Hi Ginger,

It will take me 25min from my house to DeAnza and 20’ from DeAnza to Meseum, however it only takes me 15’ to the museum  from my house.

 

Can I meet everybody around 1pm at the museum – for the sake of the environmental and $3.60 for a gallon of gas ? I might take the light-rail too….hmmmm.

Thanks Deb.  Like I said this question came up on the yahoo massage practice builder site and a very heated discussion ensued.  The big problem I saw was that instead of saying simply "I specialize in womens issues many of the female therapists put it as I don't work on men because they might attack me.  This of course made some of the male therapists feel a bit stereotyped and ticked off.  Also a few of the female therapists had different acceptance criteria for male clients as they did for female clients.  From what I have gathered having as your specialty womens issues is perfectly alright but have as your specialty I don't work on men could be considered discriminitory (it is all in the wording).  Also having a new client go through different hoops because of race, gender, marital status, orientation etc. than others would be discriminatory.

medical conditions, I affirm that I will provide all of my known medical
conditions and answer all questions honestly. I am currently free of any

Yes you always have the right to refuse.  My question is regarding
having a policy of not accepting clients based on gender.  If you
refused clients because they were Asian or Black that would be very
cut a dried you are going to get sued.  Gender is a little more
tricky.  Let me also state I fully support men only refuges and women
only refuges (by refuge I mean a place of their own not a shelter) but
wonder about the legality.  Curves only allows women but what would
happen if someone opened a men only gym?

Thanks Emily.  Yes best judgement should always prevail.  What I was
looking into was the legality of having a policy of rejecting clients
based on gender and not because they were creepy.

It really depends on which city you're working in. And in most cities
aroaround this area (including Cupertino and San Jose) it's illegal to
actually work outside of your actual home. As for working on male
clients, I'm going to add that regardless of gender you can still be
harassed sexually or non-sexually. And even if it wasn't harassment,
you AND the client both have the right to refuse treating or being
treated.

If you aren't prenatal/perinatal certified you might be scared of
working on a pregnant woman and can refuse to treat her and it wouldn't
be discrimination - you would then instead refer her to someone like
myself or Debbie who are qualified to massage pregnant females.

The best advice I can give you is to use your best judgement. If as a
female therapist, you know that the male client tried to pick you up as
a therapist by "hitting on you" then you know it's not going to be wise
to expect him to expect more than just a therapeutic massage. And
regardless sometimes our judgements fail us, so by all means ALWAYS
have a paper contract signed before the treatment promising to respect
all boundaries between the client and therapist AND be ready to report
the person immediately if something happens.

On another massage discussion site the question of choosing not to
work on clients based on specific traits that are not due to any fault
of the clients.  Specifically choosing not to work on male clients.
Now I know this is a touchy subject but my question is does anyone
know if there is any legal precedent allowing to refuse a client based
on gender or prohibiting the practice.  Also some of the people seem
to think that if  you work out of your home the regular rules of
business do not apply.  Don't you have to follow all regulations
regarding a business even if you are working out of your family room
or spare bedroom?

Hello Everyone,

Dr. Forman and I were given the list of students today. I regret that Nov
16th is full up and we had to come up with a alternate date. Sorry if this
causes anyone that had signed up to not  be able to go.

workshop to All Massage Students on Friday Nov 16th "Introduction to the
Foundation Course" by Jean Couch owner of the Balance Center in Palo Alto.

We meet at the Divine Science Center, 1540 Hicks San Jose Ca 95125

Business Meeting & Potluck starts at 7:30pm

May I say thanks to all who helped out during Club day. We had a very
productive day. We also had a lot of people sign the sheet I hope at
least half of them will actually want to be in the club. Also a
special thanks to Dr. Forman for letting us borrow the massage chair
and table. I will soon let you all know when we can have our next club
meeting.
