Once again, a group of tobacco-friendly legislators is trying to weaken Delaware's smokefree workplace legislation. They are blaming Delaware's weak economy on its smokefree workplace law. The bill they have introduced, House Bill 15, would re-allow smoking in bars and casinos. The Delaware Restaurant Association has joined health groups in condemning House Bill 15 stating that any exemptions to Delaware's original smokefree workplace law would create an unlevel playing field where some businesses would have a competitive advantage (real or perceived) over others.
There is no data to suggest that Delaware's bars and casinos are experiencing any worse impact from the bad economy than bars and casinos in states where smoking is still permitted. Nevertheless, tobacco interests are using the bad economy as an opportunity to try to repeal worker protection from secondhand smoke... and the threat is serious.
Tobacco smoke either causes cancer or it doesn't. If it does (which even Philip Morris now agrees), then ALL workers deserve equal protection from it.
