/PTSD research.

The largest Israeli weekly newspaper, Yediot Ahronot, ran a very favorable
story <http://www.maps.org/sys/nq.pl?id=423&amp;fmt=none> on the research,
which was published the day after the conference in its weekly magazine.
The article included a full-page image that is probably the most positive
portrayal of the promise of MDMA that has ever been published. The image
(see the link above) is of a weary man in the middle of a blood-red ocean,
with several helicopters flying behind him. He's almost drowned but has been
saved by a life preserver in the shape of an Ecstasy pill, complete with
smiley face!

2. Design work begins for new Spain MDMA/PTSD study.

Jose Carlos Bouso, the Ph.D. candidate who began a MAPS-sponsored MDMA/PTSD
dose-response pilot study in Madrid shut down for political reasons in May
2002, is now working on a revised protocol that he thinks can be approved
before the end of 2005. The protocol as currently designed will involve 12
subjects who will receive a combination of about 8 hours of non-drug
psychotherapy and two day-long MDMA sessions. Eight of the subjects will
receive full doses of MDMA and 4 will receive threshold/placebo doses of
MDMA.

The main reason we think that we can now obtain approval is that Jose Carlos
Bouso has found a private hospital that is seriously interested in having
the study conducted in its facility. This private hospital is not as
vulnerable to political pressure from the Anti-Drug authorities as the
public hospital where the study was previously conducted. In addition,  the
scientific consensus about the risk/benefit ratio for the use of MDMA in
clinical research has changed substantially from several years ago. The risk
of neurotoxicity is now generally considered to be minimal and we have
promising efficacy data from Dr. Mithoefer's MDMA/PTSD pilot study.  The
most important factor of all is Jose Carlos Bouso's continued committment to
conducting MDMA/PTSD research, in the face of initially overwhelming
political opposition.

MAPS has pledged an initial $25,000 to fund the Spain study and is in the
early planning stages of a benefit to raise additional funds.

3. Swiss psychiatrist Dr. Peter Oehen visits MAPS to discuss MDMA/PTSD
research

Dr. Peter Oehen, a member of a group of Swiss psychiatrists who were
permitted to offer LSD and MDMA-assisted psychotherapy in Switzerland from
1988-1993,  will be visiting with Rick Doblin on April 8-9 and then with Dr.
Michael and Annie Mithoefer in Charleston, SC. Dr. Oehen is exploring the
possibility of conducting MDMA/PTSD research in Switzerland with a protocol
design similar to the ones that MAPS will be using in the US, Israel and
Spain studies. Since MAPS is developing MDMA within a non-profit context, we
make our protocols, informed consent forms and literature review available
to any research team in the world to use as is or modify as they choose.
We're excited about the possibilities for the globalization of MDMA/PTSD
research.

4. MAPS clinical research monitoring team met in Boston March 11-13, started
work on MDMA/cancer anxiety study.

MAPS has assembled a team to monitor our clinical trials to ensure that the
data gathered in each of our studies is properly and thoroughly recorded.
There are hundreds of pages of paperwork on every subject in every study,
and managing this mountain of data is an important part of ensuring that our
results are communicated effectively to, and accepted by, the FDA and the
larger scientific community. The monitoring team consists of Amy Emerson,
who monitors studies professionally for a major pharmaceutical company, and
MAPS staffers Valerie Mojeiko and Ilsa Jerome, Ph.D.

The team met on March 11-13 with Dr. John Halpern, Rick Doblin and Jill
Stammer (who will help with data collection) for an initial site visit and
began the process of developing written procedures and Case Report Forms for
the conduct of the study. The team will also monitor the MAPS-funded studies
in South Carolina and (when approved) Israel and Spain and perhaps also
Switzerland.

MAPS' MDMA/cancer anxiety study can begin once DEA issues a Schedule I
license, which we expect will occur within a month or so.


5. MAPS receives $40,000 grant from a family foundation for MDMA
psychotherapy research

On March 10, 2005, MAPS was informed that it had been awarded a $40,000
grant from a family foundation for our MDMA psychotherapy research efforts.

We still have a fundraising mountain to climb of about $500,000 for all our
MDMA research projects already approved or on the immediate horizon, so if
you have any leads for additional grants, please let us know.
 

6. MAPS assists Sandra Karpetas of Iboga Therapy House in applying for
Health Canada grant

On February 28, Sandra Karpetas of the Iboga Therapy House, an ibogaine
clinic in Vancouver providing free ibogaine treatments to addicts that was
shut down due to lack of funds, applied for a Canadian government grant from
Health Canada to provide ibogaine detoxification
services to 20 people as a pilot project. The grant is part of the Drug
Strategy Community Initiatives fund, created under the leadership of Health
Canada in April 2004 to facilitate the development of community-based
solutions to substance abuse.

MAPS staffer Valerie Mojeiko assisted in writing and editing the grant
application, and if the clinic reopens, MAPS will provide guidance and
funding for an evaluation component of the clinic's services. MAPS will also
serve as the organization that administers the grant. A decision about the
grant is expected before the end of June.


7. April 22 deadline for prehearing statement in medical marijuana lawsuit
v. DEA

On February 28, 2005, DEA filed its prehearing statement
<http://www.maps.org/mmj/legal/DEA_prehearing_doc.pdf> in the Administrative
Law Judge hearings about DEA's refusal to grant a license to Prof. Lyle
Craker, UMass Amherst, to establish a MAPS-sponsored
facility to produce marijuana exclusively for federally-approved research.
Prof. Craker's prehearing statement is due April 22, 2005, with
our pro-bono lawyers (Julie Carpenter of Jenner & Block, Emanuel Jacobowitz
of Steptoe & Johnson, and  Allen Hopper of the ACLU Drug Law Reform Project)
and Rick Doblin making progress on the statement and the gathering of
witnesses for the hearing itself.  We intend to show to the DEA
Administrative Law Judge that it is in fact in the public interest to break
the government monopoly on the supply of marijuana that is legal for
research, since the monopoly is used to obstruct research, and that US
international treaty obligations do not prevent DEA from issuing a license
to Prof. Craker, as the DEA contends.

After the prehearing statements are submitted, there may be supplemental
statements submitted by DEA and on behalf of Prof. Craker. Then the judge
will set a date for the hearing, probably before the end of Summer 2005. The
decision by the US Supreme Court in the Raich v. Ashcroft medical marijuana
case should be issued before the DEA hearing. It's considered likely that
the Supreme Court will assert federal authority over state medical marijuana
laws. This will make the FDA-approved research process the only way for
patients to obtain marijuana legally from a federal perspective, increasing
the need for the DEA to license the UMass Amherst facility.

8. Proposed MAPS and CaNORML-sponsored vaporizer research waiting on Health
& Human Services (HHS) review and DEA license

More than 21 months after submission,  Chemic Laboratories' proposed
vaporizer study is still awaiting review of its application to purchase ten
grams of marijuana from NIDA and import ten grams of marijuana from the
Dutch Office of Medicinal Cannabis. The protocol itself needs to be reviewed
by NIDA/Public Health Service scientists in a process which has no time
limit and has already been delayed for more than 1 3/4 years.

MAPS' lawsuit against NIH/NIDA/HHS in the DC Circuit Court of Appeals,
arguing unreasonable delay, failed to convince the court to compel
NIH/NIDA/HHS to justify the delay. The case was dismissed without prejudice,
meaning that we can resubmit the lawsuit after another period of time goes
by without response. Fortunately, the DC  Circuit Court of Appeals did
require the DEA to justify why it had taken 3 1/2 years and had still not
responded to Prof. Craker's application to grow marijuana for research.
Rather than try to justify its inaction, DEA rejected Prof. Craker's
application on December 10, 2004, which has enabled us to sue DEA in the
above-mentioned Administrative Law Judge hearing.

In another bureaucratic manuever, DEA stated on December 10, 2004 that
Chemic needed a research license in addition to its analytical lab license.
Chemic immediately applied for the research license and is still waiting
almost four months later. The criteria to receive a research license are
identical to that required for an analytical laboratory license.

In early March, Chemic received word from the DEA that its application for a
research license was being processed and received word from HHS that its
protocol was being reviewed. We anticipate positive decisions on both of
these reviews in April or May.  As far as we can tell, DEA is probably
planning to improve its position in the Administrative Law Judge hearing by
granting Chemic its research license and approving the protocol. Denying
Chemic permission to purchase 10 grams of marijuana from NIDA after almost
two years would clearly demonstrate that NIDA's monopoly is insufficient to
facilitate privately-funded medical marijuana research.

9. Upcoming conferences: ASSA, MindStates

The Bay Area will host two upcoming conferences for the psychedelic
community: the Altered States & the Spiritual Awakening (ASSA) conference
and the Mind States Conference. The ASSA conference, now in its third year,
will be held April 15-16. Speakers include Stan Grof, Rick Doblin, Ralph

The Mind States conference has moved from Berkeley to San Francisco this
year, and will be held May 27-29 at the Palace of Fine Arts Theater. Three

10. MAPS Benefit Auction: A success!

Thanks to the generous donations and generous bidding of MAPS supporters and
friends, we raised just about $20,000 with the first-ever online MAPS
Benefit Auction. Some of the highest-selling items were a set of prints by
Dean Chamberlain ($2650), a guitar donated by The Cure ($1025), and a
beautiful Huichol yarn painting ($1500). We made a total of $2065 on
glassware donated by chemist Sasha Shulgin. If you were bid out, don't
worry- we hope to continue this project in the future.
