RE: S B Account no. : 04130100005548 of Alok Tholiya and others

Sub : bouncing of cheque for reasons drawers signature differs

Cheque was issued to Mumbai municipal corporation, H East towards Property tax payment for just Rs. 2521/-

 

Pl. note that our family is account holder with you since inception of this branch that is for over 30 years.

 

However above cheque was bounced for aforesaid reason. We called up to understand / clarify were told to come personally and curtly phone was kept. Then I sent my office boy twice but he was told that now cheques under clearing go to service branch (due to computerization same is now done from central place) and hence we can not reply anything. No tel. no. , name of person, address of service branch was given.

Finally myself with my wife (joint holder and signatory on cheque) came to ur branch.

On inquiry and on our insistence your officer on savings bank account counter checked the records on computer. To our shock that scanning of signature of my wife was left out. And therefore service branch had no choice but to return the cheque.

 

Sir, Let me accept that anyone can make mistakes. But

  1. Centralising does not mean becoming inhuman/ impersonal / non service oriented. There should be a person/s who should check with concerned branch/ client before taking a drastic step like bouncing a cheque.
  2. Whatever manpower cost the liaison / good relation / service too customer must be given as we are operating thru bank our transactions for such services.
  3. WE go to a good and reliable bank, keep relation with bank for decades , pay so many service charges that they will provide us umbrella and help us in keeping our good name high but due to to this act rather bank has tarnished our name.
  4. It is basic decency and ethics that small cheques of taxes, telephone, electricity, salary or school fees be returned only after taking all steps to avoid serious complications which it can have on your client. Or what is a meaning of client relationships? Specially of a client whose cheques have never bounced in 30 years.
  5. On one hand all banks unthinkably and indiscriminately issue credit cards and give credit to even non deserving but to account holders  of long time and good standing are not extended even credit of Rs. 2500 or not even a phone is made?

Therefore, Sir, like on all our mistakes you put charges then have single standard and pay happily charges and penalty of Rs. 1 lac for your mistake on following counts:

  1. Not updating our specimen signature and not scanning them correctly.
  2. Bouncing cheque on no fault of ours. And thus causing us harassment, anxiety and worries besides giving us bad name.
  3.  Not contacting before bouncing.
  4.  Bouncing small value cheque of old and esteemed client where whole joint family has account and fixed deposits.
  5.  Bouncing cheque issued to government there by govt. can auction whole property or atleast give legal notice to us causing anxiety? As such the B.M.C. officials immediately served upon us notice creating panic. I was away at Jaipur and my staff had to take instruction on STD calls and rush cash to BMC.
  6. BMC has levied penalty on us which we had to pay along with payment.
  7. For damaging our high reputation by wrongfully bouncing the cheque.
  8. You have charged cheque bouncing charges inspite of no fault of ours.
  9. For not attending on phone, refusing to listen to my office boy and therefore forcing us to visit your branch leaving our chorus and important work.
  10. All your stationary or of service branch don’t bear any address, tel no or email id causing us further inconvenience to hunt for same.

 

Therefore I hereby call upon you to suitably compensate me but with minimum Rs. 1 lac.

Pl. note I will use this compensation amount for my activities for senior citizens and helping poor in medical emergencies. But I am tired of paying charges inspite of bad service and bad behavior and taking things helplessly,

Alok's Jihad against Judicial system of India: There are coaching for all but not for new litigants, there are forums for all sufferers but for litigants , no counseling, no one to advise on court procedures, no reception/conference/ waiting room at courts for them ( litigants have keep standing in lobby n passages where even chairs are not available, they have to run for buying court fee stamp, Xeroxing , gum stick ( no single window stall to provide all this ,they have to keep searching for advocates attending different court rooms, no reservation in court canteen ( I was once asked to vacate chair in canteen as during lunch break canteen is reserved for Advocates) , no car park for litigants,no library for litigants, no system to get advance intimation that court will not sit today so you reach court and return as court is not sitting ( even clerk of ur adv. will not send u SMS and help save ur time and travel), every small paper/ application to be filed before Hon. Judge wasting his precious time,(filing/ adjournments can be done before asst. registrars), most Advocates yet don’t use PC’s , courier services and emails ( are we in 2008 or 1908??) and many more issues,
