Pot Dispensaries Appeal Order To Turn Over Client Names

Five medical marijuana dispensaries in Dana Point are appealing an Orange County Superior Court ruling ordering them to turn over records -- including client lists -- to the city as part of an investigation into dispensary operations.

"I think everyone kind of had the same idea about appealing the order for the reason of protecting third-party names and some of the privileged items that we believe shouldn't be disclosed," attorney Lee Petros, representing the Point Alternative Care dispensary, told the Orange County Register.

All five pot dispensaries in Dana Point must hand over their records to the city by Dec. 7, according to a ruling by Judge Glenda Sanders. Sanders also ordered the disclosure of member names to be limited to city attorneys, a financial consultant retained for advice in the investigation, and the assistant city manager, "who will oversee and assist the consultant in his analysis," according to the Register.

Bruce Mirken of the Marijuana Policy Project hopes the appeal succeeds. "For city officials to be allowed to receive confidential medical information for what appears to be a fishing expedition would be an extremely dangerous precedent," Mirken told SF Weekly. "It would be nice if patients could have complete trust in their local officials, but they don't, and for good reason."

Lawyers for the marijuana dispensaries have strenuously objected to releasing member names, saying that the city's request violates medical and financial privacy rights of members, the Fifth Amendment's protection against self-incrimination, and the First Amendment protection of freedom of association.

The dispensaries, while appealing Sanders' decision to the 4th District Court of Appeals, are also asking the judge to stay her order pending the outcome of the appeal.

Attorneys for the city and for the dispensaries will be in Sanders' courtroom in Santa Ana on Monday, when the judge is expected to rule on whether to set a hearing date before the Dec. 7 deadline to consider staying her order.

Attorneys have said there's no legal precedent for the Dana Point case. Both the city of Dana Point and the marijuana dispensaries seem to be floating through uncharted legal territory.

The city claims it needs the names of patients to verify whether the dispensaries are operating within the law. However, there's little or no legal guidance regarding the release of patient names from pot dispensaries.

Attorney Petros said he's concerned that even the limited release of patient names won't stop the city from returning to court, seeking to broaden the use of patient names and records.

And Alison Adams, attorney for a dispensary called Holistic Health, said she was concerned that the city would turn around and use the names in order to prosecute future cases against individuals. "I am now horrified that [the city] may attempt to use this information to put a frontal attack on medical marijuana," Adams said during court proceedings. "Producing any names is...overboard."

CORPUS CHRISTI  Police on Wednesday gave CPR to a man after an officer
used a Taser to subdue him during an incident on Wooldridge Road.

Police Chief Troy Riggs said the man was surviving late Wednesday. He
was taken to Christus Spohn Hospital Memorial, but Riggs didnt know the
mans condition.

Riggs said many details of the incident still were being investigated
but it began at 6:54 p.m. when an officer on patrol saw drivers flashing
their headlights at Cimarron Boulevard and Airline Road.

Riggs said the officer discovered a bicyclist who was westbound in the
eastbound lane on Wooldridge near Airline. When the officer approached
the cyclist, the man became verbally abusive, Riggs said.

The cyclist then rode to a nearby restaurant in a shopping center where
the officer again stopped him and tried to pat the man down. The man
resisted, Riggs said, and a confrontation began. Thats when the officer
called for backup.

The officer who first confronted the man used pepper spray, but it
didnt subdue the man, Riggs said. The chief said the officer then used
a Taser. He said he didnt know where the Taser struck the man, who
police believe to be in his 50s.

Officers cuffed the man and realized he wasnt

responsive and began CPR and called an ambulance, Riggs said.

In all, five Corpus Christi police officers responded. Riggs said a
CCISD police officer also was on scene. The city officer who used the
Taser has been put on administrative leave, which is standard procedure
during the investigation, Riggs said.

Riggs didnt release the name of the officer late Wednesday.

Last month, Taser International advised police agencies across the
nation not to shoot its stun guns at a suspects chest.

The Associated Press reported that the Arizona-based company says such
action poses a risk, albeit extremely low, of what it called an adverse
cardiac event.

The advisory, issued in an Oct. 12 training bulletin, marked the first
time that Taser has suggested there is any risk of a cardiac arrest
related to the use of its 50,000-volt stun guns, the AP reported.

Taser officials have said the bulletin does not state that Tasers can
cause cardiac arrest. They said the advisory means only that
law-enforcement agencies can avoid controversy if their officers aim at
areas other than the chest.

AMA Calls For Ending The “Schedule I Lie”

The Schedule I federal classification of cannabis — which states that, by law, the marijuana plant and its natural compounds have “no currently accepted medical use in treatment in the United States” — has long since passed the point of farcical. Nevertheless, defenders of the so-called “Schedule I lie” have possessed, for nearly 30 years, one prestigious ally that they could always rely on to endorse their absurd position: the American Medical Association.
Not anymore!
Today the AMA voted to reverse its longstanding endorsement of cannabis’ Schedule I prohibitive status. The vote took place during the organization’s annual Interim Meeting of the House of Delegates in Houston, Texas, and marks the first time that the AMA has revisited its position on cannabis in eight years.
As newly amended, the AMA’s official position (see specifically pages 12, 13, and 14) regarding the medical use of cannabis no longer “recommends that marijuana be retained in Schedule I of the Controlled Substances Act.” Rather, the Association now resolves “that marijuana’s status as a federal Schedule I controlled substance be reviewed with the goal of facilitating the conduct of clinical research and development of cannabinoid-based medicines.”
The AMA also today demolished long-held pot prohibitionist claim — frequently publicized by the White House Office of National Drug Control Policy and others — that “no sound scientific studies have supported medical use of smoked marijuana for treatment in the United States, and no animal or human data support the safety or efficacy of smoked marijuana for general medical use.” To the contrary, the AMA has adopted a report drafted by its Council on Science and Public Health (CSAPH) entitled, “Use of Cannabis for Medicinal Purposes,” which states, “Results of short term controlled trials indicate that smoked cannabis reduces neuropathic pain, improves appetite and caloric intake especially in patients with reduced muscle mass, and may relieve spasticity and pain in patients with multiple sclerosis.”
Now that the AMA has finally acknowledged reality, is anyone else wondering if David Evans (or the DEA) will finally update their talking points?

“The response has been overwhelming,” says Madeline Martinez, Executive Director of Oregon NORML. “We are excited to be able to provide a safe place for patients to medicate that is out of public view within the guidelines of the Oregon Medical Marijuana Act (OMMA).”

Martinez appeared on OPB’s Think Out Loud talk show and attended the local neighborhood association meeting to reassure the public that the café will be operated at the highest of standards and strives to be a positive addition to the area.

American Medical Association Reverses Position, Calls For Review of Medical Pot

For years, one of the main arrows in the quiver of anti-pot zealots in arguing against medical marijuana (along with the federal pot prohibition, recently blunted by the Obama Administration) has been "But the American Medical Association says pot has no medical value." As of today, that's no longer true.

In a move considered historic by supporters of medical marijuana, the AMA voted today to reverse its long-held position that marijuana should continue to be classified under federal law as a Schedule I substance with no medical value. The organization, which is the largest physician-based group in the United States, adopted a report, "Use of Cannabis for Medicinal Purposes," drafted by the AMA Council on Science and Public Health (CSAPH), which affirms the therapeutic benefits of medical marijuana and calls for further research.

The CSAPH report concludes that "short term controlled trials indicate that smoked cannabis reduces neuropathic pain, improves appetite and caloric intake especially in patients with reduced muscle mass, and may relieve spasticity and pain in patients with multiple sclerosis."

And in a move that could eventually have enormous public policy repercussions, the physicians' group urges that "the Schedule I status of marijuana be reviewed with the goal of facilitating clinical research and development of cannabinoid-based medicines, and alternate delivery methods."

This striking change of position was, according to the medical marijuana advocacy group Americans for Safe Access (ASA), partly put into motion by a resolution adopted in June 2008 by the Medical Student Section of the AMA in support of the reclassification of marijuana's Schedule I status.

The last AMA position, adopted in 2001, had maintained a hard-line anti-pot stance, calling for maintaining marijuana as a Schedule I substance with no medical value.

However, the AMA had lobbied against making marijuana illegal to begin with back in 1937. Dr. William C. Woodward of the AMA offered eloquent written testimony pointing out that "the medicinal use of cannabis has not caused and is not causing addiction" and that "the prevention of the use of the drug for medicinal purposes can accomplish no good end whatsoever."

​ "It's been 72 years since the AMA has officially recognized that marijuana has both already-demonstrated and future-promising medical utility," said Dr. Sunil Aggarwal, the medical student who spearheaded the passage of the 2008 resolution by the MSS and was also one of the CSAPH report's expert reviewers.

"This shift, coming from what has historically been America's most cautious and conservative major medical organization, is historic," said Aaron Houston, director of government relations for the Marijuana Policy Project. "Marijuana's Schedule I status is not just scientifically untenable, given the wealth of recent data showing it to be both safe and effective for chronic pain and other conditions, but it's been a major obstacle to needed research."

Other drugs listed in Schedule I, which are deemed to have no accepted medical uses and to be unsafe for use even under medical supervision, include heroin, LSD, and PCP.

Drugs listed in the less restrictive Schedule II, for which medical use is permitted with strict controls, include cocaine, morphine, and methamphetamine. Marinol, a pill containing THC, a component responsible for marijuana's "high," is classed in Schedule III; its looser requirements allow phoned-in prescriptions.

The AMA's about-face on medical marijuana follows an October announcement by the Obama Administration discouraging federal attorneys from taking enforcement actions against medical marijuana patients and providers in states where they are operating legally.

In February 2008, the second largest physicians' group in the United States, the American College of Physicians (ACP), adopted a resolution (PDF) calling for an "evidence-based review of marijuana's status as a Schedule I controlled substance to determine whether it should be reclassified to a different schedule."

"The two largest physician groups in the U.S. have established medical marijuana as a health care issue that must be addressed," said Caren Woodson, government affairs director at ASA. "Both organizations have underscored the need for change by placing patients above politics."
