My Battle for Fairness

RS: Sixteen years ago, I had walked into a doctor's office
(who had just begun his career in the medical field)
complaining about a complete erosion of the mouth. My lips
were all swollen and to touch them with your fingers they
would bleed. The doctor (my GP) had prescribed medication
that had no effect. In desperation, I went to the Civic
Hospital where a specialist could not diagnose the cause of
this either but had prescribed something to give me relief.

The miracle drug was called Prednisone. As I tapered off
this medication, this same problem would re-surface. I went
back to my GP explaining to him that the doctor at the Civic
had prescribed me prednisone for this re-occurring problem I
was having and he decided to prescribe the same. For two
years, this went on until another problem arose. After
complaining to my general practitioner, he had sent me to
consult with a specialist who had performed a series of
tests and had then informed me that I was suffering from
Crohn's disease. He well stocked me up with prednisone.

When he had realized that there were problems arising from
the use of this drug (mood problems), he had attempted to
give me sulfasalazine and also placed me on a maintenance
drug called Pentasa. He had sent me back to my regular
physician who would continue to monitor my condition
(through periodic visits to the gastrologist). The
effectiveness of these medications was little to none. My
regular GP then decided to put me back on the prednisone.
Not knowing the consequences and side effects of this drug,
and being told by the physician that damages would be
minimal, I continued to take it.

One day while shaving, I went to rest my hand on the
counter, I felt a numbing sensation in my right arm. This is
when I had realized that my finger was broken. I immediately
contacted my GP who had informed me that I had broken my
finger and asked me how much prednisone I was taking. At
this point, I realized that the drug was the root cause of
the problem. This is also when the doctor admitted that
prednisone does have these types of side effects. Of course
I was scared; I stopped taking the drug immediately.

Less than a week later after discontinuing the use of this
drug, I ended up in the GP office feeling as though I wanted
to commit suicide. He advised me to go to another hospital
and admit myself for psychiatric treatment. Shortly
thereafter my Crohn's was acting up again and I was
prescribed this medication once again. I was reluctant to go
back on this drug and was worried about the side effects but
the GP advised me that this was the only treatment option at
the time along with Pentasa which did not provide me with
any relief.

As time went on, I met my present wife who was pursuing a
Science degree at the University of Ottawa. At this point,
this doctor had me taking a total of 22 tablets to combat my
illness and other symptoms related to my disease. The doctor
kept me on an endless supply of prednisone and also gave me
sample packs of Viox. At this time, I began to experience
severe back pain and hip/joint pains. This is the main
reason why the doctor had given me Viox which would in turn
start-up my Crohn's and a new vicious cycle would begin.

At this point my wife, after witnessing, all my pain and
suffering understood the complications of my disease
more and decided to research it further. We had suspected
that the prednisone was also impacting my mood and
personality negatively along with establishing its numerous
other side effects. She then had a better understanding of
the nausea/vomiting, diarrhea, sweats, pain, and symptoms
associated with my disease. After researching further, it
was evident that several people across the country were
turning to an illegal medication that would bring them more
relief than compared to conventional medicines.

JCT: When did you first hear of the almost-miraculous pain-
killing properties of the cannabis tree flowers?

RS: At no point had the physician warned me of all the
possible serious complications associated with the
medications that he had prescribed to me.

JCT: But people with marijuana exemptions had to have all
pros and cons explained over and over and over and over
again.

RS: After experimenting with this illicit medicine, I came
to realize that it had brought me much more relief than
conventional treatment options with no side effects.

JCT: Again, a recurring testament. It seems to work so much
better than the chemical alternatives.

RS: For the first time in years, I experienced some relief
and comfort. I decided to discuss this further with my
physician and he said that this was unheard of and was not
willing to support me on this matter.

JCT: Ignorant and staying ignorant on the matter.

RS: Since there wasn't any easy access to this illicit
medication, not only was accessibility an issue but fear of
prosecution was a reality. At this time, I was bouncing back
and forth between both medications. During this time frame,
I had confirmed that my violent mood changes were caused by
the prednisone and that it had caused damage to my lower
back and hips causing me to walk with a limp that worsened
over the years.

Three years ago, supply of this illicit medicine was not
only expensive and at times difficult to acquire but there
was also a tremendous amount of risk purchasing off the
streets. Quality varied and lack of weight for the price was
also an issue. I attempt to discuss this on numerous
occasions with my physician asking him to support me in
obtaining an MMAR. I felt that he wanted to further destroy
me with these prescription drugs. However, there were no
recorded deaths or ill side effects associated with this
illicit medicine that I was taking to control the symptoms
of my disease. This is when I decided that his call was
unfair and yet he was not willing to take any responsibility
for the damages/suffering that these medications have
caused.

JCT: Doctors, the lesser engineers. Engineers have no excuse
for violating their professional oaths of integrity with
substandard work, doctors violate their oath with
substandard care due to ignorance and fear.

RS: Therefore, I took it upon myself to try to achieve my
own supply of this medicine. However, this was also proven
to have harsh consequences from the CDSA, law enforcement,
criminal justice system, and not to mention had a negative
impact on my family.

JCT: So you must have been busted to be in front of a judge.

RS: To my surprise, the judge understood my need to medicate
with the medicine of my choice and also acknowledged that he
understood that achieving a medical exemption at that
present time was extremely difficult. Health Canada's
solution was to find a doctor willing to sign, however they
were not able to disclose doctors who support the MMAR.

I thought perhaps they may be able to assume responsibility
for the damaging effects the prescription drugs cause or
maybe the government. My efforts to find a doctor to support
the MMAR seemed impossible as doctors refuse to take any
responsibility for their medications and refuse to authorize
a medicine that is less harmful than a bottle of Aspirin.

JCT: Like Crown Chris Leafloor said in Terry Parker's
examination of discovery, some doctors sign. When
challenged if he knew one, he backed down.

RS: The judge also decided that a criminal conviction on
this matter would not be necessary because there was an
obvious need. However, the judge decided to appoint a
probation officer whose role was to help and monitor my
attempts to obtain a medical exemption. The judge's
probation order allowed my consumption of this medicine.

JCT: So you were convicted even if the judge admitted you
needed your medicine for you to be on probation.

RS: As time went on, I obeyed the judge's orders. For the
upcoming years, I have been able to cope and function a
better quality of life using this medicine. The judge had
failed to specify how I was to obtain this supply of
medicine. However, he had implied that he was willing to
return my equipment but noted that it must have been damaged
and told me it would be best to purchase new equipment. My
interpretation of the judges' comments was that I was to
maintain my own supply.

I did not believe that this would have created problems once
again. Due to my illness, I believe I became an easy target
to the police. They broke into my well secured area that had
a 24 hour monitored security system, arrested me and
tortured me in jail because of my illness. My children were
also taken away when there was no apparent danger and my
wife who does not even consume it was charged as well.

We were both accused of being drug addicts. I could not
believe what was happening. I was totally devastated. I
could not comprehend why I was locked up in jail, and to be
further forced to sleep in my own feces and vomit due to my
Crohn's disease flaring up.

I was released four days later with conditions, one of which
was not to associate or be found with anyone known to
possess such substances. My children were also returned back
home with conditions. I am presently restricted from
medicating myself despite a judge's order. I am also forced
to report any prescribed medications that I will be taking
that will have to be approved by the C.A.S. prior to use. I
have not been able to medicate with the medicine of my
choice for several weeks, I have gone in for a colonoscopy
to assess my condition.

I was told that my Crohn's was severe at this point; my
colon and small bowel are extremely inflamed, several
lesions and fistulas were apparent. At this point, the
specialist does not even know what medication to prescribe
as the two options can have rather serious side effects or
possibly be life threatening.

JCT: And he won't sign an application for the only medicine
you tell him works. What cowards our lesser cousins are?

RS: He mentioned that a CAT scan/MRI and other tests would
be required to assess the level of damages and refused to
place me on the prednisone due to the damages caused to my
lower back and hips. This back and hip pain would also
require further assessment to determine whether it is
degenerative.

A recent newspaper article was published by a specialist
knowledgeable with Crohn's and Colitis. In his report, he
mentioned that new treatment options were necessary at this
point and the present treatment methods are often not
working nor have serious consequences and prohibitive costs
(ie. Remicade is an injection once every 8 weeks for $4000
per shot).

JCT: Maybe government insurance can pay the pharmaceutical
companies.

RS: However, the medicine of my choice does not have any
serious complications associated with it other than the
complications with law enforcement, criminal justice system,
the government, and the C.A.S. I was able to cope very well
with the symptoms of my disease and have not had to have any
medical interventions while using this medicine.

I am extremely dismayed that with my chronic illness and
other associated problems, I am forced to suffer without
type of relief.

I am disappointed by the fact that I am being prosecuted by
the law for medicating myself with the only source of relief
I've had in a long time.

But now we have a responsible Conservative government that
vow to be held accountable to its fellow Canadians and
certainly I hope that they stand up to their promises.

JCT: They've promise not to legalize your medicine.

RS: In the future, I hope that no Canadian should have to
take it upon themselves to research the safety of the
medications that doctors prescribe to them. I hope that no
human and their families ever have to suffer in the way that
we have.

JCT: You have legitimate medical need so you will eventually
qualify to cultivate and possess under the Krieger decision.
As long as doctors can refuse your medication choice, the
access program isn't working. The moment you find a doctor
to sign your MMAR application, you'll qualify and get
everything back and all charges dropped just like Derek
Francisco.

So keep looking till you find a good doctor and win. Finding
an honorable doctor may not be easy but it's the cinch to
get you off the hook.

Till then, go on attack with the Prohibition Kit so you'll
be able to join me, Pierre and Real at our upcoming Court of
Appeal hearing or they'll withdraw charges against you too.

Sure, they caused you much pain and now it's time to cause
the Crown much inconvenience before you win.
