An new Ontario Private member's bill calls for a ban on smoking in a car with a
child.
This has also been proposed in BC and was passed by a town in NS last week.
Family Court judges have viewed smoking in homes and cars in the presence of
children as child abuse and numerous cases from most provinces are available.
If your ex-spouse smokes, you may want to read the list of court references on
the website of the Canadian Children's Rights Council website.
These are not new decisions.
The cases listed below are for children that do not have any health issues or
for which expert medical advice or proof was provided with regards to a child's
ill health such as a child with asthma or any other medical condition that would
adversely be affected by smoke.
