death sentence is out there in public on the internet, and is on a short
list of talking points for emails to Canada's Minister of Justice Irwin
Cotler and media urging the Canadian government to block Emery's
extradition. The DEA has not yet assured the Canadian government that they

At first I was delighted by this initiative. Lately, though, I'm having doubts about the direction your emails are taking. I thought I better speak up. A couple of years ago I have been suing the Canadian government, through the Hitzig case. That case was successful. My impression is that the reaction is slightly negative. Clearly people are concerned about Marc - a Canadian, threatening to be extradited to US and the personal drama that it is causing him. Yet, I don't detect much support for Marc's arguments as to why marijuana should be legal.
It seems to me that Marc's main argument for legalization is that, "in democracy, people should not be imprisoned for lifestyle choices when they don't hurt anyone". On the surface this seems like the right argument. It is a very brief and simple statement, easy to understand by an average person. The problem is that Marc's argument is way too broad of an argument. In fact, it is not an argument for legalizing marijuana at all. Rather, it the stated goal of the entire Harm Reduction movement. I'm very supportive of the harm reduction goal. But it is a long term goal that the public is still debating and will be debating for many years to come.It applies equally to pot as well as to other street drugs. Cocaine?, Crack? Crystal? It raises too many questions and solves none. While I personally support harm reduction in general, and abhor the war on drugs, I also see the futility of Marc's efforts to lump the legalization of pot with all of the other drugs. It is just too much for the public to deal with. If we want to legalize marijuana in the near future, we ought to be making arguments that marijuana is DIFFERENT from the other drugs and could be dealt with right away.My view is that, in the end, it is not the courts, or the exhortations of the activists that will allow legalization of marijuana. It is the Canadian public that has to be convinced about this good idea. In addition, the Canadian government needs to feel that they can defend their legislating against the bullying of the big US brother. My reading of the Canadian mood is that we are ready to support decriminalization, but are usure of legalization. I believe the Canadian government is also behind decriminalization. It can be done despite the US bullying. After all, Canada could always argue that they are just bringing the law in line with the laws in United Kingdom. Why not to allow Canadians to enjoy the same rights as UK citizens? And, it is my belief, that decriminalization in Canada would also reflect positively in the US public opinion.Clearly, decriminalization has its problems. I expect that, in a couple of years or so, the experience gained from decriminalization of marijuana will show the public that we need to proceed to full legalization.
To sum up, my view is that to expect legalization happening in one step is not going to get us anywhere. We would be better off pushing the government to stop delaying the decrim bill.
