JCT: The Crown is using the Proceeds of Crime Act to seize
Gaetan Millette's home and bar after his conviction for
growing marijuana. Seems it's over a million dollars worth
of collateral they're after and he has two lawyers, the one
who lost his marijuana conviction and the other who is
going to defend the seizure of his assets.
Gaetan filled out the blank appeal form and blank
application for leave to appeal and was booked for hearing
this morning.
Looking like we might have a guy who could pay his lawyers
to go argue Krieger for the first time, it would be better
if the lawyers argued his application for him. His lawyer
was a personal friend.
So Gaetan and his lawyer had a 3-way call with me around 4pm
where I explained how Krieger had been won at the Supreme
Court of Canada and how it could be used to obtain Gaetan's
release pending appeal.
The lawyer didn't know about it and said he'd have to study
up on it. Then I left them to discuss whether the lawyer
would present the argument for his release pending his
appeal.
Then I heard nothing. It ends up that the lawyer told him
he'd need a $100,000 retainer to study the case for a month
(har har har har) and that he'd be better off abandoning his
appeal.
So Gaetan chose to follow his lawyer's advise, abandon his
appeal and lose everything and do his time rather than risk
losing not getting out. Of course, the lawyer is his
personal friend! Har har har har. And the lawyer even filed
his abandonment of the appeal for him. How says a lawyer
can't hop to it when it really matters. (to the Crown, that
is) I wonder how much he charged Gaetan to abandon his
appeal for him?
Every good hero action movie needs some good guys to fall to
the bad guys. Stabbed in the back by his lawyer friend. Har
har har har. Choosing the take the sure loss rather than
gamble on the win. Typical lawyer's strategy. Har har har
har.
