To everyone:
I know with time winding down toward my 21st birthday (Feb. 23) when Alabama Medicaid arbitrarily ends my home care, you all have been wanting info on what I've been up to. Well, here goes.
I'll write down what I've done recently now (this will be long).
I will not go quietly.
Press release announcing lawsuit
http://NicksCrusade.com/NDpressrelease.doc
Jan. 31 my lawyers filed suit in federal court in Montgomery against the commissioner of the Alabama Medicaid Agency Mike Lewis and the newly elected governor Bob Riley to stop them from ending my care, on the grounds that their 21-cut off policy violates multiple sections of three separate federal laws (Medicaid law, the Rehabilitation Act of 1973 and the Americans with Disabilities Act). We are seeking a preliminary injunction to stop them from ending my care on Feb. 23 until the defendants are brought into compliance and a favorable resolution can be reached.
These are some of the documents that were filed in court Jan. 31. Once they are filed in court, they belong to the people of the US, so I can share them with anyone.
The civil complaint (12 pages).
Brief in support of application for temporary restraining order (9 pages).
Application for temporary restraining order (3 pages).
Again, these are public record.
Tomorrow, Tuesday Feb. 11, the case goes before the judge. Mom and I will drive two hours to Montgomery and go to the federal courthouse there where we will be sworn in and put on the stand (separately).
Wish me luck!
The judge is Mark Fuller, a one-month-old Bush appointee. I couldn't find anything about Fuller's views; the best I could do was this newspaper article from the Southeast Sun that goes over his bio and includes a photo ----> Fuller earns appointment as federal judge
The Mobile Register ran a great front page story about me last Friday; it ran next to Bush and Powell! :D
To read it, click here: Mobile Register: The prospects for Nick's future dim without Medicaid help.
I was on the front page of the Register again on Saturday.

Last week I went to Soundworks Studio in midtown Mobile and recorded a piece with National Public Radio's Joe Shapiro. He chopped the interviews with mom and I up, put in narration, and made it into a long story for NPR. The piece about me and Nick's Crusade will air nationally this (Monday) evening on NPR's All Things Considered. All Things Considered usually runs from 5pm-7pm EST and 4pm-6pm CST but if you're not a regular NPR listener, I'd go to NPR.com, put in a zip code and find out the schedule for your area. You can also listen in at NPR.com, so I hope none of you miss it! :D
In my last bit of news, today at 10am the Mobile County Commission will honor me with a resolution supporting Nick's Crusade. The resolution will also be sent to the Governor and Medicaid.
Thanks for reading,
Later,
Nick
