R: Are you aware that the OCA issued (or signed, I don't
know the proper term) an order striking the offending
provisions from the MMAR on December 23, 2003?

JCT: That's the official order containing the gist of the
Judgment with reasons issued on Oct 7 2003. Alan Young was
on "Escape to Canada" explaining how the law had been
"resurrected" by his Hitzig decision on Oct. 7. The Crown
only dropped charges from Aug. 1 2001 to Oct 6 2003.

R: I know that the OCA in the Hitzig decision of Oct 2003
says the remedy they crafted was to take effect immediately.

I don't know why it took OCA nearly 3 months to sign an
order regarding the decision they released that was supposed
to take effect immediately. And I don't think it's a
coincidence that it was signed the same day as Malmo-Levine
and Krieger were released by the SCC.

JCT: True, it wasn't important. I didn't notice but it was
signed the same day as we lost Malmo-Levine's off-target
"government may prohibit" case and we won Krieger's on-
target "Section 7 is of force and effect" case.

What byzantine goings on in judicial back-rooms. All just
before my Big Three Krieger Medical Prevention Ontario Court
of Appeal appeals challenging the resurrection are heard
before the Big Three move to the Supreme Court of Canada.

R: I don't know if this has any relevancy to the case your
doing right now but I just wanted to make sure you didn't
get nailed on something so small. thanks
