Greetings Bay Area WAPF folks,
I am writing to update you about the lawsuit that is being filed this
week on behalf of consumers of raw milk in California to challenge the
constitutionality of AB 1735, the law signed by the Governor at the
end of last year that dramatically changes the testing protocols of
raw milk in CA in a way that is likely to put the producers out of
business. Myself and some friends pooled our resources and hired the
public interest law firm of Gross Belsky in SF to file the suit, and
we built the website www.saverawmilk.org to let you sign our petition,
read about raw milk organizing in CA, and make donations.
Our suit is different than the one being filed through the WAP
associated Farm to Consumer Legal Defense. That suit is on behalf of
the PRODUCERS, while ours is a CONSUMER lawsuit. Despite the
frustrations you have read in emails from Sally Fallon and Aajonus
Vonderplainitz, the latter who has contributed funding and work to the
saverawmilk.org suit, I am really trying to build coalition and get
everyone to work together. Both producers are in communication with
us about our suit and the legal teams are also in communication. We
all agree that having several suits filed only strengthens our chances
of protecting our right to food choice in California.
Many hundreds of people have signed our online petition and donated
money. We now need to find the following specific types of plaintiffs:
1. a person who wants to drink raw milk for personal reasons (such
as bodily integrity, believing foods should be in their natural state,
etc.)
this type of plaintiff should not be too hard to find.
2. a person whose doctor has told him or her not to drink
pasteurized milk, but only raw milk.
(this type of plaintiff will be much stronger than one who,
without medical advice, has problems drinking pasteurized milk and has
decided to drink raw milk. if they are doing it on medical advice,
then there should be some medical record documenting the issue.
before we include them as a plaintiff of this type, we will need to
investigate a little, perhaps get a release from them so their doctor
can talk to us and confirm his diagnosis and instruction.)
3. we could also have a person who drinks raw milk for medical
reasons, but has not been directed by a doctor to drink raw milk.
4. a person whose religion has dietary principles, and one of those
principles is to drink raw milk. we would need some documentation as
to the religion and its beliefs: for example, any writings or codes
of the religion which describe the dietary principles. as i assume
this will be a small non-traditional religion, we should also know
something about its history, the number of adherents or parishioners,
etc.
We would like at least one of these plaintiffs to be a San Francisco
resident.
