JCT: Since Judge Tulloch has the Sfetkopoulos case as one of the
reasons that the law is not valid so it's important that he knows
what happened. So this is my letter to the Court:

Dear Judge Tulloch:

1. The Crown's Application for Leave to Appeal the Federal Court
of Appeal's Sfetkopoulos decision that the MMAR is not
constitutional since the condition which had been struck down by
the Hitzig Court as unconstitutional was re-issued by Health
Canada on Dec 3 2009 was dismissed by the Supreme Court of Canada
with costs.

2. In 2003, the Hitzig Court ruled that while the MMAR was
constitutionally flawed, the prohibition on possession of
marijuana was invalid.

3. There seems to be no judicial recourse against the decision
that the MMAR was judicially flawed since Dec 3 2003 and the
Government certainly had not fixed the impugned policy until
their last appeal to the Supreme Court court on April 23 2009 was
denied. So the MMAR remains as yet constitutionally flawed.
