My family has been fighting CP$ in Onslow County, NC since Nov, 2006
when they illegally took my niece, they placed her with her sperm
donor who had abandoned her when she was 7 months old he had been
arrested several times oer 6 yrs for non payment of child support,
my sister has given both the casewrecker and GAl the Parental rights
Preservation letter , CP$ has had every hearing continued, there
stil has been no adjudication hearing , now on top of the father
taking child off her medications not once but several times, CP$
still tells my sister he is not doing anything wrong, he and his
wife have seperated and he left my niece with his wife and 2 other
children, yet CP$ still allows her to stay there. My sister has had
2 lawyers who refuse to do anything, she tried to file motions but
even when she did not have lawyer the judge would not allow her to
file anything, in March 1 judge stated the adjudication could not be
continued any more, yet DSS take it befor etheir rubber stamper
judges in a "Bench hearing" and has the hearings continued 6 times
now. Her lawyer finally filed a motion in april about the medical
issuses and once again DSS got it continued, and this has been
continued 3 times in the last 2 weeks now they have had it continued
until 6-25-07, DSS has allowed the sperm donor to not take child to
her specialists for her teeth/jaw condition. His wife has cancealed
all appointments for her thereapy that was set up due to suspected
sexual abuse. My neice is 7 yrs old yet she baths her 18 month old
sister, she has been allowed very little contact with her 1/2
sister, another child the sperm donor just got taken to court for
back child support, there is so much more but it is very long story.
DSS has fired 2 caseworkers and 2 others have "moved". DSS stated
the only thing stopping y neice from being returned to my sister was
she was missing "a kitchen table and chair set and living room suit"
she has chairs in her living room just no couch but those were both
rectified the same day wrecker stated. She has ompleted 5 case
plans, Yet we can get nothing done, all judges have said visitation
was per DSS, yet they will only allow 1 hour visiter every 2 weeks.
How can we get this case heard, or is there a motion we can file
outside of juvinile court that will force DSS to have the
adjudication hearing or get the case dismissed? Please help my neice
is withdrawing and noone seems to give a crap.
