DCF Fabricate Neglect Charges Against Santa for Child Neglect.
Hartford, CT - According to sources at the I.N.S., Santa Claus ("Mr. Claus")
will be deported to the North Pole for being an illegal alien. Santa is being
held at an undisclosed location to have other formal charges brought against him
by other federal and state agencies. Christmas will have to go on without Mr.
Claus.
Department of Children and Family ("DCF") will also be conducting a formal
investigation on Mr. Claus for allegedly playing with elves and neglecting
children. Mr. Claus told us "off-the-record" that the elves were actually
hundreds of years old but he liked jerking DCF around because they harm so many
children and lie about it.
Santa stated, "it's easy to spot a DCF worker's house, it's the one with the
giant fat ass imprint in the sofa and you'll see stickers of skull and
crossbones on the side of thier car indicating how many families they have
distroyed". He also allows all the reindeers do their business on their homes.
Santa stated, "these workers care more about their bonuses then children's
happiness". Santa also said, "DCF has been after him for years" and that "the
charges were fabricated by DCF as most charges are." According to Mr. Claus's
attorneys Duey, Cheatim and Howe, " Mr. Claus does not live in Connecticut, DCF
lacks all jurisdiction in the matter."
Santa did give a clue on where DCF workers come from when asked. He said when
the aliens crashed in Roswell, NM, several survived and mated with the
Waterbuffalo and the rest is history. We told Santa that was tastless and he
said, "not with the right Bar-B-Que sauce".
DCF spokesman, Mr. Cleblack said, "that the list Santa uses on who is naughty
and nice harms children". Spokes person for Santa responded stating, "we must
hold everyone accountable for thier bad behavior and bad behavior should never
be rewarded" and, "DCF should take a look at themselves, they harm more children
then all the parents put together". DCF approves of bad behavior and rewards
it.
Santa will also be formally charged of having in his possession reindeer of the
flying variety which are very rare and not having the proper permitting. He
will also be charged with circumventing customs with merchandise he failed to
claim and failing to have the reindeer immunized and not having the proper tags
in accordance with livestock statutes.
There will also be charges brought by the FAA for failing to have the proper
clearances to fly into U.S. airspace and failing to file a proper flight plan.
He will also be charged with landing illegally on residential roofs not approved
by the FAA.
Santa will also have one charge of using a flashing red light on a reindeer
without a red-light permit as required by law. The humane society will be
looking into the use of lights on animals.
Santa has been using multiple names and aliases to stay ahead of DCF.

DCF is Denying Children Their Right To Celebrate Christmas

Hartford, CT - DCF has intentually denied both parents and children in
fostercare to engage in their protected 1st Amendment right to celebrate the
holidays with their siblings and parents.
DCF has even gone to the extent to tell fostercare providers if they get
presents not to give them to the children for which they are intended. Like in
Harry Potter under the staircase, the child never gets that letter or presents
and the child is left feeling alone and abandoned at the hands of DCF. The
foster care system is just a cover name for the incarceration of children. DCF
may as well put ankle bracelets on all the foster children. Even enemies in the
time of war on the battle field would stop to celebrate Christmas.
DCF has even placed children in non-Christian homes who do not celebrate
Christmas who then denies the child the right to celebrate their religious
beliefs. This also applies to children of other faiths like the Jewish
holidays. One of the requisite requirements to being a DCF worker is that you
must be cold as ice and heartless like the DCF commissioner.
DCF has stripped these innocent children of their mothers, fathers, siblings and
even their pet puppies as well as the spirit of Christmas.
How would you feel if DCF did this to you and locked you up in some abusive
fostercare system and as you cry yourself to sleep wondering when your mommy and
daddy was coming to get you and DCF refuses to listen to you when you tell them
you were never abused and the worker had lied. This goes on thousands of time
every year.
I hope everyone can live with themselves as they have a jolly holiday and
remember some child is shivering in the darkness as we speak.

This is the presiding Juvenile Court Judge in OKC. in the same Juvenile Court
where the 2007 ABA report cited a lack of due process for parents and lack of
legal representation for children, yet that report was buried. So it is very
likely these could have been litigants in a Juvenile case that were jailed.
Now it is even more apparent that people like Dana Lawhon and others have been
illegally held and denied their Constitutional Rights. But this article also
gives hope, it shows bad judges can be exposed and overturned, make this
information as public as possible to show others the truth.
There's something else to note here. This information was provided by former
OKC. Special Judge Michael Chionopoulos who is now in Fl. but still has interest
and concern for his Ok. home. Please consider commenting at the former Judge's
blog and thank him for this info since our local media has ignored it. The
former Judge suffered a great loss to our court system as many of us have, and
when he left this state the people suffered a great loss also.

Oklahoma Judge Richard Kirby Overturned - but Two had already Suffered
Unconstitutional Jail Sentences at the hands of his honor
The Oklahoma Supreme Court overturned Associate Judge Richard Kirby, who jailed
two litigants for Direct Contempt of Court, holding that the litigants'
constitutional rights were violated by Judge Richard Kirby (see In Re J.H., 2008
OK 104). While the Court of Civil Appeals upheld Judge Richard Kirby in his
Direct Contempt of the two litigants, the Oklahoma Supreme Court opted to
actually apply the Constitution. The Supreme Court was concerned with those
pesky little things called CONSTITUTIONAL RIGHTS! You know, like oversight by
Judge Richard Kirby of the right to due process - both substantive and
procedural - the right to counsel when one is at risk to lose liberty/freedom
etc. As it turns out, Judge Richard Kirby denied the litigants due process by
charging them with "direct contempt of court" - as opposed to the proper charge
Judge Richard Kirby could have brought, if there was one, of "indirect contempt
of court." While there is a well-reasoned
dissent supporting Judge Richard Kirby's decision, ultimately the Supreme Court
reversed in a 7 to 2 decision mandating that all litigants in future such
contempt proceedings be given the fundamental rights to notice, adequate time
for preparing a defense, a jury trial (if demanded) etc. Unfortunately for the
two litigants involved, the Supreme Court's ruling is of little consequence -
they had long since served the unconstitutional sentences, improvidently doled
out by Judge Richard Kirby, in the Oklahoma County Jail prior to the appeal.
Someone had to pay the tuition cost for Judge Richard Kirby's constitutional
education. It is just sad that two people had to suffer an unconstitutional jail
sentence to pay for Judge Richard Kirby's eduction in the fundamental legal
principles on which this nation was founded! Unlike the student loan program,
there is no way Judge Richard Kirby can repay the debt to the litigants who paid
dearly for his education by
serving jail time. Merry Christmas to those who were wrongly jailed at the
hands of his honor.

A COURT DETERMINES THAT A CAUSE OF ACTION FOR PARENTAL ALIENATION EXISTS
Relatives Are Not Protected By DCF or the State From Lawsuits
In a recent trial court opinion issued by the Superior Court in Hudson County,
Judge Gallipoli recognized that parents in NJ may have a right to collect
damages for intentional infliction of emotional distress when their
relationships with their children are poisoned by former spouses or even
grandparents who partake in alienating behaviors.
In a November 21, 2008 trial court decision, the court recognized the right of
one parent to sue another, as well as grandparents, for what is known as the
intentional infliction of emotional distress. In this particular case, the
father sued the mother and maternal grandparents because they had alleged that
the father sexually abused the children. The suit alleges that the ex-wife and
her parents began alienating the children from the father during the pre-divorce
separation in 2006. The defendants allegedly told the children, court-appointed
psychiatrists and law enforcement officials that the father was a sex addict and
had molested the children in the past, the suit says. It also says the children
are afraid to sleep at their father's home because they have been told they are
in danger of being sexually abused.
The wife and her parents denied the allegations and argued in motions to dismiss
the suit for failure to state a claim that the Heart Balm Act had eliminated the
cause of action of alienation of affection. They argued that the term
"alienating the children" is what the complaint calls the alleged wrong. Judge
Gallipoli found that this claim was not a disguised claim for alienation of
affections, which was banned in the state in 1935 by what is referred to as the
Heart Balm Act.
This is the first time that a NJ Court has recognized the ability to bring such
a claim. A prior suit was filed in the Morris County Superior Court but
dismissed by Judge Rand on the grounds that the suit was nothing more than a
disguised claim for alienation of affections. Noting Judge Rand's opinion in
his own, Judge Gallipoli respectfully disagreed with Judge Rand's interpretation
of the decisional law in this state and found that a claim existed for these
types of behaviors. Since they are both trial court judges, Judge Rand's
opinion was not binding upon Judge Gallipoli. Judge Gallipoli noted that the
father would have to file an application in the family part seeking relief,
however his claims against the maternal grandparents would proceed in the law
division.
The real question remains as to how the Appellate Division and perhaps even the
state Supreme Court will view claims such as these.
EDITOR'S NOTE: It seems contrary to notions of judicial economy, mandatory
joiner and the entire controversy doctrine that the claims against the mother
and her parents would be handled in separate venues. In addition, while there is
precedent to bring tort actions related to a divorce in the family part, a party
may have a right to a jury on these issues and the cases are often severed and
sent back to the law division anyway.
The bigger question is how a court should handle these claims in a post-judgment
situation where there is not an ongoing matter and ultimate trial date pending.
While court's can order plenary hearings post-judgment, it seems that when these
issues arise post judgment, the better place for them may be in the law
division.
Also, the theory here that makes the claim viable is not that there has been an
alienation of affections, but that a person's intentional act has harmed
another, where the only possible remedy for same may be money. ERIC S.

It is about time. I went through a divorce and one of my two children are
alienated. This issue was raised before several judges in Essex county and also
in Hudson County.
My ex, is a professor at NYU, and got preferential treatment before Judge
Zampino, of Essex County, and also befor Judge Segluizzo of Hudson County when
the action was transfered.
There is no doubt that this type of behavior is encouraged by members of the
legal profession and sometimes the judiciary.
The suggested solution is to allow an action against both other than a complaint
to the committee on judicial conduct, or the bar ethics panel.
It is a good start to a long overdue problem. the issue of PAS (parental
alienation syndrome has been around for a while, but is not always recognized.
Several US supreme court justices have recognized that at least 1/2 of all
non-custodial parents are alienated from their children within three years. At
least one large study by Sanford Bravor that was government funded determined
that the single most important factor related to a non-custodial parent
maintaining a relationship with his/her children is the custodial parent!!

Agreed, most people don't find out their rights until it is way too late.
Agreed we have to get the word out. Okay, now how do we do this? We don't have
the money to run TV or radio announcements to counter a "TV sage" like Dr. Phil,
for instance. Here's a thought. I once lived in a part of the country where the
female VICTIMS of domestic violence were routinely being arrested along with (or
in many cases instead of) their perpetrator. The twisted feminazi logic was
that if you arrest the victim you can get them into "treatment" so they'll leave
their batterer. Anyway, there were volunteers who came into the jails to
council these women, most of whom couldn't afford a lawyer. Could we council
new mothers the same way, or at least pass out literature? Since most hospitals
aren't public, is there a way we could convince them to let us do that?

Today, DCF now charges the alleged victim (the mother) with neglect of the child
because she allegedly allowed the father to commit domestic violence in the view
of the child. This distorted view DCF has of alleged harm or maltreatment of a
child is in total opposition to the medical experts from Yale New Haven Hospital
in the class-action suit in Nicholson v. Williams, 2nd Circuit. Child
protection lost and US District Judge Weinstein ordered child protection to stop
abusing children by the act of removal in domestic violence cases. Witnessing
domestic violence is not maltreatment or harm to a child.
By DCF saying that the mother caused or allowed the domestic violence to happen,
that's kin to saying a rape victim caused her own rape because of the inaction
of the victim. DCF and its employees are the most abusive sadistic arm of the
state that has ever been unleashed onto the public in modern history.

Connecticut: DCF Hearing Reveals Social Worker Cruelty and Family Destruction
A hearing on December 18, 2008 informed Connecticut state legislators of DCF
injustice and cruelty to families. One participant, an out-of-state aunt, told
legislators that family members were denied kinship care rights because the
court ruled they had no bond with the child, a girl now totally separated from
her natural family. Many others came forward to tell legislators their stories
of injustice, trauma and distress at the hands of DCF caseworkers.
According to the article written by Arielle Levin Becker, State Representative
Toni Walker, a Democrat from New Haven, wept and said, “We as a state have
failed miserably in this situation.” One hundred and thirty eight people
signed up to testify at this hearing, the last hearing of four, and apparently
the only hearing allowing the public to testify. People spoke out about rude DCF
social workers and unjust family devastation practices.
The hearings were scheduled in response to the death of an infant in foster care
last May.

Dana Lawhon from the OKFAMRA group has been arrested and has a hearing at 8 a.m.
If anyone could be there it would help, there's less chance of anything being
done improperly if witnesses are present. It would also help Dana handle this if
she didn't feel completely alone.
I believe she was picked up on the 3rd. and she's being held without bail. It's
my understanding Dana's accuser is Antiffany McDaniel-Fears who is a DHS
employee involved in Dana's daughter's case. Dana exposed this person for having
a felony arrest record. Shortly after that this person's court docket regarding
the case,(pending since 1999??, with a warrant??) noted an entry stating the
case was "Administrativly reassigned" by the AOC. Which raises the question of
how it could be pending for 7 yrs?, how can a criminal felony be turned into an
administrative issue?, is this more proof of background checks not being done at
DHS?, how many other persons with criminal records are working at DHS?, and what
about her credibility as a witness against Dana or in the DHS cases she's
handled?
Some of you might also remember Dana's video news interview when she produced a
clean drug test her daughter had passed that was presented in court at the same
time DHS was presenting a "failed" or "misrepresented" one. Dana has fought hard
to help her daughter and save her grand baby from the horrors of our foster care
system. And in the course of doing so she has lost her job and suffered other
apparent retaliation like the charge of supposedly threatening the DHS worker,
(A.McDaniel-Fears) and also a charge of violating a protective order, (same DHS
worker) on 01/01/2008 When the P.O. wasn't even filed until 09/30/2008. I have
included case numbers below for reference.
I'm in Tulsa and unable to travel at this time, I hope someone in the OKC.
area will be able to make it there, the hearing will be in Judge Russell Hall's
court.(there is also a hearing on the VPO 12/17/2008, same judge).

Alec Baldwin and Kim Basinger's cutthroat custody battle over their
12-year-old daughter, Ireland, has made international headlines for years. The
couple divorced in 2002 after nine years of marriage, but the vicious
accusations on both sides continued, culminating in the infamous 2007 voice-mail
message in which Baldwin berated his daughter.
In an interview with ABC News anchor Diane Sawyer, Baldwin, 50, spoke
about his lengthy court struggles with Basinger, 54, and said that when the
voice mail was released, it brought him to the brink of suicide.

"I used to pray to God every night. I would get in bed, and I would say,
please, don't let me wake up in the morning," Baldwin said. "I began to think

Fragmentation of families is damaging to Oklahoma

The ripple effects of family fragmentation are costing Oklahoma taxpayers
millions of dollars each year and the problem may only get larger, officials
warned state lawmakers this week.
Members of the House Human Services committee heard from a wide range of experts
and agency leaders during a legislative study requested by state Rep. Mark
McCullough, who said the state needs to change the way it deals with family
issues.
“When it comes to the problem of family disintegration, we are like a deer in
the headlights,” said McCullough, R-Sapulpa. “Everyone is affected by the issue,
but we’re afraid to address it because we know none of us is perfect.
Unfortunately, that allows the problem to grow and the price tag keeps
expanding. It’s time we put more effort into enacting policies that support
marriages and help families both survive and thrive.”
McCullough noted lawmakers were “very fortunate” to hear from several national
experts and state agency heads as part of the study.
Dr. Jeff Frey, chairman of the Marriage Co-Mission, noted that the national
divorce rate has hovered around the 50 percent mark for about 20 years and that
the marriage rate has plunged 48 percent since 1970.
In 1960, he noted that just 5 percent of all births were to unwed mothers but
that figure grew to 36 percent by 2000 – a 700 percent increase.
Today, 33 percent of American children live away from their fathers and 40
percent of those kids never see their fathers in a typical year.
Those trends have a huge impact on both society and government. Frey and other
officials noted that children from broken homes are seven times more likely to
live in poverty, three times as likely to be expelled from school and achieve
lower grades, and 12 times more likely to be incarcerated.
Children from broken homes also tend to have poorer emotional and physical
health, which is further complicated by the fact that many uninsured children
are from single-parent homes.
Research indicates that the resulting taxpayer cost of divorce (largely through
public assistance programs) now stands at $112 billion per year nationally and
$430 million annually in Oklahoma – and those are conservative estimates.
Frey noted the “script of marriage” has been lost in large segments of the
culture and the issue is now one of “know-how.” Frey has identified seven key
factors that influence the health of marriage in America: corporate, media,
church, community mobilization, education, youth, law and/or government.
Mike Jestes, director of the Oklahoma Family Policy Council, noted the state of
Oklahoma would be better off spending money “on the front end” to preserve
marriages than on the back end to “clean up” the problems created by family
fragmentation.
For example, he noted state spending on the criminal justice system has grown
510 percent since 1982 and that a large share of that problem is likely tied to
family fragmentation.
Jestes said that the faith community could play an augmented role in the
prevention of family fragmentation. In Oklahoma, he noted 74 percent of all
weddings occur in a church and that many couples call the church first when they
have problems.
Echoing the assessment of other experts, John Stanley, director of the Marriage
and Family Foundation, said for every $1 spent on keeping families together,
government spends $1000 on “clean up” from the fallout of broken families.
Stanley said publicity efforts could play a role, such as a 13-state media
campaign planned in the coming months that will promote positive messages for
troubled marriages. That campaign will include the Oklahoma market, he said.
Beyond the social benefits, relational-wellness initiatives could also have
positive impact in the workplace and Oklahoma economy.
Dr. Greg Smalley, the director of the Center for Relational Enrichment, noted
that the communication skills required to maintain a strong marriage also
transfer to the workplace, such as the ability to understand others and work
cooperatively.
Smalley has worked with many large corporations across the country to implement
state-of-the-art “Emotional Intelligence” programs that teach business leaders
how to constructively manage emotions in the workplace.
Officials noted the state of Oklahoma has been a leader in pro-marriage
initiatives and is already experiencing some success. For example, Kendy Cox, an
official with Public Strategies, noted the Oklahoma Marriage Initiative has
served 152,845 individuals to date. The OMI has also provided relationship
training for 15,000 students in grades 9-12.
State law allows couples who complete an OMI class to obtain a marriage license
for only $5. That incentive apparently is working since there has been a slow
but steady increase in the issuance of those discounted licenses since 2007.
McCullough noted there was “strong agreement” among the marriage and family
experts who spoke at the legislative study that “we now have very effective
tools for relationship management and crisis intervention.” He said the
challenge for policymakers is to increase access to those tools.
He also noted the “unanimous consent” among agency heads – a group including the
leaders of the Department of Human Service, Department of Corrections, Office of
Juvenile Affairs, and the Department of Mental Health and Substance Abuse
Services – that a better model for addressing family problems would require
“moving upstream” and intervening before the problem reached a crisis.
“While government cannot fix everything, it can do a lot more than we’re doing
today to help preserve families,” McCullough said.
Echoing Glenn Stanton with Focus on the Family, McCullough noted that “for too
long government’s role in marriage has been limited to issuing marriage licenses
and divorce decrees. I believe this study demonstrates that government has a
much larger stake in the health of our families than many people realized. We
have learned that there are policies and incentives that will have a positive
impact on marriages. And, given the price tag taxpayers pay because of family
fragmentation, we literally cannot afford to continue ignoring this issue.”

This article needs to be commented on. These legislators listed need to be made
aware of what's really going on in the Juvenile Courts. They need to be put on
notice about the corruption and illegal activities of the lawyers and judges
involved. Get confirmation of the contacts so that this can be brought up to
them at election time or in impeachment hearings. We had a task force in 2000,
the Juvenile Law Reform Committee, lawsuits, new laws like Kelsey's Law and the
Slate Act, and now the class action fraud and secret hearings hosted by Rep.
Morrissette, (no parents involved from what I hear) This is just more of the
same covering up and diversions to avoid placing any accountability on DHS or
the lawyers and judges responsible. And why will the legislature not have a full
financial audit of DHS and the Juvenile Court? Are they seeking to hide their
own financial interest? What about the judges who do not have to file financial
disclosures? If they
really cared about justice and children being abused and dying I think they
would have made a difference by now, don't you? Things have just gotten worse
since around 1999. All of those involved appear to be either incompetent at
best, and have failed the children and families of Oklahoma.

Panel finalizing children’s code overhaul suggestions

OKLAHOMA CITY – A committee made up of legislators, judges, social program
officials and advocates have set a deadline for the end of September to finalize
recommendations for an overhaul of the children and juvenile codes.
The focus was on the children’s code as members of the Children and Juvenile Law
Reform Committee went through each section of the law and discussed possible
changes to present to the Legislature for next session.
Judge Roger Stuart spoke about the work that had been done in the general
provisions section of the children’s code. He said funding was critical for the
system to work but said difficult situations were always going to occur
regardless of how great the system was crafted.
“The code is not a solution to child abuse and neglect,” Stuart said. “Bad
things can happen.”
Stuart said ultimately the goal of the changes to the code were to “protect
those who cannot protect themselves” by putting in procedures that best
accomplished that end.
State Rep. Kris Steele, R-Shawnee, and chairman of the committee, said the hope
is that the committee could put together five recommendations by the end of
September to present to legislators with an eventual goal of drafting a 800- to
1,000-page bill for next session.
He said it was important the committee proposed a bill that size without giving
legislators plenty of time to review the content.
“I am afraid we would be doomed from the get-go if we did it that way,” Steele
said.
Some of the changes will continue to be discussed by the children’s code
subcommittee for final drafting. The juvenile code will be addressed at the next
meeting on Friday.

The Democratic nomination of Barack Obama as the next President of
the United States is just afew days away!
To have the chance to represent local Democrats at the Democratic
National Convention is exhilarating and humbling. Highly thought-
provoking is another way of describing what I'm feeling in
preparation to do my best as a convention delegate.
We are witnessing an unprecedented transformation of American
politics, along with a realignment of the electorate in the quest for
the Presidency. The results of Nov. 4 will be a defining moment for
our nation.
Through this BLOG I plan to provide daily updates on a delegate's
role and other convention happenings. I recognize the value of this
opportunity to dialogue and work with Democrats from all walks of
life.
We all view the world though many lenses and individual experiences.
In my case, I'm a son,
husband, father, grandfather, proud of my family, university
graduate, a prideful American & patriot, proud of my ethnic heritage
and an elected state representative. Because of these motivations, I
am very passionate about serving our community and moving it forward.
Historian David McCullough eloquently observes in the following
passage about our nation's history, "The American experiment was from
its start an unfulfilled promise. There was much work to be done.
There were glaring flaws to correct, unfinished business to attend
to. Improvements and necessary adjustments to devise in order to keep
pace with the onrush of growth and change and expanding
opportunities."
From my perspective, this is why the 2008 Democratic National
Convention is so vitally important because it is an essential
component of the course of human events in our great nation. So

When I went to vote, the workers asked where was my wife, little did
they care for my comments. Out side, Turner and I reacquainted, Alex
and I sparred, and I noted Walling left his wife in the hot sun, no
shade and no water as he just stood bye...mine would never suffered
that.
It was a pleasure to see and talk with Dayne and Dale, stay involved,
you both are part of the new emerging leadership.
YOU ARE NOT GOING TO BELIEVE THIS-
This week I happened to be for some time in the County Court House in
a back hallway out side the Prosecutors office. This hallway has
benches for 20 people and leads into a referee hearing room and
waiting area seating 60. On the days when child protective proceeding
and juvenile matters are heard by 2 referee the hall way and waiting
area are crammed with parents, social workers and often young people.
There could be 80 people crammed in this area. Some will be standing
some sitting on the floor as all the seats are taken. Bags, coats
sweaters will be dropped on the floor. In ongoing child protective
matters often parents homes are inspected. Lack of proper hygiene,
filth of the home and insect infestation could be a reason that a
parent does not have a child returned to them. Insect infestation
would include a home infested with roaches those nasty little bugs.
Bugs that get on our children and our food spreading who knows what.
That back hall way and referee waiting area on the southeren end of
the genesee County Court House is infested with roaches...
a CITIZEN SITTING IN THE INFESTED AREA POINTED OUT THE 20 OR SO BUGS
THAT COULD BEE SEEN ON THE FLOOR. He inquired of 2 county employees
and found out that the County knows that the south end of the Court
House on the main floor is infested with roaches . This must also
include the prosecutors office.
What is being done about this and why has the public not been told.
Here is what is unbelievable. The state takes your children from you
because you have an unfit home. A good thing. You go to meetings
every 90 days to report on your progress in cleaning up your home.
The very place that you go , court ordered to go, is infested with
roaches who ride home with you on your clothing . They reinfect your
home, the cps worker violated you and you have to return to that
hallway,,,,, Call a county commissioner, congratulate them on their
primary victory, then ask what is being done about the roaches in the
court house. [trb]

The following is a true account of how Pre-Paid Legal helped a single
mother in her CPS investigation and case. Sadly, I did not have Pre-
Paid Legal when our case was open. However, our local CPS office has
been informed that we are PPL members. There has been no involvement

I would like to share with you how [my attorney] from [the Provider
Law Firm], in Maine gave me my life back!
I am a single mom of 3 boys and wanting to raise my own children I
started day care more than 20 years ago. I have been blessed with
caring for many children over the years, but I NEVER expected the
following to happen to me.
On Friday, November 10, 2006 I received a phone call late in the
afternoon from one of my day care moms telling me that her 11 year
old son had gone to the school counselor and told the counselor that
I had abused him, the other children in day care as well as my own 4
year old son and that the counselor had called the Dept. of Human
Services to report me for abuse. The mother told me that she didn't
believe what was being said but that the school made it very clear to
her that if she didn't pull her kids out of my day care immediately
then they could go at her for not protecting her children and she
didn't dare go against the school or her son! I was totally shocked
and panicked! I had cared for these children in my day care for 8
years and considered their mom one of my best friends.
The first thing I did was call my Provider Law Firm. Unfortunately,
that Friday was a national holiday [Veteran's Day] and it was already
4:55 pm so any attorneys that had been in the office were gone but
the gentleman who took my information told me that an e-mail would be
sent to the attorneys and I would be sure to receive a phone call
first thing Monday morning. My heart was in my throat. I had no idea
how I would get through an entire weekend with this dark cloud over
my head. This is where Pre-Paid Legal rises above any other law firm

With in an hour or so of my call to the provider firm, I received a

attorney] spent over 30 minutes on the phone with me bringing me from
hysterical to reassured. He wasn't even going to be the attorney
taking my case but he wanted to call and let me know they were there
for me! Attorneys out side of Pre-Paid Legal don't do that for their
clients.
First thing Monday morning, [my attorney] called me and went over
everything and again reassured me that I would be given the best
service. I felt like my world was spinning out of control and [she]
stepped in and took the wheel and regained control for me.
The state investigation lasted 3 months! Not only did they look at me
as a day care provider but as a mother as well. My two oldest boys
are grown and in college, but my youngest is only 4 years old and I'm
raising him 100% on my own. My biggest fear was that the state would
knock on my door and take him away from me pending this
investigation. I was constantly looking over my shoulder, I was
unable to sleep well and my stress level was through the roof. When I
shared this with [my attorney] her reply was, I want you to sleep and
let me stay up and worry about this, that's my job. And you know
what?? When I found myself worrying, I would remember her words and I
would remember her words and I would relax knowing I had the best on
my side.
When I was questioned by the investigator in MY ATTORNEYS OFFICE,
[she] did not put up with any nonsense from the questions being
asked. I wish you could have been there to see her put her foot down,
making him stay within his legal boundaries. Without legal
representation I never would have known what I should/shouldn't
answer.
On February 9, 2007 I received a call from [my attorney] telling me
that I had been cleared of any and all charges. She was just as happy
and excited to tell me, as I was to hear it. For 3 months I had been
holding my breath and at that moment I felt the air start to fill my
lungs again at the same time that tears filled my eyes. When I
thanked [her] and told her that she had just given me my life back
her reply was, You always had you life, I just held you hand until
you knew it. My gratitude for so many things was at an all time high!
I asked [her] what I could do for her as a thank you for all she had
just done for me and she said, "You just did it." But saying thank
you just isn't enough. I received a level of quality care that I
doubt the rich and famous get and I got it for $26 a month! [My
attorney] isn't just an attorney working at a Provider Law Firm, she
has a true passion, Pre-Paid Legal and what it represents.

My life was turned upside down by an 11-year-old telling lies. I
can't imagine the mental stress or the potential outcome without Pre-

I am cleaning up a huge backlog of email and I come across yours, I am sorry
for not getting back to you on this. You need to make sure that you hire a
lawyer who deals with CPS cases in the family court and who has won cases
like yours in the past. Find this out by calling some in your local phone
book and finding out who has done this type of work. If you can not get the
money for this then try Legal Aid, request it down at the court house or
search on the internet for some help. No matter what you have to file
motions to intervene on the placement and adoption and fight for
restorations of your child. You have to get your friends and family behind
you and make sure to involve all of your politicians.
