Dear Sir:

Enclosed please find the materials which you are attempting

to file with this office. As I had told you previously, you

must attend the Dec 03 2004 date FOR THE SOLE PURPOSE OF

OBTAINING A COURT DATE.

Once you get a trial date with the trial co-ordinator, you

will be in attendance on December 3, then you can proceed to

file the proper application to be heard on the date of the

trial.

Please note that I am sending a copy of this letter to the

Crown Attorney as well. Yours truly,

JCT: STUPID DONKEY OF A WOMAN. This is a motion pre-plea

motion to quash before a trial date is set. How can Pierre

choose a date for a trial before he finds out if the charge

is quashed?

Wouldn't she like it to be FOR THE SOLE PURPOSE OF OBTAINING

A COURT DATE but section 601 says the accused may object to

indictment prior to plea and her ignorance doesn't take away

that right. It just costs Pierre a 3-hour drive for nothing

if it's put off



These pre-plea motions are going on all around the province

and none of them are dependent on getting a trial date

first. Her free legal advice is worth just that, nothing.

So the judge won't have had the chance to read the motion

due to the "judicial secretary." Sad to think a little

knowledge goes to their heads. Unfortunately, it is little.

Remember the secretary who decided Parker hadn't served his

documentation right so she didn't tell the Crown and they

didn't show up for Parker's Pitt hearing!

The only question is whether this is the clerk's own idiot

opinion or whether she got advice from the Crown on how to

stall the case.

The judge should still permit the motion to be heard despite

the secretary's legal ruling. Especially when Her Worship is

wrong. We'll see.

The worse case scenario is for the Crown to demand his 30

days notice which gets it put off to November 17 maximum.

The ruling of legal secretary should be easy to set aside.

Maybe I should write up a joke motion to "set aside the

ruling of the judicial secretary?" Har har har har. Wouldn't

that make the point that she stuck her nose in where it

didn't belong.

A small group of marijuana cultivator's will present a

motion this friday the 3rd of December, to quash marijuana

cultivation. The members of the group are representing their

own self and will present the motion, wich is to be heard as

soon as a date is availble, as some members of the group

have been awaiting trail for 17 months all ready.



The main argument for this case is that, There is No Laws on

cultivation , so there's No Force , No Effect, and that is

since the Parker ruling had given the gouvernement 1 year to

amend the law .



Nothing had been done after that year , and the only thing

the gouvernement did was to make things even harder .

The Gouvernement has failled to provide and give easy acsess

to marijuana , so the rulling was in full effect wich

started August 1st 2001 , and is ongoing , meaning that you

can grow marijuana as there is no more laws in effect

regarding it. " No force No effect" .



Cultivating marijuana use to give you a maximum sentence of

6 years , why is it then , that no one go's to jail for it ,

small fines and house arrest only . That is because the laws

are no longer in effect since august 2001 .



The group have selected John Turmel and Robert Neron, well

known marijuana advocate and activiste to speak on the

groups behalf .



The group will protest all day Friday December 3rd 2004 in

front of the Cochrane Superior Court of Ontario. The general

public , activiste and any one who's ever gotten charged

with marijuanna are invited to participate in a day of

protest and education .

alors le jugement Parker et effectif depuis le 1 Aout 2001,

et qui et encore en effet jusqua date , voulent dire qu il

n'y a pas de loi sur la cultivation de marijuana ." Pas de

La cultivation de marijuana vous donnais une sentence

maximum de 6 ans , alord que tout se qu'il ont maintenent

ses des petitte amende ou d'une sentence conditionnelle (
