Re: [eyegw] Re: Let's fight back!!!

Ripple effects exist everywhere in this company. It only takes one lawsuit to
take the Musa boys down in a big way. Why? Because in this company what they
have done to one employee they have done to many.

For example, the state of Florida is investigating right now if Eye Glass World
abused the independent contractor status of its doctors. There are a set of 20
criteria that must be met to call someone an independent contractor. Nearly all
of them have to be met otherwise the doctors are employees.

When the Musas set doctors schedules, schedule patients from their home office
in southern Florida, when they collect all the doctors fees and don't allow the
doctors to collect their own fees they are violating not just one but many of
the criteria that make someone an independent contractor. if the state of
Florida is successful in determining that doctors were employees and not
contractors the musas would be responsible for a large amount of back taxes and
penalties.

I know of people that have met with the states attornies recently; this is
closer to frutition than anyone could imagine.

Can you prove that? I mean really prove it? Cause if you can? You
would fall under the "whistle blower" law that forbids that from
happening. Unfortunately the law also requires that you file within a
certain amount of time. That amount of time is different for every
state.

By filing I mean make your grievance known. You have to file a formal
complaint, to the right department, within a certain period of time
to lay claim of letting you go under your protected rights. In CA
that amount of time is 90 days. Like I said...That time amount only
applies to CA.

If it has been more then a year, then I can tell you that your
statute of limitations has already expired. I don't know what will
happen once they decide about my Hubby. It may cause of chain
reaction of an audit of all employees records. Several lawyers have
already made it clear that on paper it looks highly suspicious. It
will be up to a Judge to decide. If a Judge finds in our favor, we
were told it would have a ripple effect.

Good Luck
