By way of introduction, background, training, and experience, I have been a
licensed Texas Attorney since April 1971. I began my legal career as a
Briefing Attorney to U.S. District Judge John H. Wood, Jr. (Deceased),
then served as an Assistant U.S. Attorney for The Western District of
Texas, and am the Former President/CEO and Senior Managing Shareholder of
the 18th largest lawfirm in San Antonio, Texas, as listed in the 1995 "Book
of Lists," "San Antonio Business Journal."
My biography has been published for the past 15 years in "Who's Who in
American Law." I am now retired from the active practice of law, and am
fully engaged in the ownership of a Health & Wellness Distributorship with
large international business operations. I continue to stay abreast of
health related issues involving things which are both beneficial and harmful
for human consumption, and have been featured on an ABC TV Program involving
"Dangerous Foods," in health related books, and in a recent full length
film, "Sweet Misery in a Poisoned World," involving the great dangers of
aspartame to humans.
As a briefing attorney to a U.S. District Judge, and as an Assistant U.S.
Attorney with the U.S. Department of Justice, it was my job to interpret
the meaning, application, and enforcement of federal Statutes and
Regulations, which frequently required referring to the Congressional
History of Federal Legislation by researching the history in the
"Congressional Record." This also frequently entailed researching State
Statutes.
I have reviewed the New Mexico Food Act
(25-2-1 to 25-2-19 and 25-2-20 NMSA l978) on adulterated and poisonous
foods.
It is a strong, clear law with its criminal prosecution provisions for
violators.
It is quite clear in its meaning and in its intent, and is not hard to
understand or interpret.
The said Statute provides that: A food shall be deemed to be adulterated,
(1) if it contains any poisonous or deleterious substance which may render
it injurious;
(2) if it contains any added poisonous or added deleterious
substance which is unsafe, and
(3) if it consists in whole or in part of ... decomposed substance, or if it
is otherwise unfit.
Under New Mexico law, inasmuch as aspartame clearly and unequivocally
decomposes and adulterates, this is an open and shut case.
You clearly have the right as well as the obligation to ban aspartame
for the health, safety, and welfare of your citizens.
The Bottom Line is:
(1) Aspartame is unsafe and adulterated, and is indeed
dangerous to the health, safety and welfare of the citizens of The State of
[board, not agency] New Mexico, and
(2) your Agency is empowered to and should ban aspartame from your State
in order to protect and to preserve the health, safety and welfare
of the citizens of The State of New Mexico.
DISCUSSION
In Statute 25-2-15, NMSA, the authority to promulgate regulations for the
efficient enforcement of the New Mexico Food Act is vested in your Board.
Therefore, the EIB has the right to ban aspartame.
For example, in Minnesota, U.S. District Judge, Hon. James
Rosenbaum, affirmed the right of a state to protect its citizens
health, despite corporate claims of being protected by the FDA
approval of their products and that nothing in the act which created
the FDA was intended to preempt any state tort law or consumer
protection statute or certainly the statutory powers given to the New
Mexico EIB in statutes and in the New Mexico Administrative Code.
A recent example of FDA approval of dangerous substances is the Vioxx
situation, wherein 55,000 US citizens were found to have died of
causes associated with the ingestion of Vioxx.
Don't let the much worse situation of aspartame poisoning continue in
New Mexico, when you have the very clear right and very clear power to
ban it from use in the State of New Mexico.
This could be the first step in removing what has been described by
highly credentialed medical doctors as a "Worldwide Plague."
Aspartame is a prime example of an adulterating/poisonous substance
forbidden by this law and should be banned now. The said New Mexico
Statute is very similar to the Federal Statute.
The May 7, 1985 United States Senate Congressional Record recorded the
long, detailed protest of the National Soft Drink Association against
aspartame specifically because of its unique instability. This does
not bear repeating verbatim in this memo, however, the following
salient excerpt states:
"Specifically, Searle did not met its burdens under section 409 of the
Federal Food, Drug and Cosmetic Act, 21 U.S.C. 348
("FDC Act" to demonstrate that aspartame is safe."
In fact, the FDA's own Senior Toxicologist, the late Dr. Adrian Gross, who
took part in on-site investigations at Searle, said the studies carried out
by Searle to show the safety of aspartame were "to a large extent
unreliable." He said "at least one of those studies has established "beyond
any reasonable doubt" that aspartame is capable of inducing brain tumors in
experimental animals and that this .. is of extremely high significance."
Gross also testified before Congress that because aspartame was capable of
producing brain tumors and brain cancer, FDA should not have been able to
set an allowable daily intake of the substance at ANY LEVEL. Congressional
Record SID835:131 (8/1/85).
The FDA's own report admits to 92 documented symptoms triggered by aspartame
from four types of seizures to coma and death.
A 1138 page medical text, "Aspartame Disease: An Ignored Epidemic,"
by H. J. Roberts, M.D. documents symptoms and diseases triggered
by this deadly neurotoxin. See more at www.sunsentpress.com .
In the Trocho Study (Trocho C., Pardo R, et al. Formaldehyde derived from
dietary aspartame binds to tissue components in vivo.
Life Sciences 63: 337-349, l998) it was demonstrated that
following aspartame ingestion, significant amounts of formaldehyde
accumulate in the tissues.
Russell Blaylock, M.D., discussing this study said that formaldehyde
is known to bind strongly to proteins and nucleic acids,
forming adducts that are extremely difficult
to eliminate through normal metabolic pathways.
Ergo, aspartame was clearly in violation of the federal adulteration law and
was illegally added. By admission of the National Soft Drink Association,
"Section 402 of FDC Act 21 provides a food is adulterated if it contains, in
whole or in part ...a decomposed substance, or if it is otherwise unfit for
food." This is the same language as that of the New Mexico statute, which
clearly gives The State of New Mexico and your Board the right and the power
to ban aspartame in New Mexico.
The FDA's own studies of aspartame clearly demonstrate that aspartame breaks
down in beverages in temperatures over 86 degrees Fahrenheit, into aspartic
acid, and formaldehyde, a deadly neurotoxin. This in fact occurred in the
Gulf War, as pallets of Diet Coke were left sitting for days in the hot
desert sun, and the temperatures reached 125 degrees Fahrenheit. I repeat:
There are in fact 92 medical symptoms listed in the FDA's own records.
The above referenced medical text written by Dr. H. J. Roberts, M.D. (chosen
by the editors of a national medical journal as "The Best Doctor in the
U.S." clearly makes the case against aspartame, and the fact that aspartame
decomposes and adulterates. This fact is well documented in Dr. Roberts
heavily footnoted and annotated 1138 page medical text and needs not to be
repeated verbatim in this brief discussion. As we say in law, Res Ipsa
Loquitor, "The Thing Speaks for Itself."
There is much more than a "smoking gun" here. There are in fact millions of
lives ruined, and deaths that have occurred, as a direct and proximate cause
of ingestion of aspartame since it was introduced. I myself am a victim of
aspartame, and have had 2 pituitary adenoma (brain tumor) surgeries and
radiation therapy. I have no doubt that these were directly and proximately
caused by my heavy aspartame ingestion.
The banning of aspartame is not only well within your powers, but is in fact
a long overdue service to New Mexico's consumers who are ingesting this
product unknowing its toxicity.
You are to be commended for having moved this rule change along this far to
take this much needed step of banning aspartame in New Mexico in order
to protect the health, safety and welfare of the citizens of The State of
New Mexico. Other states will follow New Mexico's example.

The Basic Facts
Because of misinformation published and advertised concerning the safety
and advisability of using aspartame products in diet drinks and other food
products, I became a heavy consumer of aspartame and food products,
especially Diet Cokes, sweetened by aspartame products (e.g."NutriSweet"
and "Equal"), and as a direct and proximate result of my aspartame
consumption, developed a brain tumor. I was operated on twice to remove a
brain tumor, in December 1996 and again in July 1998, and underwent daily
radiation treatments for two months in 1997. Yes, in the words of a former
Senior Toxicologist for the FDA, Dr. Adrian M. Gross: "Beyond a shadow of
a doubt, aspartame causes brain tumors." This was stated in his testimony
before the U.S. Congress and was permanently memorialized, documented, and
published on August 1, l985 in The Congressional Record.
Class Actions Are Currently Brewing
I am sure that there are currently several class actions of some magnitude
being prepared against the willful purveyors of misinformation, the
manufacturer of aspartame, and others who are part of the conspiracy, by
New York and Los Angeles lawfirms which specialize in large class actions.
The Question
I have read a copy of Ms. Betty Martini's email to you of May 24, 2001 at
11:30am, and I must ask you the same question she asked of you: Why are
you, David, consciously, willfully, and deliberately putting out
misinformation on aspartame? Yes - deliberately and with full knowledge of
the dire and extremely harmful medical consequences that this
misinformation is in fact causing, including the deaths of unsuspecting
mothers, fathers, and children. In my case, it almost resulted in my death
(twice) during two brain tumor surgeries which resulted in my inability to
practice law after 30 years and while in the prime of my earning years. I
feel so strongly about this issue that I have written an article on the
undeniable and irrefutable fact that "aspartame causes brain tumors beyond
a shadow of a doubt", which is now published on over 400 websites
worldwide. The information contained in this article is copied below,
along with my preliminary message to Ms. Betty Martini.
At some point, your conscience must overrule.
I know that you have a conscience, and at some point, your conscience must
overrule the disservice and harm that you are now an integral part of, in
causing great physical and mental harm, and even death, in the lives of
hundreds of thousands of unsuspecting mothers, fathers, and children each
year who believe that "the worldwide plague, aspartame," is safe to use,
or that the warnings of the dangers of aspartame are "just a hoax" as you
and your website, and those aiding and abetting and otherwise acting in
concert with you are publishing on your website.
The Worldwide Aspartame Plague is Not A Hoax And You Know It
It is not a hoax, David, and you know it full well. You are fully and
consciously knowledgeable of the misinformation that you and your website,
Urban Legends, puts out concerning aspartame, and as such, you and anyone
else who is acting in concert with you and otherwise aiding and
abetting in this conspiracy of willful and malicious misinformation, will
be held accountable, just as the tobacco companies and their officers have
been and still are being held accountable for the knowing misinformation
they put out for years, knowing full well that they were causing the
deaths, and painful suffering, of millions of people who believed them.
The scene is the same, the names of the death dealers and their
instruments of death and family destruction are different. You certainly
cannot claim ignorance; The mounting and escalating evidence is far too
compelling and overwhelming. So, what is your motivation?

As you know, I served as the first Briefing Attorney to U.S. District
Judge John H. Wood, Jr. I have a background as a U.S. Department of
Justice Attorney, and served as an Assistant U.S. Attorney for the Western
District of Texas under William S. Sessions, who later became the Director
of the FBI.
I am privileged to have my biography published in "Who's Who in The
World", "In America", "In American Law", "In The South & Southwest", "In
Industry & Finance", and "Among Top Executives". Over the last 30 years I
have owned and/or been General Counsel for several oil companies,
securities companies, and investment banking firms.
For the last 10 years I have served as founder, President and CEO of one
of the larger lawfirms in the eighth largest city in America, which does
casualty, products liability, and medical and legal malpractice defense
for some of the largest insurance companies, Fortune 500 Corporations, and
trucking companies in America. I served for three years on the Federal
Licensing Committee for the Western District of Texas, and was President

As you also know, due to my heavy ingestion of aspartame (NutraSweet &
Equal) in my food and Diet Drinks -- mainly Diet Cokes (thinking I was
"prudently and wisely watching my weight and health"), over the years
since the FDA allowed it to be placed in foods and drinks, I developed a
brain tumor (pituitary adenoma), which has required two life threatening
surgeries, and daily radiation therapy for two months. The reasons for my
belief that aspartame caused my brain tumor will become apparent as you
read on.
The combination of all of this has severely disabled my ability to
perform executive functions and to "input" and thus "recall" facts, to the
point that I was finally forced to retire from the practice of law in
January of 2000,at the age of 55. Now, unless something is written down,
and I'm looking at it, I cannot recall it. Not the type of a condition for
an attorney to have! I now have to carry a detailed planner with all sorts
of back-up systems to keep a schedule of even the simplest things.
However, I am grateful to be alive, and not among those who have not
survived "Aspartame Disease".
Short term memory loss, or more accurately in my case,"memory input
deficit", is one of the known and classic symptoms of aspartame disease,
and one of the known residual effects of radiation therapy that my
treating radiologist warned me would most probably occur after the
treatments, which were concluded over3 years ago. A medical evaluation was
recently done, and the opinion of the evaluating doctor was that "due to
the long period of time since the initial surgery and radialtion therapy,
it is improbable that a spontaneous recovery will occur." I am scheduled
to have an MRI within the next few days to determine whether the brain
tumor (2.4 cm in size) has regenerated since the last surgery. I still am
in the shadow of "Aspartame Disease".
Since December l996, when I saw an expose on aspartame (NutraSweet &
Equal) on the national television program, "60 Minutes", I have researched
the dangers and symptoms of aspartame, primarily through your website, and
the website http://www.dorway.com , through independent
reading in books, medical journals, and through your daily information
updates to your website and others, and your daily aspartame case history
reports. I have personally found an increasing number of people who have
had brain tumors and brain surgeries either themselves and/or in their
family and/or circle of friends and acquaintances.
The "60 Minutes" television program, which aired in December of l996,
pointed out that the alarming and significant rise in brain tumors in the
United States has been in direct proportion to the rise in the use of
aspartame in the United States since aspartame was allowed to be
introduced into foods and beverages by the FDA around l981. After viewing
that program, I have not touched a food product or diet drink containing
aspartame! Prior to that I drank a huge number of Diet Cokes daily, and
sweetened most all my foods and beverages with it.
Below is a Narrative Report of facts which I believe not only strongly
support, but prove the fact, that in the words of the late Dr. M. Adrian
Gross, a former Senior FDA toxicologist, "beyond a shadow of a doubt,
aspartame causes brain tumors (and cancer)". You will recognize many of
the statements in the summary, because they came largely from sources that
you yourself have researched and frequently quoted in your daily aspartame
reports, and are also to be found in The Congressional Record, and in
medical reports quoted and found on the website

As Recorded in The Congressional Record, August 1, l985
The late Dr. M. Adrian Gross, former senior FDA toxicologist, stated in
his testimony before Congress, "Beyond a shadow of a doubt, aspartame
triggers brain tumors" and, "therefore, by allowing aspartame to be placed
on the market, the FDA has violated the Delaney Amendment". In fact, his
last words to Congress were: "And if the FDA violates its own law, who is
left to protect the public?" These words have been repeated hundreds of
times in numerous publications and talks. Read Dr. Adrian Gross' letters
to Senator Metzenbaum on http://www.dorway.com , listing
all the brain tumors caused by aspartame. Read the "Bressler Report",
and the FDA's own internal audit on aspartame and the 92 adverse medical
symptoms caused by aspartame, on http://www.dorway.com .
The testimony of the late Dr. M. Adrian Gross, former senior FDA

who took part in on-site investigations at Searle laboratories, said the

Dr.Gross also testified that because aspartame was capable of producing
brain tumors and brain cancer, the FDA should not have been able to set an
allowable daily intake of the substance at any level. In view of these
indications that the cancer causing potential of aspartame is a matter
that had been established way beyond any reasonable doubt, one can
ask: What is the reason for the apparent refusal by the FDA to invoke
for this food additive the so-called Delaney Amendment to the Food, Drug
and Cosmetic Act?" As I sat next to a former FDA investigator in Houston,
Texas, as a guest on the ABC owned Channel 13, on the Top Rated "Debra
Duncan Show", the host asked that very question of him. His reply was:
"Money! There are billions of dollars in revenues at stake in the sale of
aspartame, and the people who sell it are making many billions of dollars."
So, as usual, it's all about money and greed, over the lives of the
innocent who are sick and dying, so that a few rich "cancer-mongers" can
and have become even richer. And the irony of it is that, as in my case,
the innocent think they are "improving their health" by drinking diet
drinks and sweetning their foods (unknowingly) with the deadly cancer and
tumor producing neurotoxin, aspartame (NutraSweet & Equal) which causes
brain tumors and cancer.
The manufacturer of Nutrasweet (Searle) admitted in their own internal
reports (see http://www.dorway.com for the full report),
as published in The Congressional Record at SID835:131, that "they had to
consider complete conversion to DKP". In fact, they said "if they told
the FDA this fact, the FDA wouldn't approve aspartame". "DKP" is
diketopiperazine, the brain tumor agent. Sounds like the tobacco fraud
all over again, doesn't it? But this time, it's the drug industry, and
it's big. When the class actions hit, and they will, I predict that they
will rival the tobacco litigation we have seen in the past few years.
The aspartame manufacturer (now Monsanto, which bought aspartame from
Searle) has a a lot of political influence, and when the FDA Director
refused to allow aspartame on the market, he was replaced by one who
would, and did, although the FDA had previously asked the U.S. Department
of Justice to investigate the manufacturer (Searle) for fraud and deceit
in concealing tests and results which showed that aspartame caused brain
tumors, cancer, grand mal seizures, and a total of 92 adverse medical
and physical symptoms, including blindness and death. The U.S. Attorney
who was asked to investigate Searle, failed to do so, but accepted a
position with the Monsanto Corporation's (which purchased the rights to
aspartame) defense firm, and the statute of limitations expired. He was
aware of the approaching deadline. This is all a matter of record, and can
be found on the website http://www.dorway.com .
The Delaney Amendment makes it illegal to allow any residues of
cancer causing chemicals in foods. In his concluding testimony Dr. Gross
asked, "Given the (cancer causing potential of aspartame, aka" NutraSweet"
& "Equal") how would the FDA justify its position that it views a certain
amount of aspartame as constituting an allowable daily intake or 'safe'
level of it? Is that position in effect not equivalent to setting a
'tolerance' for this food additive and thus a violation of that law? And
if the FDA itself elects to violate the law, who is left to protect the
health of the public?" Congressional Record SID835: 131 August 1, l985 .
All the documents showing brain tumors, of course, are on
http://www.dorway.com including Dr. Olney's update and
Dr. H.J. Robert's (selected "The Best Doctor in the United States" in the
1980's) peer reviewed paper on aspartame and brain tumors. Dr. Roberts
once told Betty Martini, founder of Mission Possible International that
brain lymphoma was once very rare but since aspartame was introduced, it
is projected to be the third most common brain tumor. The rats used in
aspartame studies developed astrocytomas and pituitary adenomas. A
five stage astrocytoma is a glioblastoma, the rapidly spreading malignant
brain tumor that is escalating in the population.
In December, l996, "60 Minutes" aired an expose on aspartame, and stated
that research shows that the recent high rise in brain tumors in the
United States is in direct proportion to the introduction of aspartame
("Nutrasweet" and "Equal") on the market, and the rise in its use by
American consumers in food and drinks since the FDA allowed it's
introduction into food and drinks in l981.
We need to warn the public about the established reports and public
records on the dangers of the deadly neurotoxin "aspartame", and that
aspartame (aka "Nutrasweet" and "Equal" breaks down to a brain tumor
agent, diketopiperazine ("DKP").
James Bowen, M.D. wrote in an article entitled "Aspartame Murders Infants":
"As it breaks down, aspartame creates "DKP", diketopiperazine, and with
the intact aspartame molecule you have the two greatest brain tumor
carcinogens discovered by science thus far responsible for the massive
brain tumor epidemic we now witness. The methylated aspartyl

Since no adaquate data has ever been published on the exact disposition of
toxic metabolites in specific tissues in humans of the 11% methanol
component of aspartame, the many studies on morning-after hangover from the
methanol impurity in alcohol drinks are the main available resource to date.
Jones AW (1987) found next-morning hangover from red wine with
100 to 150 mg methanol
(9.5% w/v ethanol, 100 mg/l methanol, 0.01%, one part in ten thousand).
Fully 11% of aspartame is methanol -- 1,120 mg aspartame in 2 L diet soda,
almost six 12-oz cans, gives 123 mg methanol (wood alcohol) -- the same
amount that produces hangover from red wine.
The expert review by Monte WC (1984) states: "An alcoholic consuming
1500 calories a day from alcoholic sources alone may consume
between 0 and 600 mg of methanol each day depending
on his choice of beverages (Table 1)...."
Table 1 lists red wine as having 128 mg/l methanol, about one part in ten
thousand.

The symptom list is similar to reports by aspartame reactors.
If only a fraction of aspartame users happen to be vulnerable to the
methanol, that would account well for the disbelief by those who are not
aspartame reactors, as well as the scientific difficulty in proving
aspartame toxicity in the general population.
Research can study whether the hangover prone are also vulnerable to
aspartame, methanol, formaldehyde, and formic acid, and determine the
specific biochemistry for different groups.
Hangover treatments may help aspartame reactors. For instance, adaquate
folic acid (folate) helps humans eliminate toxic products from methanol.

This paper reports the elimination half-life of methanol in human
volunteers. Experiments were made during the morning after the subjects had
consumed 1000-1500 ml red wine (9.5% w/v ethanol, 100 mg/l methanol)
the previous evening. [ 100 to 150 mg methanol ]
The washout of methanol from the body coincided with the onset of hangover.
The concentrations of ethanol and methanol in blood were determined
indirectly by analysis of end-expired alveolar air.
In the morning when blood-ethanol dropped below the Km of liver alcohol
dehydrogenase (ADH) of about 100 mg/l (2.2 mM), the disappearance half-life
of ethanol was 21, 22, 18 and 15 min. in 4 test subjects respectively.
The corresponding elimination half-lives of methanol were 213, 110, 133 and
142 min. in these same individuals.
The experimental design outlined in this paper can be used to obtain useful
data on elimination kinetics of methanol in human volunteers without undue
ethical limitations.
Circumstantial evidence is presented to link methanol or its toxic metabolic
products, formaldehyde and formic acid, with the pathogenesis of hangover.

Editorials Hangovers: Not the ethanol - perhaps the methanol
"Wine is only sweet to happy men," wrote an unhappy John Keats to his
sweetheart.(1) His observation seems to have been vindicated.
Harburg et al found that psychosocial factors such as guilt about drinking,
a neurotic personality, becoming angry or depressed while drinking, and
having suffered "negative life events" in the past 12 months are better
predictors of symptoms of hangover than the amount of ethanol drunk.(2)
In fact, ethanol itself may play only a minor part in producing the thirst,
headache, fatigue, nausea, sweating, tremor, remorse, and anxiety that
hangover sufferers report.
Hangover symptoms are worst at a time when almost all ethanol and its
metabolite acetaldehyde have been cleared from the blood, and peak blood
ethanol or acetaldehyde levels are not related to the severity of
hangover.(3 )
Between a quarter and a half of drinkers claim not to experience hangover
symptoms despite having been intoxicated.(2, 3, 4)
Congeners - complex organic molecules such as polyphenols, higher alcohols
including methanol, and histamine, which occur in varying amounts in
ethanolic drinks - are probably more to blame than ethanol.
Chapman found that hangover symptoms were almost twice as common in
volunteers who drank 1.5 ml/kg [ body weight ] of bourbon whiskey -- which
has methanol concentrations of 26 mg/l --
as in those drinking the same dose of vodka ( 3.9 mg of methanol per
litre ). (5) [ For a 60 kg person, this would be 90 mg bourbon, 0.09 l,
giving 2.34 mg methanol, which led to twice as many symptoms as the 0.35 mg
methanol from vodka. The bourbon gave as about as much methanol as an
ounce of diet soda. ]
Pawan compared the hangover produced by different types of drink (but only
one brand of each) in his study of 20 volunteers. The severity of hangover
symptoms declined in the order of brandy, red wine, rum, whisky, white wine,
gin, vodka, and pure ethanol.(6) Vodka and pure ethanol caused only mild
headaches in two volunteers.
Jones has suggested that it is the metabolism of methanol to formaldehyde
and formic acid that causes symptoms of hangover, with quicker methanol
metabolisers suffering more.(7) The justification for this suggestion is
threefold:
the types of drink associated with more severe hangovers contain higher
levels of methanol;
the time course of methanol metabolism corresponds to the onset of symptoms;
and a small dose of ethanol, which blocks the formation of formaldehyde and
formic acid, provides an effective treatment for hangovers ("the hair of the
dog").
The economic and social consequences of hangovers are probably considerable
but difficult to quantify. Performance accuracy is impaired synergistically
by sleep deprivation and hangover.(8)
Drivers perform less well in simulators when tested the morning after
drinking ethanol.(9)
Making driving with a hangover a criminal offence might be logical, but is
probably impractical in the absence of a simple diagnostic test like breath
alcohol.
Many pathophysiological disturbances occur during hangover, including
dehydration; metabolic acidosis; hypoglycaemia; disturbed prostaglandin
synthesis; abnormal secretion of vasopressin, cortisol, aldosterone,
renin, and testosterone; increased cardiac output; tachycardia; and
vasodilatation.
Hypoglycaemia and acidosis can be treated with fructose or glucose,(9) and
the cardiovascular abnormalities with ß blockade,(10) but symptoms are not
alleviated.
However, rehydration and anti-inflammatory analgesics are helpful,
particularly if treatment is started before bedtime.(11)
A completely effective treatment is probably unattainable (since so many
factors - such as lack of sleep, active or passive smoking, dietary
indiscretions, unaccustomed physical activity, intermittent upper airway
obstruction, and emotional disturbances - must play a part) and is arguably
undesirable since the fear of hangover prompts most people to moderate their
ethanol intake.(4 )
Even moderate amounts of ethanol can be damaging,(12) so a penalty for
consumption is in our interests. Perhaps those who aspire to be one of Dr
Johnson's "heroes" by drinking brandy (13) are sensible as well as brave.

"These are indeed extremely high levels for adducts of formaldehyde, a
substance responsible of chronic deleterious effects (33), that has also
been considered carcinogenic (34,47). The repeated occurrence of claims
that aspartame produces headache and other neurological and
psychological secondary effects-- more often than not challenged by
careful analysis-- (5,9,10,15,48) may eventually find at least a partial
explanation in the permanence of the formaldehyde label, since
formaldehyde intoxication can induce similar effects (49).
The cumulative effects derived from the incorporation of label in the
chronic administration model suggests that regular intake of aspartame
may result in the progressive accumulation of formaldehyde adducts.
It may be further speculated that the formation of adducts can help to
explain the chronic effects aspartame consumption may induce on
sensitive tissues such as brain (6,9,19,50). In any case, the possible
negative effects that the accumulation of formaldehyde adducts can
induce is, obviously, long-term. The alteration of protein integrity
and function may needs some time to induce substantial effects.
The damage to nucleic acids, mainly to DNA, may eventually induce cell
death and/or mutations.
The results presented suggest that the conversion of aspartame methanol
into formaldehyde adducts in significant amounts in vivo should to be
taken into account because of the widespread utilization of this
sweetener. Further epidemiological and long-term studies are needed to
determine the extent of the hazard that aspartame consumption poses for
humans."
Here is research in 1998 at a very low level of aspartame
ingestion, 10 mg/kg, for rats, which have a much greater tolerance for
aspartame than humans. The same toxicity level for humans would be
about 1 mg/kg. Many headache studies in humans used doses of about 30
mg/kg daily. A daily dose of 1120 mg aspartame, about 2 L diet soda,
used in many experimental tests on humans, is 19 mg/kg and supplies 123
mg methanol into the body, 2 mg/kg for a 60 kg body. Many cases report
typical serious symptoms at this level. This report shows that
aspartame causes binding of methanol's product, formaldehyde, a potent,
cumulative toxin, into tissues.

The Cancer Research Center of the European Foundation of Oncology and
Environmental Sciences in Bologna, Italy reported this week that a long-term
study to evaluate the potential carcinogenic effects of aspartame
demonstrates the chemical sweetener "induces an increase in lymphomas and
leukemias in female rats." The research will be presented at a September
international scientific conference, "Framing the Future in the Light of the
Past: Living in a Chemical World."
Neurosurgeon Russell Blaylock M.D. commented:
"The new study released in the European Journal of oncology by Morando
Soffritti and co-workers should terrify mothers and all those consuming
aspartame sweetened products.
This was a carefully done study which clearly demonstrated a statistically
significant increase in several types of lymphomas and leukemias in rats.
Both of these malignancies have increased significantly in this country
since the widespread use of aspartame.
"This study confirmed the previous study by Dr. Trocho and co-workers,
which also found the formaldehyde breakdown product of aspartame to be
damaging to cellular DNA and
that this damage was accumulative.
The type of damage was a duplicate of that associated with cancers.
Along with this most recent study,
this means that drinking a single diet cola sweetened with aspartame every
day could increase one's risk of developing a lymphoma or leukemia.
"They also found an increased incidence of malignant brain tumors,
even though it was not statistically significant.
This does not mean there is no association to brain tumors,
since only the animals exposed to aspartame developed the tumors.
With children and pregnant women drinking the largest amount of diet colas,
this puts their children at the greatest risk of developing one of these
horrible diseases.
Their study found that even low doses of aspartame could cause these
malignancies; yet, the higher the dose, the more cancers that were seen.
"Since aspartame can increase obesity and may even cause the metabolic
syndrome that affects 48 million Americans,
there is no reason to ever consume this product.
At the least it should be immediately banned from all schools."
Dr. Blaylock wrote the Miami Herald to counteract propaganda by the Calorie
Control Council, an aspartame front group:
"It is known that the amount of toxic phenylalanine reaching the baby is
twice as high as that in the mother's blood
because the placenta concentrates the toxin.
In addition,
numerous metabolic breakdown products of aspartame are known to damage the
developing infant's brain, including methanol, formaldehyde, formic acid,
diketopiperizine and phenylacetate.
"Aspartame has been shown by several studies to damage DNA, which can lead
to cancer and degenerative brain disorders later in life.
The risk of increased brain tumors in such a child would be enormous.
Similar mechanisms of damage would be expected in these with liver disease.
Studies on aspartame safety have shown that the product increases tumors
throughout numerous organs, especially the brain.
It was shown that brain tumor incidence increased over 47 times in animals
exposed to aspartame.
"With the public concern over childhood obesity and diabetes
few are being told of the overwhelming evidence that early exposure to
excitotoxins as found in aspartame consistently produce gross obesity and
insulin resistant diabetes, just as we are seeing in our youth.
The promoters of aspartame use have been lying from the beginning and
continue to use their money and political clout to cover up the real and
present dangers of this toxic product.".......
Dr. Roberts reviewed the Italian study, concluding:
"It's now incumbent upon researchers of leukemia and lymphoma to inquire
about the use of aspartame products routinely in such patients.
And its also highly relevant, the striking increase of primary brain
lymphoma which I reviewed in my books and articles.
You are dealing with a unique lymphoma of the brain.,
which most neurologists had not seen before the availability of aspartame.
In view of the unequivocal induction of brain tumors and of
leukemia/lymphoma in experimental animals,
the intent of the Delaney Amendment should be invoked.
This justifies [ classifying ] aspartame as an imminent public health hazard
and [ one that ] should be removed from the market, as I've emphasized for
two decades. "
In the "Journal of Advances in Medicine" Vol 4 #4, winter '91 article: "Does
Aspartame Cause Human Brain Cancer?"
Dr. Roberts said:
" The increasing frequency of primary brain lymphoma of B cell derivation --
including reticulum cell sarcoma, microglioma and histiocytic lymphoma --
also requires explanation because this subset was previously rare.
Eby et al reported a nearly threefold rise in its incidence among
immunologically normal persons in the l982-l984 SEER data, which they could
not explain. Specifically, the rate increased from 2.7 to 7.5 cases per ten
million population (p=0.001) in the time periods l973-l975 and l982-l984,
respectively.
The age-adjusted rise was more striking among women which increased from 4.9
per ten million in l979-l981 to 8.9 per ten million in l982-l984. "

"Hockberg and Miller reported a tripling of incidence of this tumor in
non-immunosuppressed persons during the 5 year interval between l980 and
l984."

The Italian study press release says the results demonstrate for the first
time aspartame is a carcinogenic agent --
"As recognized by the International Agency for Research on Cancer (IARC) of
the World Health Organization, results of long-term bioassays conducted on
rodents (rats and mice) are highly predictive of carcinogenic risk for
humans.
In light of this fact, the results of the CRC/ERF study on aspartame call
for urgent reconsideration of regulations governing its use as an artificial
sweetener in order to better protect public health, in particular that of
children."
