Other products that are deleterious or adulterated are banned, e.g., milk, meat, aspirin, etc. Other behaviors, e.g., Jack Kevorkian's, that provide the means of death are illegal. Cigarettes should be treated the same, only safe ones allowed. Deleterious and adulterated cigarettes should be banned. Providing them as a means of death is illegal.
