"I was shocked and outraged when Steve and I learned that Paulah Dauns is a card-carrying drug treatment prohibitionist, who is deeply involved with the T.N. Libby Society, a Catholic drug treatment house in North Vancouver," complained Michele Kubby. "On the third day of our hearing, Steve challenged Ms. Dauns and said that her comments were prejudicial and that therefore she was incapable of providing a fair and honest decision. Steve specifically objected to her prohibitionist comments when questioning Michele and our other witnesses. We specifically requested that Ms. Dauns remove herself as the adjudicator, which Ms. Dauns refused to do," argued Mrs. Kubby. "For Ms. Dauns to rule that she was qualified and not reveal her background and to render the kind of senseless decision that she did, is all compelling evidence that Ms. Dauns should have disqualified herself. Furthermore, St. Leonard's Society of North Vancouver was founded by a Catholic Priest and we believe they are opposed to any use of marijuana, including for medical purposes, since that is the position of the Catholic Church. A call to their facility confirmed that patients must abstain from all drugs, legal and illegal. In our case, cannabis is what is saving my husband's life. Because Ms. Dauns is involved with the drug treatment Board, she is unable to be unbiased about Steve's use of cannabis. This bias is evident in her decision where she indicates that cannabis is Steve's "drug of choice", even though the specialist we were introduced to through the Refugee Board process indicated that cannabis is the best treatment available for Steve. During our hearing, our doctor unequivocally testified that without cannabis, my husband would suffer a heart attack or stroke within days of being jailed. Dr. Connors even wrote Ms. Dauns after her decision to offer to explain his testimony to her and clarify that my husband's life depends on medical cannabis and there is no other satisfactory treatment. For Ms. Dauns to declare that she has confidence that proper medical care would be provided if my husband is returned to the US ignores the testimony of the government's own doctor in this case. Ms. Dauns not only ignored the physicians' testimony and subsequent letter; she also ignored that the evidence used to convict my husband was manufactured by police chemists, something that is not allowed under Canadian law. We challenged Ms. Dauns' ability to be unbiased on the third day of our hearings in March of 2003. She assured us that she would listen to the facts and render an unbiased judgement. That was obviously not the case. Numerous lawyers have read the decision she rendered and have agreed that it is rife with inconsistencies and outright bias. Mr. Jackson, this decision by Paulah Dauns has put my husband's life in danger. In addition to lodging this complaint about Ms. Dauns, we would like to have a review of our case by the entire Refugee Board, as is our right under the new Immigration Act. So far, we've been told there is no Appeals Board and we have no choice but to appeal this to the Federal Court. Thus, against our will, we are appealing this decision to the Federal Court, but as you are aware, that is no guarantee of anything. Only 1% of Refugee cases are overturned. I believe that because of Ms. Dauns' outright bias and prejudice, she has made a mockery of the Refugee process. We came to you with a genuine need and because she was unwilling or unable to see that need, my husband's health is greatly suffering. If my husband is returned to the US and dies, his blood will be on your hands. I trust that you will make some attempt to make this right. There are two other cannabis patients currently awaiting a decision from Ms. Dauns on their cases. I hope for your sake that the entire Refugee Board reviews this controversial and unjust decision.
