Dear All,
Although I have no personal experience of dealing with judicial system and its
components but through media and experience of closed ones I am making some
remark.
Like all other professionals,lawyers also have added commercial tag to their
services.
There is a close nexus of lawyers and judges atleast in lower courts.
Lawyers are charging hefty amounts in the name of their reputation but its their
junior who appears in the court on their behalf.
Judiciary is suffering from inbreeding.
Lawyers with hand in glove with judicial system keep on lingering the legal
cases.
I heared a quote long back ,If you are not facing the hospital,police or
judiciary you are the luckiest one.

I further partly reproduce from two paras of the speech of Shri Suraj Narain Prasad Sinha, Chairman of the Bar Council of India, delivered at the time of assuming the office of the Chairman as hereunder:


“The modern Indian legal profession is the creation of the Advocates Act, 1961. It is conceptualised as a service oriented profession and not as a profit oriented trade. The Indian Bar consists of about 10 lakh and 20 thousand lawyers. In addition, there are about 740 law colleges and 11 national law universities under the control of the statutory body representing the profession, the Bar Council of India”.


“As in the case of other democratic countries like England, America etc. in India also the leaders of the national freedom struggle were the products of the legal profession. The independence movement of India was vanguarded by the legal profession and spearheaded by leading lawyers of the country”.

As you are aware, I Love Mumbai and Giants International came out in full force to help on 26/11 the day of the terror attack, with blood donation drives, visits to the hospitals with medicines, food, educational and cash aid and counseling the victims.

Both these NGOs have been doing a lot for the beautification of Mumbai.

This time round, along with a students group named PRISM Stand Up and Act, a registered NGO, we have organized an event to pay an artisitc tribute to the 26/11 Martyrs and victims through art.  We have dedicated a prominent wall opposite Marine Lines Station to them.

 

We have got several art students from various art colleges in Mumbai and some professional artists to create designs in memory of the victims and martyrs.  

Our objective is to create something that is visually beautiful using  strategic colours -- Black for darkness -shadow, destruction and death, Red for bloodshed and sacrifice and White for Peace, Harmony and the Spirit of Mumbai; along with some social message through art, and have it painted on the wall.

This is an entirely free, fair and all inclusive secular platform working towards uniting Mumbaikars in a Tribute with absolutely no political motive or association.

We invite all our fellow Mumbaikars to treat this as your own initiative. Come support and participate in large numbers.

Paints and brushes will be provided for painting on the spot. Bring your concepts and designs. The designs should be peaceful in nature and not obscene in any form or manner whatsoever.

About a year back We were told that CT Scan, skin dept. etc  will start in this hospital soon. However same is pending for getting sr. minister. we have learnt that u r waiting for BMC election when same can be inaugurated to encash votes. Also it is said CT scan machine installed is defective. And that u will start the CT scan after the 1 year guarantee is over so that from new budget another lacs of Rupees can be given and CT scan can be started. Pl. tell us the truth and start the CT scan lying idle for a year. U have also failed to act on letter of Loksatta which is criminal inefficiency and negligence.

NEW DELHI: Her marriage was fixed and everything from the groom, his family to their financial status seemed perfect for 21-year-old Simran (name changed). Even his profile on a matrimony portal was one of the most popular. But a last-minute check by a detective agency opened up a can of worms. Not only was the groom a divorcee but, in fact, had three children. Besides, he was an alcoholic the main reason why his wife walked out.

At a time when marriages are being decided over the internet and couples prefer to wait till they build a flashy career, the Association of Private Detectives Of India (APDI) has come up with startling facts for the city.

According to Kunwar Vikram Singh, chairman APDI, there has been a phenomenal rise in the number of brides and grooms seeking to "cross-check one another's background'' before tying the knot. "There has been a 36% increase in the number of people going for pre-marital checks. Significantly, a huge 41% rise has been recorded in the post-marital queries. The average number of queries with individual agencies before marriage is around 60 per month, while post-marriage queries number around 45,'' said Singh.

According to detective agencies, it takes about a 7-10 days to complete pre-marriage enquiries. Such an exercise costs anything between Rs 15,000 and Rs 20,000. It's more for post-marriage queries which are customer specific and involve more work and detailing. Hence, the costs can go even up to around Rs 1 lakh.

"It is common for parents to get suspicious about the match and take our services. We have 21 such agencies across the country and employ over 14,000 people,'' said Sachit Kumar, managing director, Global Detectives, the oldest such agency in the country.

Mahesh C Sharma, managing director of GDX detectives, said the biggest challenge was to deliver according to the requirements of the expanding clientele. "Words are not enough, we produce photographs and hard copy evidences to ascertain our findings,'' said Sharma.

2) POLICE LAWS CAST CATEGORICAL AND UNAMBIGUPOUS DUTY ON POLICE MACHINERY TO PREVENT COGNIZABLE OFFENCES;

3) THE DUTY OF POLICE IS NOT TO SIT IN THE MERE POLICE STATION AND RUN TO THE SITE OF OFFENCE WHEN IT IS CALLED UPON;

4) THE DUTY OF POLICE STATION CONCERNED THUS INCLUDES TO CREATE AN ATMOSPHERE WITHIN ITS JURISDICTION WHEN THE POTENTIAL OFFENDER COMPEL TO THINK THE PRESENCE OF POLICE IN THE IMMEDIATE VICINITY IF HE IS VENTURED TO COMMITT AN OFFENCE;

ANSWER: HIGH COURT CONCERNED BY WRIT OF MANDAMUS.

(1) QUESTION RAISED:
The police can not be present at all places. They simply don’t have the manpower.
MY TAKE: In my view it is instead much easy for Police to create an impression of being present at all places at all the time in comparison to what they do are to do while investigating any crime..... filing chargesheet ... proving guilt of the accused beyond reasonable doubt.... maintaining prisoners and prison....

Moreover the shortcomings of manpower cannot be a ground for nobody has prevented the State to employ needed man power.

Moreover our present Chief Justice of Bombay High Court in a case before it observed- "in fact police should have been present at every corner of the city"

In Ajmal Kasab's trial 11,000 page chargesheet was filed.

Next, the media makes a big deal about his letter to his magistrate about requiring toothpaste and permission to take a walk!!

And then finally, he claims NOT GUILTY to 86 charges and the "TRIAL" still continues??

MOREOVER THE PLEA OF PAUSITY OF MANPOWER IF IS ALLOWED AS DEFENSE IN FAILURE OF LEGAL DUTY ENTRUSTED, THEN YOU MAY FIND THE STATE GOVT TAKING ANOTHER STAND OF INCOMPETENCY OF THE CONSTABULARY THAT IS THE PRESENT CONSTABULARY ARE POOR FAT THIN, OLD, THEY HAVE MERELY DANDA, HOW THEY WILL COUNTER THE ARMED OPPONENT AND SO ON.

BUT THEN WHO HAS POSITIONED THIS “POOR FAT THIN OLD DANDA ARMED CONSTABULARY.”

(2) QUESTION RAISED:
But you know the practical difficulties.....the time for the case to come up, the stamp duty and the lawyers fees. And then courts give so inadequate damages, that in the end you feel it was not worth the trouble.
MY TAKE: In my view Writ Jurisdiction under Article 226 can be invoked which doesnt involve stamp duty. In my view lawyers should be avoided and simple Writ should be filed with Written arguments as contained in our CPC 1908 and court may be asked to pass reasoned orders. This may seem idealistic and theoritical and it is. But can be tried. Thank you.

Man gets three years in prison for sex with horse

A US man caught having sex with a horse in a South Carolina stable has been sentenced to three years in prison.
Multiple media outlets report that Rodell Vereen was sentenced on Wednesday after pleading guilty to buggery.
A judge also ordered Vereen to get counselling and stay away from the Lazy B stables when he was released.
Authorities charged Vereen after a woman set up a surveillance camera and caught him on tape having sex with her horse in July.
Horse owner Barbara Kenley said she staked out the stable and caught Vereen sneaking into the barn days later, holding him at shotgun point until police arrived.
Kenley had seen Vereen before. He pleaded guilty last year to having sex with the same horse and was put on probation and ordered to register as a sex offender.

Previous animal studies had shown that BPA had a negative impact on mice and rats, but the study published Wednesday in the journal Human Reproduction was the first to examine its effects on male reproductive systems in humans.

The study examined 634 workers in factories in China over a five year period, comparing workers in facilities that produced BPA with those in facilities where the chemical compound was not present.

"The study found that the workers in the BPA facilities had quadruple the risk of erectile dysfunction, and seven times more risk of ejaculation difficulty," the study said.

The levels of BPA in the Chinese facilities were 50 times higher than what an American male faces in US factories, and it was not known what the effect of lower levels of exposure might be.

"This study raises the question: Is there a safe level for BPA exposure, and what is that level?" said De-Kun Li, an epidemiologist with Kaiser Permanente in Oakland, California and a lead author of the study.

"More studies like this, which examine the effect of BPA on humans, are critically needed to help establish prevention strategies and regulatory policies," he said.

BPA is used in the production of polycarbonated plastics and epoxy resins found in baby bottles, plastic containers, the lining of cans used for food and beverages, and in dental sealants.

A 2008 study by toxicologists at the National Institutes for Health found that the substance could affect the development of the brains of fetuses and newborns.

In March, the six biggest US manufacturers of baby bottles decided to stop selling products containing BPA in the United States, and US lawmakers introduced legislation to ban food containers with BPA.

French Health Minister Roselyne Bachelot, nevertheless, said in March that reliable studies had concluded that baby bottles made with BPA were harmless.

Noisy lover loses sex appeal

A British woman has lost her appeal against a ban on her noisy sex sessions, after a court heard how her marathon romps that kept neighbours awake sounded like someone being murdered.

Caroline and Steve Cartwright's "howling" lovemaking sounded "unnatural", "hysterical" and "like they are both in considerable pain", Newcastle Crown Court in north-east England heard.

A 10-minute recording of their sex sessions was played in court, which also heard how she tried covering her face with a pillow to muffle her cries of passion.

Neighbours at their home in Washington, County Durham, south of Newcastle, complained about the noise - as did passers-by and the postman.

The couple were banned from "shouting, screaming or vocalisation at such a level as to be a statutory nuisance", but Mrs Cartwright, 48, appealed under human rights laws against her conviction for breaching the ban.

However, a judge on Tuesday upheld the original conviction and ordered that the banning order should stay.

Mrs Cartwright said she was unable to stop the din.

"I tried to control it. I even tried to use a pillow [over her face] to try and lessen the noise," she said.

The judge, Recorder Jeremy Freedman, rejected her claim.

"We are in no doubt whatsoever about the level of noise that can be heard in neighbouring properties, in the street and in the back lane," he said.

"It certainly was intrusive and constituted a statutory nuisance. It was clearly of a very disturbing nature and it was also compounded by the duration - this was not a one-off, it went on for hours at a time.

"It is further compounded by the frequency of the episode - virtually every night.

"We do not find there is any infringement of her human rights in any shape or form."

The romps typically started at midnight and lasted for several hours, the judge heard.

The couple's next-door neighbour Rachel O'Connor told the court: "It's just quite unnatural.

"The noise sounds like they are both in considerable pain.

"I cannot describe the noise. Totally excessive and I have never, ever heard anything like it.

"I put my television in my bedroom on as loud as it could go and they drown it out."

The local council set up special equipment in the O'Connors' flat and recorded noise levels of between 30 to 40 decibels, peaking at 47 - as loud as a conversation in the very same room.

Marion Dixon, a council environmental health manager, took notes which said: "I heard a male voice howling loudly, which I felt was very unnerving."

Her colleague Pamela Spark called the sounds "hysterical, almost continuous, just screaming".

"I found it very disturbing and I noted that it sounded like she was being murdered."

Ms Dixon said that, when the council confronted the couple, "Mr Cartwright held his head in his hands but Mrs Cartwright seemed to find it quite amusing".

What to take to bed with you - not a joke .

Pretty neat idea. Never thought of it before. 


Put your car keys beside your  bed at night

Tell your spouse, your children, your neighbors, your parents, your Dr's office, the check-out girl at the market, everyone you run across.  Put your car keys beside your bed at night.

If you hear a noise outside your home or someone trying to get in your house, just press the panic button for your car.  The alarm will be set off, and the horn will continue to sound until either you turn it off or the car battery dies.  This tip came from a neighborhood watch coordinator. Next time you come home for the night and you start to put your keys away, think of this:  It's a security alarm system that you probably already have and requires no installation. Test it. It will go off from most everywhere inside your house and will keep honking until your battery runs down or until you reset it with the button on the key fob chain. It works if you park in your driveway or garage.  If your car alarm goes off when someone is trying to break into your house, odds are the burglar/rapist won't stick around.   After a few seconds all the neighbors will be looking out their windows to see who is out there and sure enough the criminal won't want that. And remember to carry your keys while walking to your car in a parking lot. The alarm can work the same way there. This is   something that should really be shared with everyone. Maybe it could save a life or a sexual abuse crime.  

P.S. I am sending this to everyone I know because I think it is fantastic. Would also be useful for any emergency, such as a heart attack, where you can't reach a phone. My Mom has suggested to my Dad that he carry his car keys with him in case he falls outside and she doesn't hear him.. He can activate the car alarm and then she'll know there's a problem.

Asset allocation is like morality: it is most talked about and less practised. Both have similar problems. On the face of it both are quite simple but the moment you try to implement , they become confusing. For example telling lies is immoral but many scriptures says that one should lie to protect someone or charity in general is good but charity to non-deserving recipient is a sin.

The list goes on. Other problem is temptation of instant gain motivates people to deviate from moral behaviour. In spite of such difficulties , we know that people who practice morality gain in a holistic way in the long term and also if the level of morality increases in society, the society as a whole becomes a more efficient and happier place to live.

Similarly, asset allocation even though academically is a very simple concept, people in general have found it very difficult to implement . Like morality, asset allocation also is contextual and hence confusing. Many people also get tempted to deviate from it in search of instant gains and many times end up getting undesired results. If people start getting disciplined about their asset allocation and rebalancing, they are less likely to meet with financial disasters.

At the broader level if most of the investors start practising it, the boom and bust cycles of the asset prices can be smoothened out to an extent (because bubbles will not form as most of them will be rebalancing if markets go up) and overall risk of investment can reduce which will result in happier investment environment.

Various academic research papers have shown that asset allocation return explains around 90-95 % of portfolio returns. Stock picking or fund manager selection does not contribute more than 10% of ones portfolio returns.

The irony is that most of the investors spend 90% of the time on activities which contribute only 10% of returns. Thus asset allocation is extremely important and one should give enough attention to it.

Take the example of equity assets: one may be better of by picking an index funds/ETFs rather then going through analysis paralysis. This will allow him/her to focus on how much equity should be there in the portfolio.

Many people are not aware that asset allocation is a three dimensional exercise. Most of us know of two dimensions — risk and return . In simple terms, if one is willing to take higher risk, then expected returns may be higher and vice versa. The third dimension of asset allocation is correlation of assets with each other. In other words it is also an extent of diversification. Blending of non-correlated assets improves risk adjusted returns.

In the context of Indian portfolios currently gold is an important diversifier due to its lower correlation with Indian equity markets. It is also very important to note that such correlation of assets is not a static thing. It keeps on evolving and hence asset allocation requires periodic monitoring.

For example in the early 90s, equity markets of various countries were not correlated and hence most of the global portfolios were constructed based on regional or country indices. But in late 90s due to freer capital movement correlation of all equity markets increased and hence the impact of geographical diversification on the portfolio reduced to a great extent.

Rebalancing is a very important part of asset allocation. The asset allocation may get skewed due to movement of prices of various assets. It needs to be corrected and brought back to the model allocation for two reasons. The first is that a skewed portfolio may not help you achieve desired results in terms of risk and return.

The second reason is that such rebalancing results in partial selling of assets whose prices have moved relatively higher compared to other assets and buying of assets whose prices have moved relatively lower. This becomes an automatic discipline and saves investors from bouts of fear and greed.Deciding the frequency of rebalancing is also a challenge. Whether, one should do monthly, quarterly or yearly. Too frequent rebalancing increase transaction cost and tax impact while too late rebalancing looses its purpose.

One of the best solutions is to decide an outer limit of tolerance and whenever it reaches that one can do rebalancing. For example, if the model portfolio is say 50% in equity and 50% in debt one can set up limit of say 60-40 . i.e if equities rise and its allocation becomes 60% of the portfolio one can sell a portion and bring it back to 50% or vice versa if markets have gone down and equity allocation comes down to 40%. This will ensure that transaction costs are kept in check and transaction happens only when meaningful move in assets occur.

Asset allocation exercise is must for all savers. It inculcates discipline and “discipline is the bridge between goals and accomplishment.".

What killed Ranjan Das and Lessons for Corporate India

A month ago, many of us heard about the sad demise of Ranjan Das from Bandra, Mumbai. Ranjan, just 42 years of age, was the CEO of SAP-Indian Subcontinent, the youngest CEO of an MNC in India. He was very active in sports, was a fitness freak and a marathon runner. It was common to see him run on Bandra's Carter Road. Just after Diwali, on 21st Oct, he returned home from his gym after a workout, collapsed with a massive heart attack and died. He is survived by his wife and two very young kids.

                                                        

It was certainly a wake-up call for corporate India. However, it was even more disastrous for runners amongst us. Since Ranjan was an avid marathoner (in Feb 09, he ran Chennai Marathon at the same time some of us were running Pondicherry Marathon 180 km away), the question came as to why an exceptionally active, athletic person succumb to heart attack at 42 years of age.

Was it the stress?

A couple of you called me asking about the reasons. While Ranjan had mentioned that he faced a lot of stress, that is a common element in most of our lives. We used to think that by being fit, one can conquer the bad effects of stress. So I doubted if the cause was stress.

The Real Reason

Last week, I was working with a well-known cardiologist on the subject of ‘Heart Disease caused by Lack of Sleep’. While I cannot share the video nor the slides because of confidentiality reasons, I have distilled the key points below in the hope it will save some of our lives.

Some Excerpts:

·        Short sleep duration (<5 or 5-6 hours) increased risk for high BP by 350% to 500% compared to those who slept longer than 6 hours per night. Paper published in 2009.

As you know, high BP kills.

·        Young people (25-49 years of age) are twice as likely to get high BP if they sleep less. Paper published in 2006.

·        Individuals who slept less than 5 hours a night had a 3-fold increased risk of heart attacks. Paper published in 1999.

·        Complete and partial lack of sleep increased the blood concentrations of High sensitivity C-Reactive Protein (hs-cRP), the strongest predictor of heart attacks. Even after getting adequate sleep later, the levels stayed high!!

·        Just one night of sleep loss increases very toxic substances in body such as Interleukin- 6 (IL-6), Tumour Necrosis Factor-Alpha (TNF-alpha) and C-reactive protein (cRP). They increase risks of many medical conditions, including cancer, arthritis and heart disease. Paper published in 2004.

·        Sleeping for <=5 hours per night leads to 39% increase in heart disease. Sleeping for <=6 hours per night leads to 18% increase in heart disease. Paper published in 2006.

Ideal Sleep

For lack of space, I cannot explain here the ideal sleep architecture. But in brief, sleep is composed of two stages: REM (Rapid Eye Movement) and non-REM. The former helps in mental consolidation while the latter helps in physical repair and rebuilding. During the night, you alternate between REM and non-REM stages 4-5 times.

The earlier part of sleep is mostly non-REM. During that period, your pituitary gland releases growth hormones that repair your body. The latter part of sleep is more and more REM type.

For you to be mentally alert during the day, the latter part of sleep is more important. No wonder when you wake up with an alarm clock after 5-6 hours of sleep, you are mentally irritable throughout the day (lack of REM sleep). And if you have slept for less than 5 hours, your body is in a complete physical mess (lack of non-REM sleep), you are tired throughout the day, moving like a zombie and your immunity is way down (I’ve been there, done that L)

Finally, as long-distance runners, you need an hour of extra sleep to repair the running related damage.

Interpretation: Score of 0-9 is considered normal while 10 and above abnormal. Many a times, I have clocked 21 out the maximum possible 24, the only saving grace being the last situation, since I don’t like to drive (maybe, I should ask my driver to answer that line J)

In conclusion:

Barring stress control, Ranjan Das did everything right: eating proper food, exercising (marathoning!), maintaining proper weight. But he missed getting proper and adequate sleep, minimum 7 hours. In my opinion, that killed him.

If you are not getting enough sleep (7 hours), you are playing with fire, even if you have low stress.

I always took pride in my ability to work 50 hours at a stretch whenever the situation warranted. But I was so spooked after seeing the scientific evidence last week that since Saturday night, I ensure I do not even set the alarm clock under 7 hours. Now, that is a nice excuse to get some more sleep. J

 

Unfortunately, Ranjan Das is not alone when it comes to missing sleep. Many of us are doing exactly the same, perhaps out of ignorance. Please forward this mail to as many of your colleagues as possible, especially those who might be short-changing their sleep. If we can save even one young life because of this email, I would be the happiest person on earth.
