Suffolk Legislator Attempts to Divert Attention from Smokefree Workplace Legislation
 
Two worthwhile bills have been introduced in the Suffolk County legislature concerning tobacco smoke pollution.  One bill would provide a smokefree workplace for all Suffolk County workers.  The other bill would prohibit smoking in cars when children under the age of 13 are present.  SmokeFree Educational Services supports both bills, but recognizes that they are significantly different and will be addressed by the legislature at different times.  Smokefree workplace legislation will be voted on next week (December 5).  Smokefree car legislation has not yet had a hearing or been put to a vote. 
 
Suffolk County legislator Allan Binder has always opposed smokefree workplace legislation.  Several years ago, when he was chair of the health committee, he voted against smokefree legislation for Suffolk County restaurant workers.  This year, he is opposing smokefree legislation for Suffolk County bar and nightclub workers. 
 
In Mr. Binder's mind, he thinks he can defeat smokefree workplace legislation by introducing a bill to prohibit smoking in cars when children under 13 are present.  Apparently Mr. Binder thinks he can paint his colleagues as being hypocritical for passing one bill without passing the other, and thus get them to do nothing.  The funny thing is that Legislator Binder would probably vote against his own smokefree car bill if it ever came to a vote.
 
Besides acting like a spoiled child, Mr. Binder is trying to use the oldest trick in the book to defeat a worthwhile smokefree workplace proposal-- divert attention from the real issue, the right to a safe, smokefree workplace.
 
As one smokefree advocate wrote back to Mr. Binder, "Your attempt to turn tables is a distasteful and ineffective diversionary ploy that leaves my concerns unanswered. It addresses another piece of legislation and says nothing about your position on protecting Suffolk's workers from second-hand smoke."

(Try to ignore four mistakes/typos in Mr. Binder's letter:  1. His first sentence talks about a "proposed smoking ban in restaurants."  Suffolk's smokefree proposal deals with all workplaces, not just restaurants.   2. In the fifth paragraph, "a" should be "at."   3. In the sixth paragraph, "there" should be "their."   4. In the sixth paragraph, "than" should be "then."  Typos are easy to forgive, but the deceitful campaign that Mr. Binder is running is not.)

To all those who have written me on the proposed smoking ban in restaurants:

Thank you for writing me, urging me to vote for the smoking ban.  I appreciate your input and assume that you have been contacted by the Cancer Society, Heart Association, or the Lung Association and asked to write me on this matter.

You should know that I have recently filed a resolution, Intro. Res. 2081, which would ban smoking in vehicles with children under 13 years old.  It is my feeling that children who cannot speak for themselves need the protection of government from second hand smoke.

Currently, New York State law provides that a person can be fined for not buckling their child into a car seat.  Of course this is necessary because government must compel adults to protect children, for the children's sake.

You might also be interested to know that all three groups, the Cancer Society, Heart Association, and the Lung Association, had nothing to say a recent hearing at the Legislature, though they were sitting in the audience.  When they came up to speak on other legislation, they were questioned and let us know they didn't want to support legislation protecting the children.

There feeble excuses were: privacy issues (than why is there no issue on the law to put our children in child seats?); no statistical data to show the law would work (but, William Stoner stated during questioning from me that they would have supported a Suffolk County restaurant ban if we were the first in the nation and there was not statistical data!); and they felt it would be good enough if we just educated parents about the harm they are doing to their child (the weakness of this argument does not have to be elaborated on).

I would appreciate your support to protect the children in cars and your letting the about three groups know if you agree that their position on my legislation destroys their credibility on all smoking issues.
