I very much agree that Zach needs to be in school and learning. My concern is that nothing has been done to assure me that there is an appropriate placement and a safe environment for Zach to return to school. We both know that this has been a recurring issue and that it really needs dealt with in a way to prevent it from recurring or even escalating further. I have been informed that Prone restraints are against the rules as well as illegal in the state of Michigan. A big reason for this is because they are so extremely dangerous. Zach is terrified of returning to school after his experience with the prone restraint being used on him for hours. He is still complaining that his side and back hurt and having bouts of anxiety where he is crying that he couldn't breathe during this incident. I am very concerned that he may be experiencing post traumatic stress disorder. I would very much like to schedule a new IEP meeting to address these issues. I never was informed that a new IEP was created, it was not created at the meeting Zachs dad attended and if there is a new one I have never seen it and have not been sent a copy. If there is a new one I am concerned that it was created with neither of Zach's parent's being informed or invited to this meeting or sent a copy and this being done when his 3 year review has not been completed or the results have not been looked at. The note I was sent only calls for testing and has no date on it and no box checked as to the purpose of the meeting or testing. I asked for a more complete evaluation as well as a full IQ test but I have never received anything as to dates and times for these tests to be complete. I am sure that Zach being at home should not have prevented this as was stated in a letter I received as I know services are required to be provided to even toddlers and home schooled children. Also I want to not again that I have requested educational services to be provided at home for Zach while the safety issue is being addressed and an approprate and safe environment is developed for Zach. I was refused but the reason I was told had nothing to do with the law that I requested it under. I am surprised that Mr Silver would be unaware that there are actually 2 types of home bound services. The first is medical homebound services, which is actually not about special education at all. It is a state law that applies to all students who are medically incapable of attending school (had a car accident, recovering from illness, etc). It DOES require a doctor's note and medical necessity. It is the kind that schools almost always think of when they talk about homebound services. However, there is a second kind of homebound services which many school personnel are not even aware of, which is home based services under the IDEA. That is a totally different kind of homebound services under a completely different law, and different rules apply. The IDEA home based services do NOT technically require a doctor's note, or even a medical condition. It is simply an IEP placement of providing services in the home, simply because that is the appropriate location to provide services for whatever reason for that particular child under the current circumstances. It is an issue of appropriate placement/location/setting, not a medical issue. One of the common reasons that this IDEA form of home based services is used is for children who have behavior problems that are not manageable in a school environment. I propose that we have a 30 day temporary home based placement be added to Zach's IEP. IDEA home based services option that does not require a doctor's note or medical condition. I think this is both fair and appropriate given the circumstances while we try to work together on fixing the issues in Zach's program. I am requesting that the recent incident report that was made concerning Zach's restraint last month be mailed to me as soon as possible as well as any other incident reports that may be in his file. I am also very concerned as to how there was a full investigation into this incident with out ever speaking to Zach? Every professional I have spoke to said that sounds very inappropriate and not done very professionally.
