I thought I would write to give you an update regarding the refusal of treatment because I have a latex allergy.
After posting to LANTERN on May 15, 2006, I called Michigan Department Civil Rights. I tried to file a complaint against the physical therapy home care - Metro Home Health Care, Dr. Friedman and Dr. Chang, in Dearborn, MI. Friedman & Chang were the surgeons that refuse to treat my father because he has a type 4 (contact NRLA) and I would be his care giver.... It took them about a week to call me back. Their decision ~ Refused to take my claim!! Here is their formal comment – “YOU ARE NOT DISABLED UNDER THE CIVIL RIGHTS LAWS. YOU DO NOT HAVE A MAJOR LIFE ACTIVITY IMPAIRMENT”. I was livid.. Well the fight was on...
After I received the letter of refusal from the MDCR representative, I filed my Appeal. It ended up be a really big production. but, I was not going to let anyone else walk all over me again. I contacted my neurosurgeon, my primary care physician, my home nurse and the home care facilities I use. I also request letters from my husband, my sister, my daughter and granddaughter who all agreed. I guess my biggest surprise came from my neurosurgeon. He became very angry when I told him what they had said about my condition. His letter was the best of all. Here is his closing statement to MDCR ~ "From my perspective as a neurosurgeon, this condition is extraordinarily debilitating as if someone were totally paralyzed and/or had severe brain injury or condition. I support the concept that this is a disabling condition" Needless to say, he is my hero.
I also printed out any/all information on NRLA I thought they would/could understand. I also included the article from the UK about the man who tried to kill his ex-wife by spreading latex powder around her home while she was out. "American Charles Henson has been accused of trying to murder his former wife with a rubber glove - knowing she is allergic to latex. The 38-year-old, of no fixed abode, was remanded in custody at Cheltenham Magistrates' Court after he was accused of attempting to murder Alison Phelps."
In my letter to MDCR I wrote under COMPLAINANTS NOTES WHY DOESN’T THIS HOLD ANY WEIGHT UNDER ADA ? IF I CAN BE KILLED BY A LATEX GLOVE or The Powder from Latex Gloves, AS THIS WOMEN COULD HAVE BEEN, WHY - AM I NOT CONSIDERED “DISABLED” – AND “DO NOT HAVE A MAJOR LIFE ACTIVITY IMPAIRMENT”.
It was a success and the complaint against Metro Home Healthcare was put through. Even through MDCR caused the delay, the six months time limit to file was up on Friedman and Chang, I was unable to file against them. I will be contacting a lawyer next week to take care of those two. With my letter of approval from MDCR, I don't see any problem winning against them for discrimination under ADA..
Maybe this can help any of you who find themselves in the same situation. Hopefully this will get medical, dental, etc.., professions to take this a bit more seriously and stop procrastinating. My goal is to get rid of the Latex Glove use, COMPLETELY. MIGHT AS WELL ASK FOR IT ALL, I MAY JUST GET IT... I know this is a tall order, but as long as I am still breathing, they will know I am here. It may take a great deal of energy, but what else do I have to do now. I need a hobby... TTFN...
