WILL THE FDA ALLOW PSYCHIATRISTS TO SELL OUT CHILDREN DUE TO VESTED INTERESTS IN KEEPING THEM DRUGGED

FDA Hearing on SSRI Antidepressants for Children: Psychiatric Damage Control Tries To Preempt Findings

With the FDA hearing on February 2 into Serotonin Reuptake Inhibitors (SSRI), antidepressants causing suicidal behavior in children and adolescents, the psychiatric industry has been accused of trying to preempt the findings by issuing reports obfuscating the risks of the drugs. 
 
On January 19, the American College of Neuropsychopharmacology (ACNP), a task force with 9 out of 10 members having significant ties to pharmaceutical manufacturers, claimed that antidepressants banned in Britain for children do not raise the risk of suicide. However the task force ignored  the information used by British regulators. The psychiatric watchdog group, Citizens Commission on Human Rights (CCHR), says such reviews are mere damage control, aimed at protecting psychiatric and pharmaceutical interests, not patient care, in an effort to ward off an onslaught of suits similar to those in the 1980s involving psychiatry’s then “miracle pills,” neuroleptics.
 
Next month’s FDA hearing is in response to British regulators recently banning the prescription of SSRIs to under 18 year olds because clinical trials show the potential side effect of the drugs to cause suicide, hostility, or self-injury. The FDA is to review the suicidal outcomes in over 4,000 children and adolescents exposed to SSRIs in clinical trials.  Despite international concern about these risks, the American Psychiatric Association (APA) has yet to issue a warning to psychiatrists to cease prescribing these drugs.  If the FDA findings substantiate British drug regulators’ concerns, psychiatrists and the APA could face massive litigation because of their failure to inform.
 
In the 1960s, the APA also refused to warn its members and physicians about neuroleptics causing Tardive Dyskinesia (TD), an irreversible neurological disorder manifesting in facial tics and uncontrollable twitching. Award winning medical journalist Robert Whitaker, author of Mad in America, said, “Year after year passed and the APA made no effort to educate its members, while the tally of Americans afflicted with TD climbed at a rate of more than 250 people per day, and still the APA did nothing.”  It issued a warning only after “several highly publicized civil lawsuits found psychiatrists (and their institutions) negligent for failing to warn patients of this risk, with damages in one case topping $3 million,” writes Whitaker. “This foot-dragging obviously told of a stunning disregard for the mentally ill,” he said.
 
In his book, Prozac Backlash, Harvard University Medical School psychiatrist, Joseph Glenmullen, reports SSRIs can also cause TD. He researched thousands of cases of four different side effects of SSRIs causing “loss of motor control,” including neurologically driven agitation leading to severe panic.  FDA Adverse Reaction Reports also show that in the early 1990s, 83 children between the ages of 4 and 18 attempted suicide while taking one SSRI, two children aged 5 committed suicide, and 77 experienced hostility, agitation and intentional injury. Today, about 1.5 million American children are prescribed these drugs.
 
CCHR summarizes its other concerns:
 
  • The FDA hearing comes at a time when Congress is considering passage of the Child Medication Safety Act that would prohibit school authorities from forcing children to take SSRIs and other psychiatric drugs. Parents have been threatened with charges of medical and emotional neglect for refusing to drug their child, and children have died after being required to take the drugs to receive educational services.
 
  • The APA opposes the bill that would protect parents’ and children’s rights. James Skully, M.D., medical director of the APA and a director of the APA’s American Psychiatric Foundation (APF) is particularly critical of the legislation. CCHR says this is another example of the APA’s “stunning disregard” for children, fueled by the unholy alliance between the APA and Pharma. Both the APA and APF receive substantial annual funding from pharmaceutical interests totaling more than $15 million.
 
  • Clinical trials for psychiatric drugs are based on the APA’s Diagnostic Statistical Manual of Mental Disorders (DSM) that many medical experts condemn as unscientific. Dr. Sydney Walker III, neurologist, psychiatrist and author of A Dose of Sanity, said DSM has “led to the unnecessary drugging of millions of Americans….”
 
  • With over a million children said to be suffering “depression” and prescribed SSRIs, Dr. Glenmullen says, "…the symptoms [of depression] are subjective emotional states, making the diagnosis extremely vague.”  Referring to the DSM inspired rating scales for depression, he said they are "designed to fit hand-in-glove with the effects of drugs, emphasizing the physical symptoms of depression that most respond to antidepressant medication…While assigning a number to a patient's depression may look scientific, when one examines the questions asked and the scales used, they are utterly subjective measures based on what the patient reports or a rater's impressions.”
 
  • The APA created the market for drugging kids by fabricating disorders and then convincing people that they exist.  Medical doctors agree that the DSM is nothing but junk science and the FDA shouldn’t be relying upon it to approve any psychotropic drug.

Bruce Wiseman, national U.S. president of CCHR, says, “More than a decade ago in the U.S., we presented evidence of these drugs causing violent and suicidal behavior. Since then thousands of adverse reactions and deaths have been reported to the FDA from the use of these drugs. Yet psychiatrists continue to defend them with a vengeance and freely prescribe the same suicidal-inducing antidepressants that were just been banned in the UK. Psychiatrists and the FDA knew about this data but didn’t want to bite the hand that feeds them—pharmaceutical interests.

“The FDA investigating these drugs comes too late for the many children now dead because of being falsely labeled as mentally disordered and needlessly subjected to these ‘killer pills.’ It is not too late for those children not yet labeled, and the FDA needs to fulfill its original purpose, which is protecting the public health, and particularly that of our children.”

The Citizens Commission on Human Rights was established by the Church of Scientology in 1969 to investigate and expose psychiatric violations of human rights.

I second Dr. Harte's motion!!  I see much less sickness and much faster recoveries in those who are under regular chiropractic care (regular meaning a check up at least every 4 - 6 weeks, and adjustments when indicated.)  It's all about nerve pressure!

I don't often post here either, but I have to speak up for Lloyd's concern.  I don't think he is putting his foot in his mouth, but simply raising a red flag.  Scientologists have been frequently accused of operating OTHER scams.  It makes sense to wonder if this one is a scam as well.  Lloyd raises a good question we should all think about.
 
Personally, I haven't seen anything about CCHR that suggests it is like other Scientology operations.  For one, they are not asking or demanding exorbitant amounts of money that their other programs do.  I am not fond of their rigid and militant denouncement of anything related to psychiatry and psychology.   But it does appear, so far, that they are offering a valuable service to the alternative health community.
 
Kim, I am glad to hear that your experience with them is so positive and that they helped your son.

I don't know what your credentials are; if you're a journalist, medical researcher, lawyer, etc., but I can rest assure you that CCHR is NOT a scam!  I am not a Scientologist, but I've worked alongside CCHR dealing with adhd fraud.   Dr. Fred Baughman, a Board Certified Neurologist, also works alongside CCHR and has been instrumental in bringing to the forefront the absolute fraud perpetuated by the psychiatric community in its deceptive and fraudulent practice in claiming adhd is a bona-fide disease, which it is not.
 
I'm a former legal assistant; my husband is a Partner with a Silicon Valley law firm in California.   We don't align ourselves with any endeavor lightly when it comes to this issue.  In other words, we're not ignorant.  Our son was fraudulently diagnosed as having adhd by a psychiatrist in San Ramon, California.   At the time of our son's "diagnosis," it was strongly suggested by our son's school we drug him.  Our son was not a behavioral problem (nor is he now) at this time; however, we were told our son would be able to achieve much more academically if we put him on Ritalin.  After much hesitation and concern for our son's welfare, we caved and gave our son this drug.  We witnessed total manic behavior in our son within just a few short days afterwards. 
 
As one leading medical journalist stated in an article dating February 16, 2002:
 
"There is no drug that can cure modern psychiatry.  This is a profession that is close to routinely practicing medical terrorisism by shamelessly over-prescribing drugs to people OF ALL AGES (emphasis mine), often for phantom diseases and for purposes that have no rational basis in science."
 
I would strongly urge those of you interested in this topic to visit Dr. Fred Baughman's website, http://www.adhdfraud.org.  I found out about Dr. Baughman through CCHR.  I can't thank this group enough for all of the help and information they've shared with me.
 
I've seen you make this statement before about this group, Lloyd, and I can't tell you how much it upsets me.  I don't often post on this site, but I just couldn't ignore this one.  I've no idea what's going on with the Narconon project.  But I am very aware of the many highly esteemed professionals who've aligned themselves with CCHR in helping to expose the scams thrust on our society by the psychiatric community. 
 
I'm fortunate in that I can stay at home and homeschool our son, who is now 10-1/2, through our school district.  With the help of Ryan's other teachers and play groups through our homeschool support group, he's now thriving, sans drugs.  There was absolutely nothing wrong with Ryan, but because his learning style is so entirely kinesthetic, neither public nor private schools were a "fit:" for him.  With CCHR's help, I now have my son back.
 
So, please, Lloyd...before you put your foot in your mouth about this group, please visit some of the links attached to CCHR's website.  I'm sure you'll be amazed.
 
And just so you know...many of the folks who have worked tirelessly with CCHR regarding adhd issues are NOT Scientologists, nor are we.

project of Scientology, which also has the Narconon project [not to be
confused with Narcotics Anonymous or Nar-anon, which are legitimate 12 Step
groups]. Narconon charges huge fees, using brain-washing methods on drug
addicts to get them to entice other dupes into paying huge fees for the same
disservice. CCHR is probably similar to Moon's propaganda with the
Washington Times and Tom Delay's Prisoners' org. There are many scams going
on in the U.S. and we need to be careful not to support such people thru

CCHR is likely a scam, i.e. a Wolf in Sheep's Clothing type of scam. It is a
project of Scientology, which also has the Narconon project [not to be
confused with Narcotics Anonymous or Nar-anon, which are legitimate 12 Step
groups]. Narconon charges huge fees, using brain-washing methods on drug
addicts to get them to entice other dupes into paying huge fees for the same
disservice. CCHR is probably similar to Moon's propaganda with the
Washington Times and Tom Delay's Prisoners' org. There are many scams going
on in the U.S. and we need to be careful not to support such people thru
ignorance. LK

Great news! The Association of American Physicians and Surgeons (AAPS)
<http://www.aapsonline.org/>
with a membership of several thousand private doctors, has has stepped up
to the plate in the Yurko case.

At their annual meeting in Orlando, Florida (18-19 January 2004), AAPS
voted unanimously to submit an "amicus curiae" brief (volunteered opinion
or "advice" to the court). This will add immeasurable support for the
evidence accumulated since the conviction that demonstrates Alan's
innocence.

AAPS is one of over 115 organizations around the world committed to
Alan's release and to bringing reform to issues of vaccine safety and
medical error.

The case approaches resolution with an upcoming evidentiary hearing in
the courts. The office of Judge C. Alan Lawson contacted Alan's attorney
on 19 December 2003 to advise him that an evidentiary hearing had been
granted, but that the date had not been set.

A 16 January 2004 letter to Alan from his attorney indicates that some
additional legal wrangling by the State Attorney must still be addressed
before the date can be arranged. So apparently things are a bit more up
in the air than thought. Such is life in the justice system. However, the
support of AAPS strongly reinforces positive results. We will keep you
posted.

Meanwhile, this "delay" gives us more time to raise needed funds, and all
YP supporters are urged to continue the fund-raising effort. If you have

Dear Friend,

Alan Yurko has been in jail for 6 years, falsely convicted of killing his
infant son by shaken baby syndrome (SBS). Before his false arrest and
conviction, there was little help out there. After his incarceration, the
Yurkos began their trail-blazing odyssey of researching SBS and
contacting professionals to review the case. In that time, the case has
gained international attention and recognition in newspapers and other
publications---including a number of medical journals---and on the
Internet. Due in great part to the Yurkos' and their supporters' efforts,
help is growing.

Although the work the Yurko Project and others have done has already
helped prevent many convictions, very few false convictions have been
reversed. At any rate, no case is as "notorious" as this one, especially

A Pox On Your House? Please Call!
Chicken pox parties may be back in vogue

When she was 7 years old, San Francisco resident Eos de Feminis remembers,
she attended an out-of-the-ordinary slumber party. "It was unusual, because
we lived across the street from them, so we normally wouldn't spend the
night," recalls de Feminis, 36. More notable was the fact that at least one
of the kids at the party had broken out with itchy, red sores, and De
Feminis was there to deliberately get infected, too.
Though chicken-pox parties like the one de Feminis attended have fallen out
of favor in recent years, they may be making a comeback. Despite the
medical
establishment's warnings about the risks involved, some parents are more
concerned with the potential side effects of vaccines -- believed to
include
autism, as well as learning and hyperactivity disorders -- leading them to
seek alternatives to vaccination for some childhood diseases.

San Francisco librarian Ren Volpe became interested in chicken-pox parties
because her daughter, Isabella, will soon enter kindergarten. "Now that my
daughter is almost 4, it's time to start thinking about this, because the
public schools require that children be immunized or have proof of having
had the disease," says Volpe.

"It's not that I'm against all vaccines," she says. "There are other
diseases that I am happy to vaccinate against, like polio. But I just don't
see the necessity to vaccinate against a disease that is, at most,
uncomfortable and inconvenient, especially when we don't know the long-term
effectiveness of this vaccine."

Volpe also notes that catching the disease naturally is more effective than
conventional immunizations against it. "The immunity you get from the
'wild'
version of chicken pox is lifelong," she observes. "At this point, even the
vaccine makers do not know how long the vaccine provides immunity. We are
taking the chance that our children will get chicken pox in 15-20 years as
an adult, which is apparently much worse, with more complications and
higher
death rates."

"My memories of being sick as a child are actually quite pleasant," Volpe
recalls. "I got to sleep in my parent's bed during the day and eat special
food and get my forehead stroked." Not that the experience will necessarily
be so painless for her 3-year-old daughter, she admits, acknowledging the
discomfort and itchiness characteristic of chicken pox, though she adds,
"Personally, I would love a reason to take a week off from work and stay
home with my daughter."

Indeed, although the idea of deliberately exposing children to virulent
diseases at parties may seem like a trendy, New Age kind of approach to
disease prevention, it harkens back at least 350 years. Lady Mary Wortley
Montague (1689-1762), wife of the British ambassador to the Ottoman Empire,
discovered in her travels that the scourge of smallpox, which had been so
devastating in western Europe, had been largely contained in present-day
Turkey due to the practice of deliberately infecting children with small
quantities of the smallpox virus.

In a letter from 1717, Montague writes, "The small-pox, so fatal, and so
general amongst us, is here entirely harmless, by the invention of
ingrafting, which is the term they give it." She describes parties that
were
widely held at the time: "People send to one another to know if any of
their
family has a mind to have the small-pox; they make parties for this
purpose." She then describes the process, wherein a bit of the smallpox
virus is introduced through a scratch in the arm or leg in order to infect
the child. Noting the procedure's success, she continues, "Every year,
thousands undergo this operation, and the French ambassador says pleasantly
that they take the small-pox here by way of diversion, as they take the
waters in other countries. There is no example of any one that has died in
it, and you may believe I am well satisfied of the safety of this
experiment, since I intend to try it on my dear little son."

After her son's successful ingrafting, Montague subsequently promoted the
concept in England and other parts of Europe, where it became a widespread
practice. In 1796, Dr. Edward Jenner furthered this technique when he
discovered that deliberate exposure to cow pox, a disease not fatal to
humans, also prevented contraction of the deadly smallpox. Rather than
patent his discovery -- a method he termed vaccination, from the Latin word
for "cow" -- Jenner offered up the information freely so that even those in
poverty would be protected against the dreaded disease.

Chicken pox is, of course, a much milder illness, particularly when
experienced in childhood. Less than a generation ago, most people, as
children, naturally contracted chicken pox from others and gained lifelong
immunity. But nowadays, doctors are vaccinating against chicken pox rather
than allowing the disease to spread from person to person. (The commercial
chicken-pox vaccine was developed less than 30 years ago, and doctors
started recommending vaccination of all children in 1998, with controlled
doses of live viruses administered to the patient by health-care
practitioners.)

Dr. David Tejeda, chairman of pediatrics at San Francisco's California
Pacific Medical Center, understands the concept behind pox parties but
states, "As a medical professional, I wouldn't recommend chicken-pox
parties, because of the risk." He notes, "Most cases of chicken pox are
mild, but there's a chance that if you get it 'wild,' it may be more severe
and [may] in some rare cases lead to complications like pneumonia and
encephalitis. With the vaccine, you don't have that risk." Dr. Michelle
Perro of the Elizabeth Medical Center in San Anselmo agrees, stating, "You
can get virulent skin infections, pneumonia and cerebellitis" from a
case of
chicken pox.

However, Eos de Feminis disputes these warnings, claiming, "Staph
infections
and other complications, a lot of times, are an end result of antibiotics."
A 1998 study from the Centers for Disease Control and Prevention
corroborates her statement, finding that in some cases, the use of
analgesics, antibiotics and steroidal medications to treat chicken pox
increased the severity of the disease and associated complications.

Still, Perro contends that the vaccination is preferable to the "wild"
virus
contracted naturally. "I frown upon chicken pox parties, because the
disease
is not as benign as some people think," she says. However, she agrees that,
unlike "wild" chicken pox, the vaccine's efficacy is not lifelong. "No
vaccines last a lifetime," she says. "You should get boosters every 10
years."

And, Tejada notes, "1 to 2 percent will still get chicken pox [even after
vaccination], but it will be relatively mild -- there will only be a
handful
of pox," as opposed to an average of 200 red and itchy spots with cases of
naturally occurring chicken pox.

Ren Volpe believes the bottom line is the reason behind the medical
establishment's endorsement of commercial chicken-pox vaccinations. "I
believe that the reason the vaccine is being pushed is twofold: There's
money to be made by the pharmaceutical companies -- lots of it, if every
child in the country must get the vaccine -- and also because so many
mothers now work," she says. "Most of us do not have employers that are
family friendly and cannot afford or are not allowed to take a whole week
off to be with a sick child. This is all about work and money and business,
not our children's health."

Volpe, however, is willing to take the chance. "The risks are slim,
compared
to the risks associated with getting chicken pox as an adult," she says.
"Chicken pox is a relatively benign childhood disease, albeit uncomfortable
and inconvenient."

Eos de Feminis agrees, observing, "For most kids, a case of poison oak is
worse than chicken pox." De Feminis recalls the pox party she attended,
held
in 1974 in her native Switzerland. "A bunch of the kids from the elementary
school, about six or so, spent the night at our neighbor's house," she
recounts. "Then, in a couple weeks, I got a very mild case of chicken pox,
with about 10 spots. The parties were standard procedure back then."

Even Dr. Michelle Perro herself has not yet immunized her young daughter,
hoping she will contract chicken pox naturally. A pediatrician with a
diploma in homeopathy, Perro recommends an alternative for those parents
uncomfortable with vaccinating their children. "We offer homeopathic doses
of the varicella [chicken-pox] virus, which a large population of our
clients prefer." She reports that she and her associates have not heard of
any children contracting chicken pox after receiving the homeopathic
treatment.

However, Perro adds, "once adolescence starts, chicken pox is a much more
serious disease, and if you get it as an adult, you can get profoundly ill.
If my daughter hasn't gotten it by the time she's 8, I'll have her
immunized." De Feminis, however, is hoping to replicate her own childhood
encounter with chicken pox -- she's looking for a chicken-pox party her
4-year-old daughter can attend.

Alternative to the sting of a failed flu vaccine

This year's flu season has been hyped by the medical profession and its
governmental minions more than the "Lord of the Rings" and the Iowa
caucuses
put together. They mean to cause frenzied demand for the flu vaccine, now
and in the future -- especially the future.

Is demand for the flu vaccine, to the point of panic, being artificially
created? Within one month last year, at least three stories forced the
issue: In Science magazine, we saw "Are we ready for pandemic influenza?"
(Nov. 28). Then, USA Today ran "Next flu pandemic could wreak global havoc,
scientists warn" (Dec. 4). And AOL News lead with "Western flu outbreak is
the worst in 30 years" (Dec. 17).

Let's go back a few years. Besides disco, the '70s can be remembered for
the
swine flu catastrophe. This was the first big push by the medical
profession, through the media, for the flu vaccine. We were warned of dire
consequences if mass vaccination was not achieved from this "killer
strain."
If you are older than 40, you might remember the television coverage of
President Gerald Ford rolling up his sleeve for his flu shot.

At the same time, a survey of practicing physicians showed that, without
exception, every doctor surveyed stated that they would not administer the
swine flu shot to their own children. The result? Claims totaling in excess
of $1.3 billion were filed with the U.S. Department of Justice because of
injury or death due to these shots. The suits claimed that the shots caused
517 Americans to become afflicted with Guillain-Barré syndrome (an
auto-immune disease that can cause severe weakness and pain and
paralysis of
the limbs and face), of whom at least 23 died.

Because of the method of manufacture, every year, by its very nature, the
flu vaccine is out of date before it is even released. It can only offer
partial protection for flu strains that happen to be closely related to
last
year's favorites that have been selected. When public health officials warn
of a "killer flu" or a "possible pandemic," they expect a significant
genetic shift in flu strain, and this is when they insist most strongly on
people rolling up their sleeves for the vaccine. The trouble is, in these
cases of "transgenic shift," the vaccine of the far-removed flu strain
becomes near useless. According to Barbara Loe Fisher, of the National
Vaccine Information Center, "Public officials knew last spring that it was
highly unlikely that the A/Panama strain in the current vaccine was not
going to protect against the mutated, more dangerous A/Fujian strain (of
this year)."

Evidence of the vaccine's ineffectiveness abounds. A 1999 Dutch study, for
instance, reported on a home for seniors, where 49 percent suffered from a
severe flu, though two-thirds were vaccinated. Meanwhile, 48 percent of the
nonvaccinated population got the disease, whereas 50 percent of those who
were vaccinated got it.

A former chief vaccine control officer of the FDA, J. Anthony Morris, has
said: "There is no evidence that any influenza vaccine thus far
developed is
effective in preventing or mitigating any attack of influenza. The
producers
of these vaccines know that they are worthless, but they go on selling them
anyway."

Is the flu vaccine safe? The strains of influenza within the vaccine are
inactivated with formaldehyde and preserved with Thimerosal, a mercury
compound. Aside from possible danger from the active biological agents,
isn't it biological common sense not to put poisons such as formaldehyde
and
mercury into your veins? The world's leading immunogeneticist, Hugh
Fudenberg, stated that if an individual has five consecutive flu shots,
instead of two, one or no shots, his/her chances of getting Alzheimer's
disease are 10 times higher. He said that the causative agents in the flu
shots were aluminum and mercury, with a gradual buildup resulting in
cognitive dysfunction. In the "Essential Guide to Prescription Drugs,"
adverse effects for the flu vaccine include anaphylactic shock,
Guillain-Barré syndrome, pericarditis (inflammation of the covering of the
heart) and kidney damage.

The immune system protects us from the flu, as well as any other infectious
disease, and strives to get us well again when we do fall ill. That immune
system, like every other system in the body, is coordinated and controlled
by the nervous system.

Chiropractic allows a better-running, healthier nervous system. Ample
literature supports the successes of chiropractic with infectious disease.
For instance, a study published in 2000, from the Anglo-European College of
Chiropractic, showed chiropractic adjustments leading to increased serum
IgM
levels, an indicator of immune function.

The Great Flu Pandemic of 1918 was the greatest plague of modern times. It
is estimated to have killed between 25 million and 40 million people
worldwide, about half a million in this country. History shows us that
those
under chiropractic care during the flu pandemic had a far better chance of
survival. One example: medical doctors in Davenport, Iowa, treated 93,590
patients, with 6,116 deaths -- in other words, 1 out of 15 under medical
care succumbed to the flu. At the Palmer College of Chiropractic in
Davenport, 1,635 flu cases were adjusted, with only one fatality.
Outside of
Davenport, chiropractors adjusted 4,735 flu cases, with only six deaths
-- 1
out of 866. In 1919, Palmer published "The Flu and You." The ratio of flu
cases cared for versus deaths were as follows: Medical care: 1 out of 17
died. Osteopathic care: 1 out of 36 died. Chiropractic care: 1 out of 886.

Christopher Kent, president of the Council on Chiropractic Practice,
sums up
the issue nicely: "Flu shots seem to be more a product of cultural
superstition than science. Think twice before rolling up your sleeve." Good
advice? You, too, can be smarter than President Ford!

Jefferson City, Missouri;

The Joint Committee on Administrative Rules (JCAR)  has agreed to a
hearing on the department of health's proposed rule which would add
the
chickenpox vaccine to the proposed list of those required for
admission
to school.

The hearing is scheduled for Thursday, February 5th upon adjournment
of
the house and senate.   That will probably be around 11:00 to 12:00.

Anyone wishing to testify or otherwise participate in the hearing is
urged to contact me so we can coordinate our response.  JCAR has asked
that we strive to avoid redundancy in our testimony.

This is a good first start to getting the new rule removed. If the
committee agrees that the rule is inappropriate, the issue will go
before the rest of the legislature where a simple majority is required
to reverse the rule.

I've had  a HUGE interest in my homeopathy online class - I will be
starting the 13th one Monday, February 2, 2004 & anticipate it will last
about 2 - 2.5 months

Register early - I may have to limit the size of  this one, as there is a
maximum that I can work with.

Many of you didn't seem to be able to do the 4 month comprehensive course so
I decided last year to divide the course in half (basically) - I have
divided it
into Basic and Advanced.  The Basic class will cover the laws and
principles and how to use the repertory and take a case so you can use this
with your family as soon as possible (see outline below).   The Advanced
class will cover more
details about homeopathy (more details about the lessons that were introduced)
for those who want to know more.  More on this as
you get closer to finishing basic.

This basic class should last about 2 - 2.5 months and will require study
time of about 2-3 hours a week maximum.

Spread the word to others you know - friends, relatives other email lists,
webboards etc. Please refer anyone you can think of as this information is
vital to avoid the allopathic system!  If you were in one of my previous
classes and didn't finish, contact me about transferring into this one.

I know how important this information is in moderating vaccine dangers
lists for several years.  You have to be prepared for illness, whether you
are vaccinating or not vaccinating.  All the childhood illnesses can occur
in vaccinated and unvaccinated as well as other illnesses.  And all are
treatable with homeopathy - many times on your own and sometimes with
backup from a homeopath.  Certainly it is my experience that unvaccinated
children are usually healthier, though.

I am a Registered Nurse and have left that behind & have been a 22 year
student of homeopathy & completed my formal homeopathic education in
January of 2003.. 
I am currently seeing patients on my own here in the UK.  I am able to do
some long distance cases by phone interview if it is
accompanied by a video of that session but am not seeing many patients at
present due to travels (I also own a travel tour company -lots of interests!).

I am passionate about homeopathy!  I share wherever I go.  I was cured of
serious migraines with homeopathy about 8 years ago (cured within 2
months!).  I also teach about the use of homeopathy for acute
problems or first aid.  Whether you are treated by a homeopath for a
chronic or acute problem or you are treating at home for acute things, you
will be amazed at how wonderful it. is.  Everyone needs to be prepared for
illness and this is something you can use yourself instead of putting
yourself at the mercy of the medical system and the constant pushing of
vaccines and antibiotics and steroids.

Sheri's course on Homeopathy is well-taught and *very* comprehensive,
touching upon every possible subject you could think of in an Intro
Course.  To give you an example: 
       
        I was only about halfway through Sheri's course when I attended my
first Homeopathy Study meeting offered through the NCH (National Center
for Homeopathy).  The people meeting within this study group had been
doing so for almost four years, and a few months prior to this meeting
the lady who ran it said that they didn't want to have to regress for a
"newbie" or go over the same old things again.  But I insisted that I
wouldn't be a burden and wanted to attend.  To make a long story short,
I went in December and was surprised to find that I knew and understood
over 90% of what was taught and discussed at that meeting (and I even
already had some of the books they were using!).  I had Sheri's
teachings to thank for that.

Prior to Sheri's class I had read Miranda Castro's book, but Sheri
brought it to life in the best way possible.  She made the pages come
alive and made understanding new concepts very enjoyable.

If you're at all interested in learning about a non-allopathic way to

always felt that allopathic medicine was too "generalized" for the
population. That one cold remedy can relieve symptoms for millions of
people that are individuals simply never made sense to me. This course

I started teaching an online class on the Dangers of Vaccinations earlier
in January and have had a huge response.
I have had to limit the size of the first class, but have decided to add a
2nd class, starting Monday, 02 February.

Many of you are new to this issue or have come to it because your child was
harmed by vaccines or some of you know parts of the puzzle but don't know
the whole picture of why vaccines are dangerous.

It is hard to get this from participating from an email list, although they
are important to keep up to date, ask questions of other parents and
professoinals and to have the support the list offers.

By taking this online class, you will:
1.  Learn all of the aspects of vaccines and why they are dangerous
2.  Be able tell others with a stronger knowledge base about vaccines
3.  Have a ready resource of information in your files on your computer
4.  Be able to ask questions of me

Robert Lee Marion, Psychiatric Survivor, Wins $975,000 Jury Judgment
After Being Locked Up in Psychiatric Unit and Forcibly Drugged.

Robert Lee Marion went to a hospital for diabetes. But he was held
because he was considered "mentally ill," and force injected with
psychiatric drugs. A law clinic took up Marion's cause, and now a jury
has awarded him nearly one million dollars. Prof. William Brooks at the
Touro Law Center directs the mental disability law clinic. Brooks said:
"The award sends a message to psychiatric hospitals and doctors that you
can't routinely admit someone and label them dangerous ... and inject
them with mind-altering drugs because you have a desire to treat them."

Email letter sent to IOM as well as NAA (who was copied). In early February 2004, I will be working on a
letter regarding cutting the budgets of the IOM, FDA, NIH and CDC, so that parents can contact various
US Senators and Congressmen/women as well as those running for the 2004 election for President.
As everyone knows, 2004 will be an election year and therefore Democrat and Republican politicians in
Washington, DC will be more attuned to what people are saying. If the IOM, FDA, NIH and CDC are just
another arm of the pharmaceutical companies and don't represent the people's interests, then it is time to decapitate
that arm since we, the people, pay their salaries.

Congressman Dan Burton and others have noted that representatives of the CDC, FDA and NIH have financial
connections to the pharmaceutical industry. At the same time, they are putting these interests ahead of the needs
of families and their children/adults with autism that have been damaged by the vaccines. For years, I and other
parents have lobbied the CDC and the NIH to look into the vaccine link to autism and fund clinical research that
would replicate the work of Dr. Vijendra Singh and Dr. Andrew Wakefield. We have been ignored so we have
no other recourse then to take this action. Even Congressman Weldon and Congressman Burton have done the same
and they have been ignored. Therefore, the course of action we will pursue has been long overdue.

Our organization, The Autism Autoimmunity Project, has documented the autism epidemic in "The U.S. Autism Epidemic:
Our Bitter Harvest" (see http://autismautoimmunityproject.org/shame.html) using the data from the US Department of
Education on autism. The US Department of Education has used the same diagnostic criterion since 1991/1992 for autism.
Our son, Eric was born normal in 1985 and regressed into autism after receiving the measles-mumps-rubella (MMR)
vaccine in April 1986. Eric tested positive for myelin basic protein antibodies, has elevated measles antibody titers, T-cell
abnormalities as well as colitis. Research that Vijendra Singh, PhD. has done to show that children with autism have elevated
measles antibody titers and research that Andrew Wakefield, MD has done to show that children with auitism have measles
in the gut can be replicated. Unfortunately, the medical establishment is preventing this from moving forward. They would rather
publish epidemiological studies and write letters denying this clinical science than trying to replicate this very credible science.
Our son, Eric is 19 years old and is over 6 feet tall and weighs 213 pounds. When he has a tantrum, he will head-butt, bite, kick, scratch and pull hair of family members or school staff. We have him on 9 medications for his behavior and gut
problems. We hope to get him into the Kennedy-Krieger Institute in Baltimore, Maryland soon so they can better manage
his behavior problems by treating his behaviors with a three to four month in-patient stay. This will cost approximately
$50,000.00 a month. For the children/adults with autism as well as the families, autism is real. No one can miss these children/
adults regarding their diagnosis.
I have gone to several NIH meetings since 1995 and asked for the
NIH to fund immunology/gastroenterology research into the vaccine
(particularly the MMR vaccine) link to autism. To date, the NIH
has not moved on this important research. Also, Congressman
Dan Burton has found that employees of the NIH, CDC and FDA have
financial connections to the pharmaceutical companies. This is shameful since the NIH, CDC and FDA should represent the people
over the profits of companies.
The costs of autism both in human suffering and financial costs will continue to mount. That is why it is so important to
look into the vaccine link to autism now rather than acknowledge it later. If we wait, the epidemic will continue and the
human and financial costs will become insurmountable. The clock is ticking!!!
If something is not done soon to have the IOM, NIH, FDA and CDC start to
represent the parents rather than the pharmaceutical companies, parents like
myself will have to start a grass roots campaign to cut the budgets of the
IOM, NIH, FDA and CDC. I hope it will not come to that, but if we don't see a different direction by the FDA, CDC, NIH and IOM, immediately, then parents like myself will take action.

Missouri may
require vaccination
before kindergarten


The Missouri Department of Health and Senior Services is moving to
require all children in the state to be vaccinated for chickenpox before
they enter kindergarten.

Bryant McNally, director of the department's division of environmental
health and communicable disease prevention, said the department was
following the recommendation of a committee that advises the Centers for
Disease Control and Prevention on immunization practices.

Missouri already requires the chickenpox vaccination for children in day
care, and "a fair number of states" require it for admission to school,
McNally said. Illinois is among those states.

A committee of physicians, nurses and public health experts that advises
the Missouri department on immunizations recommended in June that
chickenpox be added to the list of those required for school entrance.
The list includes vaccinations for measles, mumps, rubella, pertussis,
tetanus, polio, diphtheria and hepatitis B.

McNally said the department published the proposed rule for chickenpox
vaccine in the Missouri Register and that the period of public comment
on it closed in December. "Now we're in the finalization stage,"
reviewing the comments and rewriting the rule if necessary, with
completion likely in April, he said. The rule would be effective for
children entering kindergarten in the fall of 2005.
The vaccine became available in 1995. Before then, in any given year the
disease resulted in 4 million cases, 11,000 hospitalizations and more
than 100 deaths, McNally said. "Chickenpox is an extremely infectious
disease."

Dr. Robert Belshe, director of the center for vaccine development at St.
Louis University, described chickenpox in young children as "a
relatively mild, self-limited illness that lasts two weeks and is gone."
But older children and young adults who don't get the vaccine are
susceptible to more serious illness, including pneumonia, and may
require hospitalization, he said. "Sometimes they get very, very sick."

Belshe described requiring the vaccine for school entry as "a reasonable
thing to do" and "one way to improve immunization rates."

The vaccine is usually given to children from 12 to 18 months old, but
Belshe said it was also effective in school-age children. He called it
"an incredibly safe vaccine" whose adverse effects are usually limited
to a rash at the vaccination site.

The disease itself is believed to boost immunity to shingles, which
people can get in later life. Belshe said a trial was under way to
determine if the vaccine offered the same benefit.

You are right, HB1226 got it's start from federal "model legislation" - no doubt all part of the homeland security push.

Jeff,

I hope you are right - feds have already tried to put the mechanisms in place to Mandame vaccines for everyone.  In the Missouri legislature in 2002 we fought what was called "The Emergency Health Powers Act". It would have given the governor the power to mandate vaccines for everyone just because he thought there MIGHT be a danger at some point in time somewhere in the world.  The bill passed, but not before we stripped it down to practically nothing.

We need to continue to be vigilant and fight these battles....

Welcome to the Homeland Security Act!  This is one of the reasons why I've
been forwarding information regarding the military and the anthrax/smallpox
vaccine to the list.  They are coming up next to the public.  Every citizen
needs to become educated on this.  Everyone needs to check out their state's
bioterrorism plan.  If the Federal Government has its way, it will NOT be
voluntary, not even for the public.    Of coarse, one MAY have the option
for being quarantined.
Now, picture this... there's at least 50 NEW biological warfare vaccines
coming down the pipeline for our military.  Keep in mind, using HUMAN trials
for data will be 'unethical'. (thus, the animal efficacy rule comes into
play from the FDA).  This means no 'real data' will be known on either
safety or efficacy, until the experiment has gone underway.  Ah... our
military comes through for us again.  People need to become educated... and
quick.

again....

HB1226 is intended to give "first responders" the first shot (pun
intended) at vaccines in the event of a bioterrorist event.  Most of the
bill is quite reasonable - they would have the greatest exposure and
deserve what they personally believe to provide themselves the best
protection as they protect the rest of us.

One problem with the bill, however, is that some first responders will
not have a choice.  Notice paragraph 3:

3. Participation in the vaccination program shall be voluntary by the first
responders, except for first responders who, as determined by their
employer, cannot safely
perform emergency responsibilities when responding to a bioterrorism
event or suspected
bioterrorism event without being vaccinated. (Emp added RC) The
recommendations of the Centers for
Disease Control and Prevention's Advisory Committee on Immunization
Practices shall be
followed when providing appropriate screening for contraindications to
vaccination for
first responders. A first responder shall be exempt from vaccinations
when a written
statement from a licensed physician is presented to their employer
indicating that a vaccine
is medically contraindicated for such person.

First responders will be subject to the whim of their employers -
employers who often are not qualified to make this type of decision.

I believe we should support this bill, but only if participation is
totally voluntary.

JMHO, but I seriously doubt the Feds would be able to pull this one off (mandating EVERYONE have these vaccines).  The government is so inept...trying to round up everyone to receive these vaccines would be darn near impossible.  There'd be widespread revolt even if they tried to do this...can't see it happening.

(FinalCall.com) - According to a genetics expert from the largest European pharmaceutical corporation in the world, GlaxoSmithKline, 90 percent of drugs only work in 30-50 percent of people. Geneticist Allen Roses said that "drugs in the market work, but they don’t work in everybody."

Mr. Roses also quoted research results by a medical diagnostic, Brian Spear, who three years earlier, had found that different drugs had vastly different success rates in treating patients.

The consequences of this finding are real and form the basis of what is termed "business with disease" in an astounding complaint filed with the International Criminal Court that names President George Bush, members of  his staff, British Prime Minister Tony Blair and some of the largest pharmaceutical companies in the world, including GlaxoSmithKline.

However, this information seldom reaches the patients who are prescribed these drugs. Whether they work or not, these drugs are paid for by the patient or government programs that supplement the cost.

Just recently, President Bush signed a $400 billion healthcare bill which, according to Congresswoman Nancy Pelosi, will set aside $139 billion for drug companies. Despite questions on their effectiveness, the pharmaceutical companies get paid.

The medical term describing the adverse effects of drugs administered by doctors is "iatrogenetics." In fact, any adverse condition resulting from the care of a physician or surgeon, especially in cases of infections acquired by the patient during the course of treatment, is termed "iatrogenetic."

"It is evident that the American medical system is the leading cause of death and injury in the United States," declared a medical group that released a study entitled, "Death by Medicine."

The researchers of the study examined different aspects of iatrogenic occurrences and styled tables and charts to show the devastating horrors not reported. They found that as many as 7.5 million unnecessary medical and surgical procedures are performed annually, and that 8.9 million patients may have been exposed to hospitalization unnecessarily.

Three independent studies of iatrogneic deaths concluded that 106,000 deaths resulted from adverse drug reactions; 98,000 deaths were caused by medical errors; and more than 115,000 cases of bedsores ended in death. The economic cost of medical intervention in these cases totaled almost $70 billion.

These figures, the study continued, represent only a one-year period. However, if these stats were to be multiplied by 10 years, the total number of iatrogenic deaths would exceed all the casualties of the wars in which America has fought. The projected figure is approximately 7.8 million iatrogenic deaths.

"What we must deduce from this report is that medicine is in need of complete and total reform. We are fully aware that what stands in the way of change are powerful pharmaceutical companies, medical technology companies and special interest groups with enormous vested interests in the business of medicine," the study acknowledged.

Avemtis Corporation is a major manufacturer of the now popular "flu vaccine" that the public is now rushing to get for fear of a dreaded "killer" flu virus. Aventis profits can be traced back to supporters of the Bush presidency. Secretary of Defense Donald Rumsfeld was, at one time, the head of Searle Pharmaceuticals. 

"You only have to look at the number of invested people on hospital, medical and government health advisory boards to see the conflict of interest," the report continued.

Recently, U.S. District Court Judge Emmet Sullivan ruled that the military could not force soldiers to take the anthrax vaccine, equating such force as treating the troops like "guinea pigs."

Experts Fear Global Bird Flu Outbreak
Sudden Sweep of Bird Flu in Asia Leaves Scientists Worrying of
Possible Global Human Pandemic

Jan. 24 - With luck, the world will escape the latest outbreak of
bird flu with no more than the six human deaths already blamed on it
and the loss of millions of chickens. But public health experts worry
of a much greater disaster: A catastrophe they say is among the worst
imaginable, a global outbreak of an entirely new form of human flu.
There is no clear sign that will happen. Nevertheless, avian
influenza's sudden sweep through Asia, along with its tendency for
wholesale mutation, leave many wondering about the bug's potential
for rampant spread among humans. It is a possibility the medical
journal The Lancet calls "massively frightening."

"The question everybody is asking is, 'Is this the progenitor to a
pandemic?'" says Dr. Gregory Poland, chief of vaccine research at the
Mayo Clinic.

Influenza pandemics typically strike three or four times a century.
The worst in the past 100 years, the 1918-19 Spanish flu, caused an
estimated 40 million to 50 million deaths. Another is considered
inevitable and perhaps overdue, but when it will happen and how bad
it will be are almost totally unpredictable.

The nightmare this time would be a flu virus leaping from birds to
people and spreading, introducing a disease for which humans have no
natural defense.

The potential source is the strain of bird flu that has moved rapidly
through parts of Asia since December, infecting chickens in at least
six countries.

Millions of birds have died of the flu or were destroyed by workers
trying to contain the outbreak. The World Health Organization says
eliminating this "animal reservoir" is urgent.

Avian flu is naturally carried by wild ducks, and it ordinarily does
not attack creatures other than birds or pigs, so experts are
especially concerned that this bird flu is occasionally infecting
people.

Human cases have been reported in Vietnam and Thailand, including six
deaths as of Saturday in Vietnam, the WHO said, and one suspected
death in Thailand. Experts believe all caught the virus from
chickens, not other people.

"We know there are two possible ways a new pandemic strain can
emerge," said Dr. Steve Ostroff, deputy director of the National
Center for Infectious Diseases at the Centers for Disease Control and
Prevention. One is a human flu virus that resurfaces after years of
dormancy, so people have no defense built up from earlier bouts. The
other is a non-human variety acquiring the ability to infect people
and spread.

The latter may happen if somebody already infected with a human flu
virus also catches the bird virus. Inside the body, these two may
recombine into a new mutant, part-human virus, part-bird.

The more people are around infected chickens and other birds, experts
say, the more chances there are for such a disaster to occur.

"If the virus continues to spread in chickens, it may adapt itself so
it can grow in humans," says Dr. Arnold Monto, a University of
Michigan epidemiologist. "If it is transmitted human to human, then
we are concerned this is the start of the great pandemic."

The first time an avian flu virus was found to have infected people
was in Hong Kong in 1997. At least 18 people fell severely ill and
six died.

Experts believe a pandemic may have been averted that time by the
rapid slaughter of Hong Kong's entire poultry supply an estimated 1.5
million birds killed in three days.

That flu virus was the H5N1 variety, one of 15 known subtypes of
avian flu. The WHO calls it worrisome for several reason: It mutates
rapidly and tends to acquire genes from flu viruses in other animal
species; it is clearly dangerous to people; and it spreads quickly.
Infected birds give off the virus for at least 10 days in their feces
and oral secretions.

H5N1 appeared again last February, when two members of a family
returning to Hong Kong from China became ill. One died and the other
recovered. How and where they got infected was never learned.

The disease now circulating in Asia is the same H5N1, but it is so
widespread that a quick purging, like Hong Kong accomplished seven
years ago, is unlikely. Testing shows it has mutated but has not yet
picked up any genes from human flu viruses.

If a bird flu pandemic occurs, could it be stopped? Many experts fear
not. Flu is so contagious that quarantining victims, a method that
eventually contained SARS last year, is unlikely to work.

Studies suggest that prescription drugs used to treat human flu
strains could also keep people from catching the bird flu. However,
spot shortages were reported during this winter's U.S. flu outbreak,
and supplies would quickly run out during a pandemic. No country has
stockpiled the drugs, Tamiflu, Relenza and the older amantadine and
rimantadine.

The WHO is already working on a prototype vaccine against the bird
flu. But even the standard annual flu shot takes six months to
manufacture, and experts doubt a new vaccine could be ready in time.

If there is evidence the bird flu is producing significant illness in
humans, "there would be a full-bore effort to produce a vaccine,"
says the CDC's Ostroff. "It's hard to predict the timeliness of it
and how widely it could be put into people's arms."

Remember... it's the FDA now (the organization 'supposedly' in charge of 'protecting the health of the public') that has now cleared this for public use.  Considering the DoD has indemnified Bioport from lawsuits stemming from injuries from soldiers, based on the "unusually hazardous adverse reactions", who will now indemnify Bioport/FDA from lawsuits from the public for "unusually hazardous adverse reactions"?

Anthrax ruling a victory for local mom

MISSOULA – It took three years, but there it was: Just before Christmas, a federal judge ruled that “Absent an informed consent or presidential waiver, the United States cannot demand that members of the armed forces serve as guinea pigs for experimental drugs.”

Kathy Hubbell of Missoula knows the fight over the anthrax vaccine is far from over. Still, she says, “We were absolutely thrilled that the judge had the courage and integrity to tell the truth about the vaccine.”

Hubbell had never heard of the controversy surrounding the vaccine when, back in 2000, she visited her son, John Hubbell, before the Air Force deployed him to the Middle East. In 1996 John had been in Saudi Arabia, and was en route to the Khobar Towers in Dhahram when terrorists exploded a massive truck bomb there that killed 19 American service members and injured hundreds of others.

“There was about a 5-minute window there, or we might have lost him,” Hubbell says. “Ever since, I’ve organized family reunions or gone to visit him every time he was going to be deployed overseas.”

And in 2000, as he prepared for his third deployment to the Middle East, Kathy’s visit found her son and daughter-in-law “up in arms” over the anthrax vaccine that was being forced on him by the Air Force.

“Really, I thought some right-wing wackos had gotten ahold of them and brainwashed them,” Hubbell says.

But their concern over the vaccine prompted Hubbell to start researching the subject.

“I went looking on the Internet for something that was not hysterical, not emotional; I wanted facts,” says Hubbell, who runs a public relations firm out of her Missoula home. “I found that when I came across the site sponsored by Maj. Sonnie Bates.”

Bates, Hubbell says, is the highest-ranking officer to refuse the anthrax vaccine, costing him his military career.

“His letter to his commanding officer explaining why he would not take it had a military precision to it,” she says. “It was just fact, fact, fact, fact. It convinced me there was a real problem here, and I had to get involved. The people this is affecting can have their pay docked, be demoted, be court-martialed. They can’t speak up, so I figured it’s up to the parents to do it.”

Hubbell helped start the Anthrax Vaccine Network, which has since spawned the Military Vaccine Education Center. They have discovered that the Department of Defense can be a formidable opponent.

What is it that has some service members upset about the vaccination?

Reactions that, in John Hubbell’s case, according to his mother, had him develop severe joint and bone pain, lesions, short-term memory loss and a heart murmur that had not existed before.

“And he’s one of the lucky ones,” Kathy says. The vaccine has been linked to six deaths, and to troops who have been permanently disabled by its side effects.

“The original label on the vaccine said side effects were reported by 0.2 percent of the people who took it,” Hubbell says. “The new label says it’s 35 percent, and earlier this year the (General Accounting Office) said it’s up to 85 percent. But military doctors deny any connection to the vaccine, and if anyone insists that, yes, it’s due to the vaccine, they’re told they’re malingerers and sent to psychiatrists instead.”

The vaccine, licensed to protect against anthrax-to-skin contact, is also being used as protection against inhaled anthrax – the most likely form of biological warfare a soldier might face – even though the vaccine had not been approved for such use, Hubbell says.

“They’re using animal data to make that claim, even though we don’t know if the animal data can be transferred to human reaction,” Hubbell says.

U.S. intelligence agencies tell us anthrax is a top choice for use as a biological warfare agent according to the Department of Defense’s Anthrax Vaccine Immunization Program (AVIP). “Anthrax spores are relatively easy to produce, remain dangerous for decades, and can be spread in the air easily,” AVIP says on its Web site, www.anthrax.osd.mil. “Because of its deadliness, inhalational anthrax is the type of anthrax potential enemies have the capability to use against our troops.”

AVIP says the anthrax vaccine is as safe as any vaccine, adding, “Many people get bothersome side effects where any vaccine is injected. People report headaches, muscle aches, and other temporary symptoms after any vaccine. Study after study shows: people vaccinated against anthrax are as healthy as unvaccinated people.”

“Your health and safety are our No. 1 concerns,” AVIP tells men and women in the service. “We know anthrax vaccine works, because it protected mill workers in a study conducted by CDC scientists. Anthrax vaccine protected animals from inhalational anthrax in multiple studies. Anthrax vaccine works basically the same way other vaccines do. Like other vaccines, anthrax vaccine is not perfect.”

Shortly after Judge Emmet G. Sullivan issued his ruling barring the military from administering mandatory anthrax vaccine inoculations, the Food and Drug Administration declared the anthrax vaccine “safe and effective.”

The FDA said its “final rule and order” is that the vaccine is “safe and effective for the prevention of anthrax disease – regardless of the route of exposure.”

The FDA also cited an independent review of the vaccine by the Institute of Medicine, which concluded that it was safe.

Responded the Military Vaccine Education Center: “Here we go. If anyone ever needed evidence that the FDA is tucked securely and safely into the back pocket of the Department of Defense, here it is. A few points to remember:

“1) The Pentagon funded the Institute of Medicine study, and there isn’t a single dissenting opinion in it, even the Army’s own publicly stated opinion that the anthrax vaccine is highly reactive. Furthermore, the study conveniently ignores independent studies as well as the label on the vaccine itself.

“2) The FDA/DoD consortium here is trying to use animal data to back up this current claim that the vaccine is safe and effective. This move is a direct outcome of the fact that the Bush administration, in conjunction with the FDA, has moved to declare animal data acceptable in vaccine research without human data trials. Feel safer now?

“3) Snip from the article: Lawyers for the plaintiffs in the lawsuit issued a statement saying that the FDA’s ruling is nothing more than ‘after-the-fact gamesmanship to overrule the Court’s findings.’”

Says Hubbell, “I thought we signed something called the Nuremberg Code after World War II that said we would never conduct experimentation on human beings. Congress blasted the military in 1996 for continuously experimenting on our own troops since World War II, and they listed the anthrax vaccine as one of them.

“Walter Reed Hospital has an entire wing devoted to people who’ve gotten sick from military vaccines,” she goes on. “The FDA is so bogus. I’d like those people to take a tour of that wing some time.”

Staff Sgt. John Hubbell is out of the Air Force now after a 10-year career that saw him deployed to Saudi Arabia twice, plus Egypt and South Korea. His mother says he still experiences some of the side effects from the anthrax vaccine.

“It broke his heart to leave, because he wanted to serve,” she says. “The military shouldn’t so blithely let good people go over a vaccine. There are a lot of people like him out there.”

Welcome to the Homeland Security Act!  This is one of the reasons why I've
been forwarding information regarding the military and the anthrax/smallpox
vaccine to the list.  They are coming up next to the public.  Every citizen
needs to become educated on this.  Everyone needs to check out their state's
bioterrorism plan.  If the Federal Government has its way, it will NOT be
voluntary, not even for the public.    Of coarse, one MAY have the option
for being quarantined.
Now, picture this... there's at least 50 NEW biological warfare vaccines
coming down the pipeline for our military.  Keep in mind, using HUMAN trials
for data will be 'unethical'. (thus, the animal efficacy rule comes into
play from the FDA).  This means no 'real data' will be known on either
safety or efficacy, until the experiment has gone underway.  Ah... our
military comes through for us again.  People need to become educated... and
quick.

Subject: Another vaccine bill in Missouri

If you think that mandating vaccines is only about school kids, think
again....

HB1226 is intended to give "first responders" the first shot (pun
intended) at vaccines in the event of a bioterrorist event.  Most of the
bill is quite reasonable - they would have the greatest exposure and
deserve what they personally believe to provide themselves the best
protection as they protect the rest of us.

One problem with the bill, however, is that some first responders will
not have a choice.  Notice paragraph 3:

3. Participation in the vaccination program shall be voluntary by the first
responders, except for first responders who, as determined by their
employer, cannot safely
perform emergency responsibilities when responding to a bioterrorism
event or suspected
bioterrorism event without being vaccinated. (Emp added RC) The
recommendations of the Centers for
Disease Control and Prevention's Advisory Committee on Immunization
Practices shall be
followed when providing appropriate screening for contraindications to
vaccination for
first responders. A first responder shall be exempt from vaccinations
when a written
statement from a licensed physician is presented to their employer
indicating that a vaccine
is medically contraindicated for such person.

First responders will be subject to the whim of their employers -
employers who often are not qualified to make this type of decision.

I believe we should support this bill, but only if participation is
totally voluntary.

Legal fight puts Marine in limbo

For the last three years, Ocean Rose of Marietta has been trapped in the military version of purgatory.

In January 2001, the Walton High School graduate pleaded guilty to disobeying a superior officer. Busted to private, he was drummed out of the Marine Corps with a bad conduct discharge.

With his case on appeal since then, he technically remains a member of the Marine Corps even though he is not being paid and is not allowed to perform his duties as a firefighter and hazardous materials specialist.

Neither in nor out of the service, he finds his life and career in legal limbo.

"It's odd," Rose said recently at his parents' east Cobb home, "but maybe because it's been going on so long, it seems normal to me."

Rose, 23, is among hundreds of members of the armed forces who since 1998 have faced legal action for refusing to obey the same order: Submit to a series of anthrax inoculations.

The refusal of all of them stems from their concern about the safety and effectiveness of the shots. Yet their punishment has been far from uniform.

• Air Force Capt. John Buck, a physician from Pascagoula, Miss., stationed at Keesler Air Force Base, was convicted at court-martial in May 2001 for refusing to take the vaccine. He was denied promotion and fined $21,000 but given an honorable discharge.

• Joy Jama of Fairfax, Va., a former senior airman at Shaw Air Force Base, S.C., refused three times to take the anthrax shots. Instead of a court-martial, she was given what the military calls nonjudicial punishment, decided on by her commander. Eventually she received a general discharge under other than honorable conditions but was allowed to keep her top secret security clearance and now works for a defense contractor.

• James Muhammad of Washington, a former sergeant who wanted to make the Marine Corps his career, refused to take the anthrax vaccine last year. He pleaded guilty at a court-martial and was sent to the brig for 60 days, busted to private and given a bad conduct discharge.

• Kurt Hickman, an Ohio National Guard soldier, is facing a second military trial for refusing to take the vaccine. Found guilty in the first trial under Ohio's version of the Uniform Code of Military Justice, he was sentenced to 40 days in jail, ordered to repay a college loan from the state, and given a less-than-honorable discharge. Before Hickman went to jail, his unit was mobilized for duty in Iraq. Again he refused to take the vaccine, this time while on active duty, and a decision on another court-martial is pending.

Marines 'the worst'

Critics of the anthrax vaccine program complain that the punishments are not equitable across the services. They also say refusing to take the vaccine should not be a crime in the first place. Instead, they argue the order is illegal because the vaccine has not been proved safe or effective in humans.

"We don't know why there is such a disparity [in punishment] among the services, but the Marines seem to be the worst in the sense of being the harshest," said Mark Zaid, a Washington lawyer who has filed suit against the Pentagon on behalf of six anonymous vaccine refusers.

Pentagon officials contend the anthrax inoculations are necessary because the virus could be used by terrorists as a biological weapon. Those who resist the shots are endangering not only themselves but also others around them, these officials say.

Zaid, a defense lawyer in 10 trials involving the vaccine program, said military judges had not permitted the Pentagon's order to be challenged in any of the vaccine refuser cases. Neither have defense lawyers been able to question the safety of the vaccine or its possible harmful side effects.

"Military judges shot us down every time," Zaid said. "We never got to the merits of the argument."

Calling his defense "very limited" because of similar rulings, Rose said that "the court made it obvious anthrax [vaccine] was allowed, it was not against the law, and . . . it's safe."

Before deciding to refuse, Rose submitted to two of the shots in early 2000, shortly after arriving at Marine Corps Air Station Miramar in San Diego.

After the first shot, he experienced flulike symptoms and "a pretty good-sized lump in my arm." He had the same reaction to the second shot.

Then he went for a physical that included an electrocardiogram.

"The EKG indicated I was having a heart attack," Rose said. "I started to get worried because heart disease runs in my family. My father has had a heart attack, and my grandfather died of a heart attack."

He asked for a second test on a different machine. The results, he said, were the same.

Puzzled, Rose wondered how he could go in just a few months from being a healthy young Marine to someone with heart trouble. When Rose expressed concern that the aberrant heartbeat might have resulted from the anthrax shots, a Navy doctor replied that they were safer than flu shots.

"This wasn't adding up," said Rose, who began doing research on the vaccine. "I found things the military doesn't want you to know" about possible adverse effects and health risks for those who take the vaccine.

Critics of the vaccine have questioned the adequacy of its testing and expressed concern about possible links to cancer and birth defects.

The military insists the vaccine is safe. "Our position is the same position as the [Food and Drug Administration]: The vaccine is safe and effective," said Jim Turner, a Pentagon spokesman.

But the FDA did not make that ruling until last month.

For the previous 18 years, Zaid said, the vaccine had been considered an investigational drug, that is, one that is under study but is not yet permitted to be legally marketed and sold in the United States.

Injunction halted

The FDA's finding came in the midst of Zaid's suit against the government and just a week after a U.S. District Court judge in the District of Columbia issued an injunction stopping the Pentagon from ordering further anthrax inoculations because of his concerns about their safety.

Despite his misgivings about the timing of the FDA's ruling, Judge Emmet Sullivan lifted the injunction and the shots resumed.

Over the last three years, Zaid said, many vaccine refusers have been given nonjudicial punishment and a general discharge rather than court-martial.

The services differ on the quality of statistics they keep regarding vaccine refusers, despite a law requiring them to submit detailed annual reports to Congress.

Spokeswoman Valerie Burkes said 85 vaccine refusers in the Air Force had legal action taken against them since 2000. Only three were court-martialed.

Army spokeswoman Martha Rudd said the Army did not specifically track cases of vaccine refusers.

"We are aware of a few cases in the last several years, but the number is small," she said in an e-mail response to questions.

Burkes, also responding by e-mail, said no policy determined how commanders should deal with anthrax refusal cases or what punishment should be given.

"Each commander exercises his or her own best judgment, after reviewing all the facts, in determining how to appropriately handle a case in the best interests of justice," Burkes wrote.

The Navy judge advocate general's office, which handles Navy and Marine Corps cases, said it also did not track vaccine refuser cases.

Carolyn Alison, an office spokeswoman, said "fewer than 10" anthrax refusal cases were pending before the Navy-Marine Corps Court of Criminal Appeals, Rose's among them.

Rose decision perplexing

Rose's case has twice gone before the Naval Clemency and Parole Board, which reviews discharges for possible upgrading.

The first time, a recommendation that Rose be reinstated to active duty was denied. The second time, a recommendation that his discharge be upgraded also was denied, said Geoff Lyon, a Washington lawyer and retired Marine lieutenant colonel who was on the board.

Of 16 cases considered for upgrading when he was the board's president, Lyon said 12, including Rose's, were sent to the Department of the Navy with a recommendation for upgrade.

"His package was stronger than the other 12 we upgraded," said Lyon. But the upgrade was denied without explanation.

Rose is permitted to wear his uniform but chooses not to. He does not want to strip off the treasured lance corporal stripes he earned during the two years he served.

Rose has no discharge papers, since legally he is still a Marine. Without a discharge, many prospective employers are reluctant to hire him because he could be called back to active duty at any time.

If his bad conduct discharge is not overturned or upgraded, he will be unable to get a government job or be eligible for veterans benefits.

Until about six months ago, Rose made do with a series of low-paying jobs. He now works as a hazardous materials specialist for a New Jersey company.

Rose's lone hope is for the appeals court to side with him. But that could take years. Some appellate cases are more than 5 years old.

He said he has no regrets and still loves the Marine Corps.

"I'm comfortable with the decision I made," he said. "But I thought the punishment seemed severe. I was being compared to someone who disobeyed an order to protect my country, but all I did was refuse to take a shot."

There are too many outstanding questions about the effectiveness of the chicken pox vaccines to justify their addition to the mandatory vaccine list in Missouri 

By Statute the only way to stop it is to prove that
“The rule is so arbitrary and capricious as to create such substantial inequity as to be unreasonably burdensome on persons affected” RSMo 536.014

The Rule is moving through the process.  By law this ruling goes into effect on the 13th of February.  We must get a hearing with the Joint Committee of Administrative Rules by then.  We need your help!  If you have a medical background or personal experience with a chicken pox immunization, are willing to attend the hearing, or give testimony to the Joint Committee of Administrative Rules, please contact the following right away:

If you think that mandating vaccines is only about school kids, think again....

HB1226 is intended to give "first responders" the first shot (pun intended) at vaccines in the event of a bioterrorist event.  Most of the bill is quite reasonable - they would have the greatest exposure and deserve what they personally believe to provide themselves the best protection as they protect the rest of us.

One problem with the bill, however, is that some first responders will not have a choice.  Notice paragraph 3:

3. Participation in the vaccination program shall be voluntary by the first
responders, except for first responders who, as determined by their employer, cannot safely
perform emergency responsibilities when responding to a bioterrorism event or suspected
bioterrorism event without being vaccinated. (Emp added RC) The recommendations of the Centers for
Disease Control and Prevention's Advisory Committee on Immunization Practices shall be
followed when providing appropriate screening for contraindications to vaccination for
first responders. A first responder shall be exempt from vaccinations when a written
statement from a licensed physician is presented to their employer indicating that a vaccine
is medically contraindicated for such person.

First responders will be subject to the whim of their employers - employers who often are not qualified to make this type of decision.

I believe we should support this bill, but only if participation is totally voluntary.

Lawsuit Forces School To Readmit Student Who Was Expelled
For Refusing The Hepatitis B Vaccination
Camden, NJ – Nancy Mergenthal filed suit on behalf of her son against the
Gloucester Township School District after he was expelled by school
officials in December of 2003 for refusing to receive the Hepatitis B
vaccine. Mrs. Mergenthal is represented by Mathew D. Staver, President and
General Counsel of Liberty Counsel, and Joel Oster, Litigation Counsel for
Liberty Counsel.

Mrs. Mergenthal is a Christian who worships at the Bethel Christian Center.
She has a sincerely held belief that her body is the temple of God that she
should not intentionally defile, and she has come to believe that she
should
not subject her children to immunizations, particularly Hepatitis B. Her
oldest son, Gene, at one time had a severe reaction to an immunization and
almost died. New Jersey law provides that a child shall be exempted from
mandatory immunization if the parent objects in writing, explaining how the
administration of the immunization conflicts with a bona fide religious
tenet or practice.

After school officials informed Mrs. Mergenthal that her son must be
immunized, she submitted a written request for exemption, explaining in
detail her religious beliefs and why immunizations conflicted with these
beliefs. Mrs. Mergenthal’s pastor and her physician also submitted letters
supporting her objection to immunizations. The pastor, Rev. Kurt Kinney,
stated in part: “I am writing as her pastor to plead with you to listen
with
an open heart to her request and grant that which she asks so that Matthew
can return to the school he enjoys and see the fairness of this great
state.” Despite her request, the state of New Jersey denied the exemption
and the school expelled Matthew and then threatened to pursue truancy
charges against Mrs. Mergenthal.

After Mrs. Mergenthal filed suit on January 4, 2004, school officials
agreed
to allow Matthew to return to school, but the case is still pending. Staver
said, “Many people have sincerely held religious beliefs that do not permit
them to subject their bodies to immunizations in general, or to some
immunizations in particular. That’s why virtually every state in the
country
has an exemption from mandatory immunizations for medical or religious
reasons. Although New Jersey has such an exemption provision, state and
school officials ran roughshod over Mrs. Mergenthal’s religious beliefs.
It’
s a sad day when government officials will only respect constitutional
liberties after they are subjected to a lawsuit.” Hepatitis B is not a
highly contagious condition. It can only be transmitted in one of three
ways. These three risk factors include a mother who is chronically infected
at the time of birth, blood products primarily through sharing dirty
needles, or promiscuous sex. Forcing a Hepatitis B vaccine on children
conflicts with most religious beliefs and instruction of parents that their
children should avoid promiscuous sex and illegal drug use.
