Don't feel badly, Mr. Tong. Even legal advocates have been debating
the Crawford ruling.

To break it down for you, basically, the question raised by
Supreme Court Decision on Crawford v. Washington is
is whether this procedure complied with the _Sixth Amendment_

guarantee that, “[i]n all criminal prosecutions, the accused shall
enjoy the right … to be confronted with the witnesses against him.”

The Crawford case had nothing to do with sexual abuse of children, although
many non-experts have been trying to find a corollary between the Crawford
Case and those accused of sexual abuse because sexual abuse in most of the
fifty-one states is considered an egregious act and has criminal outcomes for
individuals so accused. Those non-legal experts have been asserting that the
Crawford v. Washington case would make the sixth amendment's protection of
"the right to confront your accuser." be guaranteed in those accused of sexual
molestation. Some of these non-experts have even gone so far as to parallel
Crawford's use in child abuse and neglect cases. However, the jury is still
out on this question and the Crawford case is now four years old.

This case is exemplery as to how, a murder victim who is not available to
testify (as young children are sometimes excluded in sexual abuse cases because
they may be further traumatized by the perpetrator) because of the acts of
the defendant/perpetrator can have the "sixth amendment" guarantee of
confrontation waived as this case I posted shows and allow the heresay
statements or
evidence.

I don't see how the case above would apply to a criminal child sex case
unless an alleged victim and/or her therapist stated an alleged perpetrator
threatened the alleged victim with retribution to keep tight-lipped.
