Q1. Speaking of out-reach, how can we move those still using non-standard transactions and paper claim submissions to standard transactions?
Q2. At least one clearinghouse plans to broadcast eligibility requests to every payer they can. These 270 transactions are HIPAA-compliant. Can a payer refuse to enter into a trading partner agreement with a clearinghouse that intends to do so?
Q3. Can a provider require us to send both payment advice and benefit payment to them electronically, or are we compliant by sending electronic payment advice via an 835 and a paper payment via check?
Q4. In regards to achieving compliance with the Security Rule, where do you start?
Q5. Regarding the HIPAA Security Technical Safeguards, there are no implementation specifications for Audit Controls. What is required to be audited and how long must these audit logs be kept?
Q6. We are planning to implement system upgrades that will provide needed technical safeguards. The upgrade is expected to be completed in September 2005. Will we be subject to penalties come April 2005?
Q7. What PHI can a health plan provide to an employer or plan sponsor?
Q8. Is it necessary to audit compliance with the Privacy Rule, and if so, how?
Q9. Bob Hoover, CIO, Independent Health responds to the question: Now that the deadline for compliance has come and gone, what are the issues that you are dealing with in regards to the HIPAA Privacy Rule and how are these issues being addressed?
