I completely agree that not even one step in the study should take place before the REC approval specially that having REC in almost all the universities is a hot topic those days
in my Personal Openion that all studies should be published ,as the data can be helpful for other investigators to avoid exposing new patients for the same procedures &dangers that may have been harmful already for some patients
also may deprive the sience from new information or new technique
also as you said that will be unfair for the patient for the second time -as you said -by thrawing their data away

BUT ,on the other hand those regulations oblige the investigators &companies to seek the approval of the REC to add a value for the study by publishing the results
so as a compromise ,the results can be published by two conditions
1- mentioning on the top of the publication &mentioning the detailed procedures
2- not taking the study valid to be used in the investigator promotion
I know that all of that talk is not going ever to be considered ,but it is just personal openion
and after all ,what actually regulates the research from the ethical point of view is the investigator &his actual adherance to the ethical issues either being international or being social.

Dear friends and colleagues
We all know that it is almost impossible to publish data obtained
from "unethical" research or research that did not obtain REC/IRB
approval. Do you think it is fair to the subjects who were involved in
such research to throw their data away? Isn't this a waste of the
sacrifice the subjects made (even if they were unaware of it) and it is
twice unfair to subjects, once by enrolling them in unethical research
and the second time by throwing their existing data away?
Your thoughts and why?
