Well my friends I just got back from court, well me and Real
just did and I think it was a good day.

First of all the judge was 2 hours late and then when he got
there and things got started he kicked every one out of the
court room that wasn't involved. So i guess we have a public
ban for shure lol.

Real went first and he told the judge, he wanted to fill a
new application for prohibition. The judge asked what it was
about and Real told him that it was about 3 new appendix
that were missing in the first application and that he
wanted to have them added to his file.

Right away the crown attorney started telling the judge it
was the same thing has the first one we had filed and that
it had gotten dismissed so this wasn't any good and that
they didn't want to accept this.

So Real looked at the crown and said: you wanna get
technical, i want all the transcripts of all the court cases
so far in french that's it then if you dont want to accept
this application I will file an application about my rights
as a french man, I have all the cases of some guy that won
because his rights where violated for not getting the paper
work to defend himself properly,because they where not in is
language.

So right away the crown accepted the new application.

It's so funny how much trouble they are having with us and
they better get use to it cause we ain't going away lol.

I wasn't in Real's court room when it all happen so I dont
know all of what happen there.

So after that it was my turn, when Real came out I asked him
how it went and all he kept saying was dont give up till he
takes it, so I said ok.

First the judge started talking to me in french so the crown
attorney got all pissy there and told the judge it was in
english. The judge looked at me and asked why and then the
crown really got pissy and said it was offered 5 times to Mr
Drouin to have it in french or english ,so I looked at the
judge and told him I was asked once at the beginning if i
could do it in english because the crown attorney Bill
Matwischuk didn't speak french.

To be the nice guy that I am I said no problem lets do it in
english. So I told the judge it was in english.

Then MR Bill(the crown attorney) started bitching about this
new application I wanted to serve saying it was the same
arguement as the last time and that it had been dismiss.

Right away I cut him off and told the judge that I was sorry
but it ain't the same thing, it's close but it's not and
that I had 3 new appendix that I need to add to my file.

So then the crown started talking about the paper he had
served me with some plea bargain on it wich was also telling
me to take the plea for 2 months of jail, 1 year probation
and no fire arms for 10 years, I started lauging out loud.

I said no way. the judge looked at me and said do you
understand what the crown is saying? Yes I do your honnor.
he want's to throw me in jail for 2 months if i plead
guilty, ya right the last time he had offered me 1 month
house arrest. what's going on here today. No your honor I am
not pleading anything and dont accept his deal.

The judge looked at me like he was pissed off. So I told him
sorry your honnor but section 7 cultivation has been struck
down since 2002 and there was no proceding done or any
follow ups, it's still stuck down. The judge looked at me
and said: so what your saying is every one in canada can
grow marijuana legally, that's exactly right your honnor, he
started laughing.

Then he went back to the paper the crown had served me and
said: so what your saying is that you dont want to take this
deal of 2 months of jail and stop all this right now, that's
correct your honnor. if this application gets dismiss like
the last one, then I will appeal the decision, I will take
it to the toronto court of appeal and then to the supreme
court where this Krieger case happened.

The judge wasn't impress with me because I was being
cocky, like I just didn't give a shit anymore.

So he told me to serve the crown and after the court has
over to go to the clerk and serve another judge. So I did
that and the crown was bitching that this was gonna drag on
and on, so I responded it already has for 24 months now
makes no difference to me am going all the way to the
supreme court of canada in ottawa.

Then the crown started bitching he was ready for trial, so I
responded that I wasn't even close to being ready for trial
so they put off the trial till september 2005 for a date to
set a date. lol whatever hey.

So then the judge told that I would need to come back on
july 15th, 2005 but not to argue my motion (what the hell
they will have the application for 3 weeks, isn't it 3 days
notice) but anyways on july 15th it's to set a date to argue
my get ride of prohibition application.

Am also in court on july 25th, 2005 for 5 weapon charges
(they incriminaded me with weapon charges after wrongfully
busting me with a dead law)

So that was our day in court, the batlle still on people
lets kick there ass.

O and I overheard the crown talking and he was saying we are
the first one to represent ourself ever here in the north
for such big charges and that he was proud of us not giving
up, so I wink at him and he started laughing and so did I.
it was a little weird, like he knew we are right.

But anyways my back is killing me from the 6 hour ride so am
gonna go rest, you all have yourself a wondefull day.

P.S. I will be getting my exemption to possess and cultivate
marijuana next tuesday in toronto but will not pull it out
until am in supreme court lol(that's my ace John) lol lol
lol

JCT: You're not supposed to let them know when you get it.
Not before challenging the existence of the law. It's your
Ace in the hole if you lose.

It also keeps a friendly beacon shining brightly (and it's a
*sensible* one, no less... it's not just some dumb-assed,
pie-in-the-sky "symbol" like a flag, a corporate seal or a
nifty letterhead,) on behalf of all those who'll never stop
hoping for the day their medicine is truly *theirs*... and
who'll never - EVER - stop prying at the chinks in our

JCT: Actually, Pierre and Real are our best shots because
they can raise a challenge to pure Section 7 cultivation
charge. When the Crown tries to raise Hitzig, "that's
section 4, not 7." Or Malmo-Levine "that's section 4, not
7." The only relevant case law on section 7 is Krieger! And
Pierre and Real won't allow anything not relevant to section
7 to get in. Can't wait for the 15th. They're booked to be
heard no matter what the judge said. I wonder why he said it
wouldn't be heard?
